      In accordance with subparagraph 1) of paragraph 2 of Article 17-1 of the Constitutional Law of the Republic of Kazakhstan dated December 26, 1995 "On the President of the Republic of Kazakhstan", I HEREBY RESOLVE:

      1. To approve the attached Regulation on the State Security Service of the Republic of Kazakhstan.

      2. To approve the attached amendments and additions which are introduced into some decrees of the President of the Republic of Kazakhstan.

      3. To recognize as invalid some acts of the President of the Republic of Kazakhstan in accordance with the annex to this Decree.

      4. This Decree shall enter into force from the date of signing.

REGULATIONS
on the State Security Service of the Republic of Kazakhstan

Chapter 1. General provisions

      1. The State Security Service of the Republic of Kazakhstan (hereinafter referred to as the State Security Service) is a special state body directly subordinate and accountable to the President of the Republic of Kazakhstan, related to the national security forces of the Republic of Kazakhstan and carrying out, within the competence established by law, security measures to ensure the safety of the President of the Republic of Kazakhstan, other protected persons and objects.

      2. The State Security Service has a department - the Special Purpose Forces of the State Security Service (hereinafter - Special Purpose Forces).

      The Special Purpose Forces is a military formation.

      3. The State Security Service shall operate in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as these Regulations.

      4. The State Security Service shall be a legal entity in the organizational and legal form of a state institution, have a valid and conventional name, seals with the image of the State Emblem of the Republic of Kazakhstan, stamps, letterheads in the state and Russian languages of the established pattern, its symbols and insignia, flag, banner, as well as accounts in accordance with the legislation of the Republic of Kazakhstan.

      5. The State Security Service shall enter into civil legal relations on its own behalf.

      6. The State Security Service shall have the right to act as a party to civil law relations on behalf of the state if it is authorized to do so in accordance with the legislation of the Republic of Kazakhstan.

      7. On issues of its competence the State Security Service, as required law, shall make decisions, formalized by orders of the head of the State Security Service and other acts provided for by the legislation of the Republic of Kazakhstan.

      8. The structure and staffing limit of the State Security Service shall be approved by the President of the Republic of Kazakhstan upon recommendation of the head of the State Security Service.

      The staff number of the State Security Service shall be established by the head of the State Security Service within the limits of the funds allocated for these purposes.

      9. Location of the legal entity: 010000, Republic of Kazakhstan, Astana city, Mangilik El Avenue, 30.

      10. These Regulations shall be the constituent document of the State Security Service.

      11. The State Security Service activities shall be financed from the republican budget in accordance with the legislation of the Republic of Kazakhstan.

      12. The State Security Service may not enter into contractual relations with business entities for the performance of duties that are the powers of the State Security Service.

      If the State Security Service is granted the right to carry out income-generating activities by legislative acts, then the income generated shall be directed to the state budget, unless otherwise established by the legislation of the Republic of Kazakhstan.

Chapter 2. Tasks and powers of the State Security Service

      13. Tasks:

      1) ensuring the safety of the President of the Republic of Kazakhstan and other protected persons;

      2) identification, prevention and suppression of offenses directed against the life, health, rights, freedoms, dignity of the person and property of the President of the Republic of Kazakhstan and other protected persons;

      3) protection of property, ensuring public order and security at protected sites and in other places of stay of protected persons;

      4) implementation of counter-terrorism within the limits of their powers;

      5) projecting and identifying threats to protected persons and objects, implementing a set of operational measures to prevent and neutralize them;

      6) protection of the standards of the State Flag of the Republic of Kazakhstan and the State Emblem of the Republic of Kazakhstan and participation in the fulfillment of ceremonial and protocol events;

      7) organization of presidential communications;

      8) other tasks determined by laws and acts of the President of the Republic of Kazakhstan.

      16. Powers:

      1) rights:

      check the identity documents of individuals at the entrance (entry) to protected objects and when leaving (exiting) them, conduct a personal search of them (with the exception of protected persons), inspection of their belongings, inspection of vehicles and things carried on them, including the use of technical means;

      prohibit the bringing of objects and substances into protected facilities;

      if necessary, create operational headquarters for carrying out protective measures (hereinafter referred to as operational headquarters), the status and powers of which are determined by the regulations approved by the joint order of state bodies that are part of the republican operational headquarters for carrying out security measures;

      photographing, sound recording, filming and video recording of facts and events during security measures;

      conducting an inquiry within the powers established by the laws of the Republic of Kazakhstan;

      making proposals and (or) orders to eliminate circumstances conducive to the commission of offenses that infringe on the life, health, rights, freedoms, personal dignity and property of protected persons;

      creating separate units outside the location of the State Security Service that are not subject to registration with the authorized body;

      using office premises, vehicles, communications and other property of state bodies and organizations, as well as, on a contractual basis, residential and other property of citizens, and in urgent cases - communication means of citizens;

      organizing and carrying out in the prescribed manner the equipping of the protected objects with security alarms, video surveillance, operational and technical control, other technical security means, as well as operational and technical maintenance of these means, ensuring, if necessary, the protection of information during their operation;

      issuing conclusions on bringing into the territory of the Republic of Kazakhstan and taking out from the territory of the Republic of Kazakhstan of military hand-held small arms and ammunition to employees of foreign law enforcement bodies and special services arriving in the Republic of Kazakhstan to perform tasks to ensure the security of heads of foreign states, parliaments and governments during their stay on the territory of the Republic of Kazakhstan;

      request and receive necessary information and materials;

      send employees and military personnel of the State Security Service on assignments within the Republic of Kazakhstan and outside the republic;

      carry out, on a contractual basis, training and advanced training of personnel in educational institutions and research institutions of the Republic of Kazakhstan, including those under the jurisdiction of law enforcement, special and other state bodies of the Republic of Kazakhstan, as well as in educational institutions of other states;

      have medical institutions and units in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

      use printing and photo and video studio equipment, also produce information, analytical, military journalistic and other materials;

      encourage citizens for their merits in ensuring the safety of protected persons, nominate them in the manner established by the legislation of the Republic of Kazakhstan for state awards of the Republic of Kazakhstan;

      engage citizens of the Republic of Kazakhstan on a voluntary basis as freelance operative officers of the State Security Service;

      temporarily restrict or prohibit the movement of vehicles, including vehicles of diplomatic and consular missions, as well as individuals on specific areas and facilities, oblige them to remain on specific areas or facilities or leave these areas or facilities;

      verify and authorize individuals and legal entities to work on the protection and maintenance of protected persons and facilities;

      secret;

      detain, deliver citizens to internal affairs bodies, office premises of other law enforcement or special state bodies if they commit offenses;

      use service dogs in the manner determined by the head of the State Security Service;

      permit employees and military servicemen of the State Security Service who have undergone special training to store and carry service weapons and special equipment;

      use weapons, military hardware, special means and physical force;

      conduct operational and combat measures to suppress illegal activities that encroach on the safety of protected persons, in accordance with the developed methods;

      carry out, in the manner determined by the head of the State Security Service, escort and protection of special-purpose vehicles with the performance of tactical actions, including by collision to eliminate threats of attack and (or) obstacles to their movement;

      when organizing protective measures an anti-terrorist operation regime and ensuring the legal regime of an anti-terrorist operation, apply measures and temporary restrictions provided for by the Law of the Republic of Kazakhstan “On Countering Terrorism”;

      use telecommunication networks when performing tasks in conditions of a social emergency, state of emergency or martial law;

      ensure own safety;

      involve forces and means of internal affairs bodies, special state bodies, the Armed Forces, other troops and military formations, as well as other state bodies to participate in security measures;

      require citizens and officials to comply with the established order in places where security measures are carried out;

      identify, prevent and suppress offenses;

      enter without hindrance residential and other premises belonging to citizens, the territory and premises of enterprises, institutions and organizations, regardless of their form of ownership (except for diplomatic, consular and other representations of foreign states and international organizations), when suppressing criminal and administrative offenses that pose a threat to protected persons and objects, also when pursuing suspects in the commission of such criminal and administrative offenses, if delay may pose a real threat to the protection of persons and objects.

      establish additional requirements for the organization of anti-terrorist protection of objects vulnerable to terrorism, intended for the stay of protected persons;

      ensure operation and maintenance of the facilities on the balance sheet, organize sanitary-hygienic, environmental and anti-epidemic control at them;

      carry out covert investigative actions within their competence on behalf of the investigator, interrogating officer;

      create clandestine objects (enterprises and organizations), also use documents encrypting employees, servicemen, confidential assistants, departmental affiliation of units, organizations, premises and vehicles;

      use the assistance of officials and specialists with the necessary scientific, technical or other special knowledge;

      receive free of charge and use information that is important for solving the tasks of operative investigative activities from other organizations in compliance with the requirements established by the legislative acts of the Republic of Kazakhstan for the disclosure of information constituting commercial, banking and other secrets protected by law;

      attract, in agreement with other bodies that have the right to carry out operational investigative activities and covert investigative actions on the territory of the Republic of Kazakhstan, the forces and means of these bodies to carry out counterintelligence and operational investigative activities;

      on its own initiative or on the initiative of other state bodies, collect data characterizing a person necessary for making decisions provided for in paragraph 2 of Article 10 of the Law of the Republic of Kazakhstan “On Operational Investigations”;

      demand from entities carrying out security activities to suspend security activities in the zone where the legal regime of the anti-terrorist operation has been introduced;

      in order to ensure the safety of movement of special-purpose vehicles in the cities of Astana and Almaty, determine the speed of their movement on highways or separate sections of highways and introduce restrictions on the movement, stopping and parking of vehicles, temporarily change the traffic direction;

      suspend, during the security measures period, all types of repair, construction, installation and other work on the routes followed by protected persons (hereinafter referred to as special routes) and within airport territories;

      use unmanned aerial vehicles in the preparation and conduct of security measures, also to suppress violations of the use of airspace in the security measures zone or above the territory of protected facilities;

      carry out dog training;

      carry out education, training and retraining of employees and servicemen of the State Security Service, the Armed Forces, other troops and military formations, law enforcement and special state bodies of the Republic of Kazakhstan in the field of security, and also in accordance with international treaties of special services of foreign states;

      determine the procedure for organizing and conducting security measures, as well as, upon agreement with state authorities, the composition of forces and means involved in participation in security measures;

      2) responsibilities:

      prevent and suppress offenses that infringe on the life, health, rights, freedoms, personal dignity and property of the President of the Republic of Kazakhstan, other protected persons, identify circumstances conducive to their possible commission, and, within the limits of their rights, take measures to eliminate them;

      provide assistance to protected persons who have suffered from crimes and accidents, as well as those who are helpless or in another condition dangerous to their health and life;

      accept statements, messages and other incoming information about impending offenses and events that threaten the personal safety of protected persons or public safety at protected facilities and in other places where they are located, and timely take measures provided for by law;

      provide assistance to law enforcement bodies in identifying and searching for persons who have committed criminal offenses against the life, health, rights, freedoms, personal dignity and property of protected persons;

      maintain public order and security at protected sites and other places of stay of protected persons;

      in case of accidents, catastrophes, fires, natural disasters and other emergency situations, take urgent measures to rescue protected persons and provide them with first medical aid, also to protect the personal property of protected persons and other property that is subject to protection and is left unattended;

      participate, in accordance with the law, in ensuring the legal regime of a state of emergency or martial law in respect of protected persons if they are introduction on the territory of the Republic of Kazakhstan or in certain areas, as well as in carrying out quarantine measures in respect of protected persons during epidemics and epizootics;

      organize provision of communications to the President of the Republic of Kazakhstan and other protected persons, the security of presidential communications systems, as well as a set of measures to prevent information isolation of the President of the Republic of Kazakhstan. The procedure for organizing interaction to provide presidential communications shall be determined by joint orders of state bodies and organizations;

      compensate, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, to citizens, enterprises, organizations and institutions for damage caused in connection with the use of their means of communication, transport and premises for official purposes;

      ensure the safety of movement of protected persons on all types of vehicles, observe and monitor compliance with established rules, regulations and standards in force in the field of traffic safety of automobiles and other vehicles allocated for the movement of protected persons;

      participate, within their competence, in addressing organizational matters related to medical care of protected persons;

      identify signs and facts of reconnaissance and subversive activities and take measures to eliminate the causes and conditions conducive to the implementation of reconnaissance and subversive activities;

      inform the President of the Republic of Kazakhstan and state bodies about threats to the national security of the Republic of Kazakhstan;

      take the necessary measures to protect the foundations of the constitutional system, state sovereignty, territorial integrity, economic, scientific, technical and defense potential of the Republic of Kazakhstan;

      take measures to ensure secrecy when carrying out counterintelligence activities, as well as protection of the forces, assets and information of the State Security Service;

      periodically, but no less than every five years, review the contents of the current lists of information subject to classification, in terms of the relevance of classifying information and its compliance with the previously established degree of secrecy.

      17. Functions:

      1) organize and carry out security measures to ensure the safety of the President of the Republic of Kazakhstan, other protected persons and objects. Manage the forces and resources of state bodies involved in security activities. Determine the boundaries of the zone of conduct, start and end time of security measures, the procedure for organizing and carrying out security measures, the composition of forces and means involved in their implementation, as well as the procedure for sound recording, photography and video recording in the security measures area;

      2) carry out, in the manner determined by the head of the State Security Service, the protection and defense of protected objects, organize combat duty to ensure the safety of protected persons and objects;

      3) conduct operational investigative and counterintelligence activities, conduct information and analytical work to accomplish the assigned tasks;

      4) report to the President of the Republic of Kazakhstan, the Government and state bodies of the Republic of Kazakhstan on issues within the competence of the State Security Service;

      5) organize and conduct, in the manner determined by the head of the State Security Service, measures to ensure mobilization, combat and operational readiness, including through practical exercises, training and experiments;

      6) organize and exercise departmental control over the operational-service, combat, operational-search, counterintelligence, financial-economic and other activities of the department and structural divisions;

      7) organize professional selection for service with a special check, staff the State Security Service with persons, mainly from among military personnel, servicemen of law enforcement and special state bodies of the Republic of Kazakhstan. State bodies of the Republic of Kazakhstan shall provide assistance to the State Security Service in the checking and special verification of persons entering service in the State Security Service;

      8) organize and carry out measures to counter technical intelligence means and technical protection of information, counter unauthorized flights of unmanned aerial vehicles;

      9) provide the President of the Republic of Kazakhstan, other protected persons and officials with presidential communications in accordance with the legislation of the Republic of Kazakhstan.

      10) ensure the safety of movement of protected persons by aviation, road and other modes of transport. Determine special routes, monitor compliance with established rules, regulations and standards in force in the field of traffic safety of aviation, automobile and other types of vehicles allocated for the movement of protected persons. The procedure for interaction between the State Security Service, special state, law enforcement and other state bodies in ensuring the safety of movement of protected persons shall be determined by joint regulatory legal acts;

      11) participate jointly with the Executive Office of the President of the Republic of Kazakhstan, the Ministry of Health of the Republic of Kazakhstan and territorial health authorities in resolving organizational issues related to medical care of protected persons;

      12) create and use operational records and information systems;

      13) organize and carry out encryption work within its powers;

      14) monitor radio broadcasts during protection measures;

      15) carry out access control in accordance with the established procedure at protected sites and in the security measures area;

      16) organize and conduct activities for neutralization and destruction of explosive devices, explosive objects in the territory of protected facilities and places of security measures, research work on countering the commission of illegal actions with the use of explosive devices;

      17) organize and carry out, together with state bodies, sanitary and hygienic, environmental, radiation, biological, chemical and anti-epidemic control at protected sites, as well as in places where protected persons visit and in adjacent territories;

      18) ensure the protection of information constituting state secrets;

      19) coordinate the production of all types of repair, construction and other work on protected facilities, zones of regime territories intended for their placement, special routes and adjacent territories;

      20) organize combat, technical, material, financial, scientific, information, legal, social and other types of support for the State Security Service, including catering for servicemen and military personnel, construction, reconstruction and repair of buildings and structures under its authority, housing and barracks construction;

      21) carry out accreditation of participants in the events with participation of protected persons;

      22) participate in anti-terrorist operations to ensure the safety of protected persons and objects, and also ensure the legal regime of anti-terrorist operations;

      23) protect the standards of the State Flag of the Republic of Kazakhstan and the State Emblem of the Republic of Kazakhstan and participate in the conduct of ceremonial and protocol events;

      24) carry out management, coordination and ensure consistency of actions of the State Security Service units;

      25) organize work on moral and psychological support for the service and combat activities of the State Security Service units, develop and implement measures among personnel to maintain and strengthen discipline and law and order, prevent delinquency, and provide the necessary conditions for the safety of the service;

      26) carry out interdepartmental coordination and organization of activities to ensure the biological safety of protected persons and objects in places where security measures are carried out;

      27) determine the list of special means, types of weapons, military hardware and ammunition in service with the State Security Service;

      28) approve the list of objects of the State Security Service that are vulnerable to terrorism, and establish requirements for them for organizing anti-terrorist protection according to their category;

      29) adopt normative legal acts regulating the activities of the State Security Service and the implementation of security measures;

      30) approve regulatory legal acts in the field of mobilization preparation and mobilization of the State Security Service;

      31) determine the procedure of compensating for damage caused to the health and property of an employee, a serviceman of the State Security Service, as well as damage caused to the health and property of family members and close relatives of an employee, a serviceman of the State Security Service in connection with the performance of his official duties;

      32) approve the standard form of the act of examining the family and property status;

      33) determine the procedure and conditions for conducting attestation of employees, conducting unscheduled attestation, determining thresholds for certification testing, selection of methods for conducting psychological and sociological research during attestation, and also establish the form of attestation sheets and the list of positions considered by attestation commissions and the Higher Attestation Commission;

      34) approve, in agreement with the authorized healthcare body, the contents of medical kits (individual, group) used by military personnel and servicemen of the State Security Service;

      35) determine the form of the cooperation contract with adult, legally capable individuals, its conditions and validity terms;

      36) determine the procedure for the formation and use of operational records and information systems, as well as the maintenance of operational records files;

      37) determine the storage terms, the procedure for storing and destroying materials of operational investigative and counterintelligence activities;

      38) determine the procedure for paying a one-time benefit in cases of the death of a confidential assistant or his injury or other harm to health in connection with his participation in counterintelligence activities;

      39) approve the form of the contract, the procedure for its conclusion, extension, amendment, termination and expiration;

      40) other functions provided for by the legislation of the Republic of Kazakhstan.

Chapter 3. Status, powers of the Head of the State Security Service, the Collegium of the State Security Service

      18. The management of the State Security Service shall be exercised by the Head, who bears personal responsibility for the personal safety of the President of the Republic of Kazakhstan, implementation of the tasks assigned to the State Security Service and the exercise of his powers.

      19. The head of the State Security Service shall be appointed and dismissed by the President of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan.

      20. The Head of the State Security Service shall have deputies who are appointed to positions and dismissed from positions by the President of the Republic of Kazakhstan upon the proposal of the head of the State Security Service in accordance with the legislation of the Republic of Kazakhstan.

      21. Powers of the head of the State Security Service:

      1) organize the work of the State Security Service, determine the main development directions of the State Security Service;

      2) manage the republican operational headquarters for carrying out security measures. Determine the heads of oblast, republican status cities’, the capital’s operational headquarters;

      3) manage, from the beginning of security measures until their completion, all military servicemen, servants and specialists of state bodies of the Republic of Kazakhstan involved in their implementation;

      4) make a decision on conducting anti-terrorist operations to ensure the safety of protected persons, on introducing a legal regime for anti-terrorist operations for the period of their conduct;

      5) determine the scope of security measures carried out by the State Security Service, issuing from the nature and reality of the threat to their safety;

      6) approve, in agreement with the Administration of the President of the Republic of Kazakhstan, the List of objects protected by the State Security Service;

      7) establish the procedure for monitoring radio broadcasts during security measures;

      8) issue orders, directives, and give instructions that are binding on all officers, servicemen and employees of the State Security Service;

      9) establish the procedure for organizing and carrying out combat duty to ensure the safety of protected persons and objects, as well as objects of the State Security Service by the department and structural divisions of the State Security Service;

      10) establish the procedure for interaction of state bodies in the implementation of sanitary and hygienic, environmental, radiation, biological, chemical and anti-epidemic control at protected sites and in places where security measures are carried out;

      11) establish the procedure for neutralizing and destroying explosive devices, explosive objects at protected facilities and in places where security measures are carried out;

      12) establish the procedure for the use of special means, weapons and military equipment by employees and servicemen of the State Security Service;

      13) approve the Combat and Special Training Program for employees and servicemen of the State Security Service;

      14) approve safety measures in the handling of weapons and special means;

      15) determine the list of objects and sections of special routes on which operational support is carried out by the State Security Service, as well as the procedure for coordinating the implementation of operational investigative and counterintelligence activities at the operational support objects of the State Security Service and in the area where security measures are carried out;

      16) approve the regulations, structure and staffing levels of the department, structural divisions and state institutions of the State Security Service;

      17) determine the number of employees of the current reserve within the limits of the staffing level approved by the President of the Republic of Kazakhstan and the funds allocated for these purposes;

      18) determine the powers of heads and officials of the department and structural divisions of the State Security Service in resolving organizational, personnel, structural, staffing, financial, production, economic and other matters;

      19) establish the procedure and plan for staffing the Special Forces with conscripts, as well as servicemen undergoing military service under conscription and contract;

      20) approve the nomenclature of positions of the State Security Service, the list of positions filled by employees, servicemen and workers;

      21) make, in accordance with the established procedure, decisions on the deployment (relocation) of units of the State Security Service;

      22) establish the procedure for using the real and conditional names of the State Security Service;

      23) establish qualification requirements for categories of positions in the State Security Service;

      24) establish the procedure for organizing and conducting selection and enrollment of candidates for service, the list of necessary documents, their execution, the timing of checking candidates for service, requirements for their education, work experience, physical fitness and health status;

      25) establish the procedure for conducting polygraph examinations in the State Security Service;

      26) establish the procedure for referring employees of the State Security Service to a military medical commission to determine the category of fitness for service;

      27) enroll citizens of the Republic of Kazakhstan into service in the State Security Service with their removal from general military registration, assign to them special and military ranks up to and including colonel rank. To certain categories of the State Security Service employees it may count in their length of service their work experience before enlisting in the service in the procedure established by them;

      28) determine the List of officials who have the right to issue orders on concluding a contract, appointing to positions, moving, releasing, dismissing employees, servicemen, as well as assigning to them a special or military rank;

      29) establish the procedure for re-attestation and assignment of a special rank to citizens enlisted in the State Security Service from the reserve, or accepted as a transfer from the Armed Forces, other troops and military formations, special state bodies or law enforcement bodies and having military, special ranks, class ranks , when appointing an employee to a position;

      30) appoint and dismiss employees, servicemen and workers, dismiss from service or military service and transfer employees and military personnel of the State Security Service, with the exception of those appointed and dismissed by the President of the Republic of Kazakhstan;

      31) approve the list of information subject to classification in the State Security Service;

      32) decide on the secondment of employees and servicemen of the State Security Service to state bodies and organizations, regardless of their ownership form;

      33) establish the procedure for enrolling employees in the current reserve of the State Security Service and their service;

      34) reward, encourage employees, servicemen, servants of the State Security Service and impose disciplinary sanctions on them. Enjoy disciplinary rights in relation to subordinate military personnel in full, defined by the Disciplinary charter of the Armed Forces, other troops and military formations of the Republic of Kazakhstan;

      35) determine the powers of the heads of the department and structural units of the State Security Service to encourage and impose disciplinary sanctions on employees, servicemen and servants of the State Security Service;

      36) establish the procedure for using the forces and means of the State Security Service to ensure the security of protected persons and objects in peacetime, as well as in emergency situations and during mobilization, martial law and wartime;

      37) establish the procedure for issuing orders to eliminate circumstances conducive to the commission of offenses that encroach on the life, health, rights, freedoms, personal dignity and property of protected persons;

      38) establish the accreditation procedure and the list of participants in events with participation of protected persons subject to accreditation;

      39) make submissions to the President of the Republic of Kazakhstan on awarding special and military ranks of senior officers and awarding employees, servicemen, workers with state awards, also conferment of honorary titles;

      40) establish the procedure for wearing special uniforms by members of the State Security Service, and also establish the specifics of wearing individual items on military uniform and insignia by members of the State Security Service;

      41) approve insignia, badges and emblems of units, distinctive signs indicating membership in the State Security Service, placed on weapons, military hardware and special equipment, vehicles, as well as the procedure for wearing and placing them;

      42) approve the description of service IDs of employees and servicemen of the State Security Service, samples of badges, forms of pension certificates, determine the procedure for their issuance and use;

      43) establish the procedure for assigning, promoting, demoting and removing class qualifications to members of the State Security Service, including the right to wear a black beret of the State Security Service;

      44) establish the procedure and conditions for bonuses, provision of financial assistance and establishment of increments to official salaries of employees, servicemen, workers by saving funds provided for the maintenance of the budget program (subprogram) under the financing plan, in the manner established by the Government of the Republic of Kazakhstan;

      45) approve the Instruction on business trips of employees, servicemen and employees of the State Security Service;

      46) form a permanent departmental budget commission, approve the regulations on it, determine its composition;

      47) manage the property and financial resources of the State Security Service;

      48) establish the procedure for monetary support and determination of service(work) length for calculation of official salaries and benefits for the health of employees and servicemen of the State Security Service;

      49) establish the procedure for accepting weapons, ammunition and other items for temporary storage when implementing access control at protected facilities and in the security measures area;

      50) approve the Rules for ensuring access and internal security regimes at the State Security Service’s own facilities;

      51) represent the State Security Service in relations with state bodies of the Republic of Kazakhstan, legal entities, as well as with special, law enforcement and other bodies of foreign states and international organizations;

      52) submit proposals on improving the State Security Service performance for consideration by the President of the Republic of Kazakhstan;

      53) approve the Regulations of the State Security Service;

      54) take measures to combat corruption in the State Security Service and bear personal responsibility for this;

      55) approve the Rules for creation, maintenance and development of information systems, formation, storage, processing, transmission and access to electronic information resources in the State Security Service;

      56) submit for approval to the President of the Republic of Kazakhstan the structure and staffing levels of the State Security Service;

      57) determine the list of items and substances that may not be brought into protected facilities and into the security measures zone;

      58) establish the list of departments, services, divisions, and categories of staff members subordinate to them who have the right to carry out operational investigative and counterintelligence activities;

      59) establish the number of staff members of the State Security Service within the funds allocated for these purposes;

      60) approve, in coordination with the central authorized budget planning body, natural norms (supply norms), norms for reimbursement of transport costs on the territory of the Republic of Kazakhstan;

      61) approve the position and composition of the consultative and advisory bodies of the State Security Service;

      62) determine the units of the State Security Service related to operational and equivalent to them;

      63) determine the list of positions filled on a competitive basis

      64) establish the procedure for special accounting of the State Security Service;

      65) establish the procedure of forming a contingent of trainees, organization and undergoing of retraining and advanced training by the staff members;

      66) establish the procedure for organizing work on adaptation of employees;

      67) establish the internship order;

      68) approve the charter of the internal service;

      69) establish the procedure of registration, accounting and storage of personal files of the State Security Service personnel;

      70) approve the List of non-standard positions and corresponding to them special and military ranks;

      71) establish procedures for appointing lower level personnel to positions to be replaced by sergeants and officers if it is impossible to appoint personnel of the corresponding composition to these positions;

      72) establish the procedure for filing a submission when appointing an employee to a position, in dismissal, enrollment at the disposal of the supervisor, dismissal, assignment, demotion, deprivation of a special rank, and when concluding a new contract;

      73) approve the Rules of staff movement;

      74) establish the procedure for assigning temporary positions to an officer for vacant positions to be replaced by senior officers;

      75) approve the regulations on official representatives;

      76) establish the procedure of forming a personnel reserve and organizing work with it;

      77) establish the procedure for organizing the accounting of reserve officers of the State Security Service and the stay of employees in the reserve;

      78) establish the procedure of applying incentives provided for in subparagraphs 2), 3), 5), 6), 9) and 10) of paragraph 6 of Article 63 of the Law of the Republic of Kazakhstan “On Special State Bodies of the Republic of Kazakhstan”;

      79) establish the procedure of paying monetary compensation to employees (except for employees living in official housing located on the territory of closed and separate military camps, border departments and other closed facilities, as well as cadets and trainees) for housing maintenance and payment of utilities;

      80) establish the procedure for providing special uniforms and other clothing and the procedure for paying monetary compensation to employees (except for cadets and trainees) in return for not received clothing articles;

      81) establish the procedure for paying lifting benefits to employees (except for cadets, trainees) of the State Security Service in case of relocation in service, associated with moving from one locality to another at a distance of more than one hundred kilometers;

      82) establish the procedure of honoring members of the State Security Service at burials;

      83) establish the procedure for monitoring the state of anti-terrorism security of protected objects;

      84) establish the area for conducting the anti-terrorist operation in accordance with the Law of the Republic of Kazakhstan “On Countering Terrorism”;

      85) approve the Instructions for organizing anti-terrorist protection of objects of the State Security Service that are vulnerable to terrorism;

      86) approve the passport of anti-terrorist protection of objects of the State Security Service that are vulnerable to terrorism;

      87) make decisions on the transfer and redistribution of property within the state body;

      88) establish the procedure for paying remuneration to confidential assistants who provide assistance on a reimbursable basis;

      89) ensure control over the organization, tactics, forms and methods of counterintelligence activities, the forces and means involved, organization and implementation of international cooperation with special services, security agencies, law enforcement bodies of foreign states, international organizations, ensuring secrecy and conspiracy;

      90) determine the list of services, divisions and categories of the State Security Service members who have the right to use the National video monitoring system;

      91) establish the procedure for the construction, management, use, distribution of numbering, organizational and technical support for operation, information security, traffic clearance, interaction conditions and acceptance into operation (decommissioning) of encrypted, classified, coded communication networks and special-purpose telecommunications networks;

      92) establish the procedure for the use of unmanned aircraft in the preparation and conduct of security measures, also to suppress violations of the use of airspace in the security measures zone or over the territory of protected objects;

      93) establish the procedure for organization of cynological activities in the State Security Service;

      94) exercise other powers assigned to it by the legislation of the Republic of Kazakhstan.

      The powers of the head of the State Security Service during his absence shall be executed by the person replacing him in accordance with the current legislation of the Republic of Kazakhstan.

      22. The head of the State Security Service shall determine the powers of his deputies in accordance with the current legislation of the Republic of Kazakhstan.

      23. The Office of the State Security Service, directly subordinate and accountable to the head of the State Security Service, shall coordinate and supervise the activities of departments and structural units, organize information, analytical, legal, and documentation support for the activities of the State Security Service.

      The Office of the State Security Service is headed by the head of the Office, appointed and dismissed by the head of the State Security Service in accordance with the current legislation of the Republic of Kazakhstan.

      24. The collegial body of the State Security Service is the Collegium.

      Powers of the Collegium:

      1) consideration of the most important operational and service activity issues;

      2) ensuring development of measures to improve the efficiency of operational activities and adoption of coordinated decisions on them.

      The decisions of the Collegium shall be announced by order of the head of the State Security Service. The tasks, powers, procedures and personnel of the Collegium shall be regulated by regulations approved by the head of the State Security Service.

      25. The procedure for admission to the State Security Service and service shall be determined by the laws of the Republic of Kazakhstan “On special state bodies of the Republic of Kazakhstan” and “On military service and status of military servants.”

      Special forces shall be recruited in the manner prescribed by law, from among citizens conscripted for compulsory military service, as well as servicemen undergoing military service under conscription and contract.

      The selection of conscripts into the Special Forces is a priority.

      26. Secret.

      27. A special state archive shall be created in the State Security Service.

      28. Medical support and services for employees and servicemen of the State Security Service, the supply of medical equipment and medicines shall be conducted in the manner determined by the legislation of the Republic of Kazakhstan.

      29. Calculation of the service length for the assignment of pensions to employees and servicemen of the State Security Service shall be carried out on preferential terms in the manner determined by the Government of the Republic of Kazakhstan*.

      *Note. For the State Security Service employees, the service credited at the rate of one and one-half months for one month of service prior to January 6, 2020, shall not be recalculated into length of service with a state body for the purpose of establishing ratios for calculating salary and health benefits.

      30. The performance of service by employees and servicemen of the State Security Service is fulfillment of a combat mission and is based on the implementation of a set of activities carried out both independently and jointly with other state bodies.

      During security measures to ensure the safety of protected persons and objects, the senior official of the State Security Service shall be the operational supervisor for all persons involved in their conduct.

Chapter 4. Property of the State Security Service

      31. The State Security Service may have separate property on the operational management right in cases stipulated by the legislation.

      The property of the State Security Service shall be formed at the expense of property transferred to it by the state, as well as property acquired from its own activities, and other sources not prohibited by the legislation of the Republic of Kazakhstan.

      32. The property assigned to the State Security Service shall belong to republican property.

      33. The State Security Service may not independently alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by the legislation of the Republic of Kazakhstan.

Chapter 5. Reorganization and abolition of the State Security Service

      34. Reorganization and abolition of the State Security Service shall be carried out in accordance with the legislation of the Republic of Kazakhstan.

The composition of the forces and means of operational headquarters, the procedure for forming operational groups, a detailed list of their actions during the preparation and conduct of the anti-terrorist operation shall be determined by the joint regulatory legal acts of the National Security Committee, the Ministry of Internal Affairs, the State Security Service, the Defense Ministry of the Republic of Kazakhstan, and other state bodies participating within their competence in the fight against terrorism.";

      in the Rules for organization and functioning of the state system for monitoring information and alerting the public about the threat of an act of terrorism, approved by the said Decree:

      subparagraph 4 of paragraph 4 shall be worded as follows:

      "the State Security Service of the Republic of Kazakhstan";

      part two of paragraph 5 shall be worded as follows:

      "Information on the threat of an act of terrorism against persons or objects protected by the State Security Service of the Republic of Kazakhstan, received by the state bodies referred to in paragraph 4 of these Rules, shall be also immediately transmitted to the duty service of the State Security Service of the Republic of Kazakhstan.";

      paragraph 11 shall be worded as follows:

      "11. In order to timely deploy the republican, regional, city of republican significance, capital, district (city of regional significance) operational headquarters to combat terrorism, depending on the established level of terrorist danger, a single warning signal and appropriate algorithms for bringing forces and means of state bodies to combat operational status shall be applied, included in their composition, determined by the joint regulatory legal acts of the National Security Committee of the Republic of Kazakhstan, the Ministry of Internal Affairs of the Republic of Kazakhstan, the State Security Service of the Republic of Kazakhstan, the Defense Ministry of the Republic of Kazakhstan, as well as other state bodies participating within their competence in fighting terrorism.".

      15. In the Decree of the President of the Republic of Kazakhstan dated August 28, 2013 № 624 "On formation of the Presidential reserve of the leadership of law enforcement and special state bodies of the Republic of Kazakhstan":

      in the Rules for formation of the Presidential reserve of the leadership of law enforcement and special state bodies of the Republic of Kazakhstan approved by the said Decree:

      subparagraph three of paragraph 5 shall be worded as follows:

      “Approval of the Presidential reserve of employees and military personnel of the State Security Service of the Republic of Kazakhstan (hereinafter referred to as the State Security Service) shall be carried out by the Head of the Presidential Administration of the Republic of Kazakhstan at the recommendation of the Head of the State Security Service of the Republic of Kazakhstan.”;

      part two of paragraph 6 shall be worded as follows:

      "The organization of work on formation of lists of employees and military personnel of the State Security Service recommended to the Presidential Reserve of the leadership of special state bodies, and the preparation of the documents referred to in paragraph 10 of these Rules, shall be assigned to the State Security Service";

      subparagraph 2) of paragraph 20 shall be worded as follows:

      "2) by the Head of the Presidential Administration of the Republic of Kazakhstan in relation to employees of special state bodies in accordance with the materials submitted by personnel departments of special state bodies to the Secretariat of the Security Council, as well as in relation to employees and military personnel of the State Security Service."
