      In accordance with subparagraph 2) of Article 9 of the Law of July 22, 2011 “On Migration of the Population” I HEREBY ORDER:

      1. That the attached Rules for Registering Immigrant Passports, Providing by Receiving Persons of the Information on Immigrants Staying with Them, Preparing and Issuing Migration Cards, Immigrants Moving, Entering Certain Areas (Territories), Which Are Closed for Visiting by Foreigners, as well as Transit Travel of Foreigners and Stateless Persons along the Territory of the Republic of Kazakhstan shall be approved.

      2. The Department of Migration Police of the Ministry of Internal Affairs of the Republic of Kazakhstan shall:

      1) ensure the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, in the manner prescribed by law;

      2) within ten calendar days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan send a copy hereof for the official publication in periodicals and Adilet, the legal information system;

      3) within ten calendar days after the official publication in periodicals, send it to Republican State Enterprise on the Right of Economic Management “Zakon” Database” for inclusion into the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;

      4) place this order on the Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan and on the web-portal of government bodies;

      5) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry of Internal Affairs of the Republic of Kazakhstan the information on the implementation of measures provided for in subparagraphs 1), 2), 3) and 4) of this paragraph.

      3. The control over the execution of this order shall be assigned to the Deputy Minister of Internal Affairs of the Republic of Kazakhstan (Turgumbayev Y. Z.) and the Migration Police Department of the Ministry of Internal Affairs of the Republic of Kazakhstan (Sainov S.S.)

      4. This order shall become effective upon expiry of ten calendar days from the date of its first official publication.

Rules for
Registering Immigrant Passports, Providing by Receiving Persons of the Information
on Immigrants Staying with Them, Preparing and Issuing Migration Cards, Immigrants
Moving, Entering Certain Areas (Territories), Which Are Closed for Visiting by Foreigners,
as well as Transit Travel of Foreigners and Stateless Persons along the Territory
of the Republic of Kazakhstan

1. General provisions

      1. These Rules for Registering Immigrant Passports, Providing by Receiving Persons of the Information on Immigrants Staying with Them, Preparing and Issuing Migration Cards, Immigrants Moving, Entering Certain Areas (Territories), Which Are Closed for Visiting by Foreigners, as well as Transit Travel of Foreigners and Stateless Persons along the Territory of the Republic of Kazakhstan (hereinafter referred to as the Rules) are developed in accordance with subparagraph 2) of Article 9 of the Law of the Republic of Kazakhstan dated July 22, 2011 “On Migration of the Population”.

      2. Immigrants temporarily staying in the Republic of Kazakhstan for more than five calendar days from the date of crossing the State Border of the Republic of Kazakhstan shall have a temporary residence permit (registration), unless otherwise established by agreement of the Republic of Kazakhstan with the relevant party or the Government of the Republic of Kazakhstan.

      The immigrants that shall be exempted from registering passports:

      those who have a diplomatic or official passport;

      those who arrived in the Republic of Kazakhstan with a visa of the Republic of Kazakhstan of the category “diplomatic” , “official” , “investor” or upon confirmation of the status of “ investor ” from the authorized body of the Republic of Kazakhstan on investment issues (for countries with a visa-free stay);

      who are members of the crews of aircraft, sea and river vessels;

      those who are under the age of 16.

      Persons acting as hosts shall inform internal affairs bodies about immigrants staying with them within three business days from the day of their arrival in the form in accordance with Appendix 1 to these Rules or through the Visa-Migration Portal (www.vmp.gov.kz) of the unified and information system “Berkut "(hereinafter - VMP).

2. The procedure for registration of immigrant passports in the Republic of Kazakhstan,
the provision by the receiving persons of information about immigrants staying with them

      3. Registration of immigrant passports shall be carried out in the unified information system “Berkut” (hereinafter - UIS “Berkut”).

      4. Registration and its extension shall be carried out on the day of submission of documents.

      5. Registration of immigrant passports on the territory of the Republic of Kazakhstan shall be carried out in accordance with paragraph 4 of the Rules for the Implementation of Migration Control, as well as Registration of Foreign Residents and Stateless Persons Illegally Crossing the State Border of the Republic of Kazakhstan, Illegally Staying on the Territory of the Republic of Kazakhstan, as well as Persons Who are Prohibited from Entering the Territory of the Republic of Kazakhstan, approved by Decree of the Government of the Republic of Kazakhstan No. 148 dated January 21, 2012 “On Approval of the Rules of Entry and Stay for Immigrants in the Republic of Kazakhstan, as well as Their Departure from the Republic of Kazakhstan and the Rules for the Implementation of Migration Control, as well as Registration of Foreigners and Stateless Persons Illegally Crossing the State Border of the Republic of Kazakhstan, Illegally Staying in the Republic of Kazakhstan, as well as Persons Who Are Prohibited from Entering the Territory of the Republic of Kazakhstan ".

      Registration shall be confirmed by a certificate of temporary registration of an immigrant (foreigner) (hereinafter referred to as the Certificate) in the form according to Appendix 1-1 to these Rules, or by the visa of the Republic of Kazakhstan to the UIS “Berkut”, or on paper from the Visa and Migration Portal or by the mark in the migration card.

      6. The bodies of internal affairs shall carry out registration in the district, city or regional offices of the migration service, as well as offices of the migration service in transport - immigrants, incurred the administrative liablity for their departure from the Republic of Kazakhstan.

      7. Immigrants engaged in missionary activity, as well as those arriving with charitable or humanitarian reasons, shall be registered with the internal affairs bodies on the basis of corresponding visas , with further registration with local executive bodies of oblasts, cities of republican significance and the capital on issues of religious activity and interaction with religious associations.

      Immigrants who arrived with missionary activity from countries without a visa stay shall be registered with the internal affairs bodies after registering with local executive bodies of oblasts, cities of republican significance and the capital on issues of religious activity and interaction with religious associations.

      8. The basis for registration of immigrant passports shall be:

      1) visas of the Republic of Kazakhstan, except for citizens of countries with which the Republic of Kazakhstan has concluded international agreements on visa-free entry and stay;

      2) applications from the host legal entities, individuals or the immigrant himself.

      In identifying the immigrant who has violated legislation of the Republic of Kazakhstan in the field of migration, the reason for its registration after bringing to responsibility shall be the report of the employee of the migration service department.

      9. Registration of immigrant passports by the Border Service of the National Security Committee of the Republic of Kazakhstan (hereinafter referred to as BS NSC) shall be carried out by affixing the date of the stamp in the column “registration” of the migration card.

      10. Record-keeping for registration of immigrant passports shall be carried out in UIS “Berkut” by officials of the migration service divisions, affixing the registration number, attesting the migration card with a signature and a visa (passport) seal, as well as issuing a Certificate.

      If the purpose of the is changed by citizens of countries with which the Republic of Kazakhstan has concluded international agreements on visa-free entry and stay, they shall draw up a new migration card with the corresponding purpose.

      When an immigrant provides a migration card for registration with a note of entry and in the absence of information about crossing the State border of the Republic of Kazakhstan at the UIS “Berkut”, the responsible officers of the Migration Service Directorates of the Departments of the Interior Astana, Almaty and regions (hereinafter - DI) by telephone shall request the fact of crossing from the administrator of the UIS "Berkut".

      If the fact of crossing the state border of the Republic of Kazakhstan by an immigrant is not confirmed, the official of the internal affairs bodies shall report of it to the management of the unit to make a decision on entering into the Unified Register of pre-trial investigations.

      11. Registration shall be issued for the period specified in the application of the receiving legal entity, individual or immigrant, but not exceeding the validity period of the visa, the permitted duration of stay or the validity of the passport or an immigrant substitute document (hereinafter - passport) of the immigrant.

      Immigrants with multiple visas shall be registered for the period of actual stay in the Republic of Kazakhstan.

      12. The registration of immigrants shall be carried out by the person who invited him or by a natural or legal person providing hotel services and shall not depend on the place of registration of the receiving person.

      13. Upon departure to other regions of the Republic of Kazakhstan for a period of more than five calendar days or when an immigrant changes his temporary residence in the Republic of Kazakhstan, the receiving legal or natural person shall notify the internal affairs bodies in writing of this within three working days in accordance with Paragraph 2 of these Rules.

      The internal affairs bodies, according to the notifications received from the receiving persons, shall enter information into the UIS “Berkut”.

      When changing a permanent or temporary place of residence, immigrants shall pass re-registration with the internal affairs bodies at the place of new residence within five calendar days.

      When registering immigrants arriving for temporary residence, the units of the migration service shall notify, through the leadership of the internal affairs bodies, the local police inspectors of the terms of their residence in the given area.

      14. The extension of the stay of immigrants shall be carried out by issuing or extending visas and extending the validity of registration of immigrant passports on the basis of applications from the host legal entity, individual or the immigrant himself.

      15. The extension of the validity of registration of immigrant passports shall be executed by the employees of the internal affairs bodies at UIS “Berkut”.

      16. In case of loss of a passport, an immigrant shall immediately apply to the internal affairs bodies at the place of permanent residence or temporary stay with a statement stating in detail when, where and under what circumstances the loss of documents occurred. Based on the application of the immigrant registered in accordance with the Rules for the Receipt and Registration of Applications and Reports of Criminal Offenses, as well as the maintenance of the Unified Register of pre-trial investigations, approved by order of the Prosecutor General of the Republic of Kazakhstan No. 89 dated September 19, 2014 (registered with the Register of State Registration of Regulatory Legal Acts under No. 9744) and whose identity has been established, the migration service unit shall issue him a certificate issued to foreigners regarding their loss of passports or documents replacing them in the form in accordance with Appendix 2 to these Rules.

      On the basis of the issued certificate, the foreigner shall receive a new passport or a document replacing it at the consular offices of his state, in which the exit visa is issued by the internal affairs body.

3. The procedure for the production and issuance of migration cards

      17. Upon entering the Republic of Kazakhstan, an immigrant shall be issued a migration card.

      Migration cards shall not be issued:

      1) to persons having visas of the Republic of Kazakhstan, as well as persons having diplomatic, service passports and confirmation of the status of “investor” from the authorized body;

      2) to persons under the age of 16 ;

      3) to crew members of aircraft, sea and river vessels;

      4) to employees of train crews, including refrigerator, locomotive and persons accompanying goods following the railway transport;

      5) to passengers of trains traveling in transit through the territory of the Republic of Kazakhstan;

      6) to drivers of vehicles engaged in international road transport.

      If the persons specified in subparagraphs 4), 5) and 6) of this paragraph of the Rules stay more than five calendar days from the date of crossing the State Border of the Republic of Kazakhstan, unless otherwise established by agreement of the Republic of Kazakhstan with the relevant party, they shall be registered with the internal affairs bodies.

      18. The migration card shall contain the information about the immigrant entering the Republic of Kazakhstan, and serve as the basis for monitoring his temporary stay in the Republic of Kazakhstan, which shall be issued in the form in accordance with Appendix 3 to these Rules.

      19. Immigrants entering the Republic of Kazakhstan shall be provided with timely information on the need to fill out migration cards, the possibility of unhindered access to the forms and the time required to fill them out before passing the border control.

      20. The issuance of forms of migration cards shall be made:

      1) at border inspection posts across the state border of the Republic of Kazakhstan - Border Service of the National Security Committee of the Republic of Kazakhstan (including with use of opportunities "Berkut" for automated filling of forms of migration cards);

      2) by internal affairs bodies - at the place of temporary or permanent residence of immigrants, including through the receipt through UIS "Berkut" of information from legal entities and individuals about their immigrants;

      3) along the route:

      by air (sea) transport - by crew members of air (sea) ships;

      by rail - by members of train crews;

      by international bus transport – by drivers of international bus transports.

      Prior to arrival at a checkpoint across the State Border of the Republic of Kazakhstan, a migration card may be filled out and printed by an immigrant independently through the VMP.

      21. The preparation of migration cards shall be carried out by DI. The DI shall be provided with migration card forms by subdivisions of the Frontier Service of the National Security Committee and the Ministry for Investments and Development of the Republic of Kazakhstan.

      22. Migration cards shall be filled by immigrants readably without corrections and erasures with ink or the ballpoint pen paste of blue or black color in accordance with a reminder to fill migration cards according to Appendix 4 hereto before the start of boundary control. Migration cards shall be filled in with the letters of the Kazakh, Latin alphabet or Cyrillic alphabet in accordance with the data specified in the passport or other document proving the identity of the immigrant.

      If the UIS “Berkut” allow an automated filling in of migration card forms, their filling and issuance shall be carried out by the National Security Committee.

      The migration card shall indicate the surname, name of the immigrant, purpose of stay, inviting party, registration address, the number of children following the same age under 16 years of age, notes shall be made on entry into the Republic of Kazakhstan and registration at the place of temporary residence.

      23. Upon entering the Republic of Kazakhstan, the Frontier Service of the National Security Committee shall verify the submitted migration card with the data of the passport, put the entry mark. The entry mark shall be carried out by affixing the date of the stamp in the entry column, then the migration card shall be returned to the immigrant.

      24. Upon departure of foreigners (staff and residents) from territories leased from the Republic of Kazakhstan outside the leased territory, internal affairs bodies shall issue migration cards on the basis of identity documents and registration at the place of residence on the leased territory, with information entered in the UIS “Berkut". The date of entry shall be the date of registration with the internal affairs bodies.

      25. For immigrants in respect of whom a decision is made on expulsion, the internal affairs bodies shall issue a migration card indicating the period for departure from the Republic of Kazakhstan. The time limit for departure shall be established in accordance with the court decision on expulsion. At the same time, in the column “Departure” of the migration card, the entry “Expulsion” shall be made.

      If the court does not establish a deadline, then the deadline for departure shall be established up to 15 days from the date of entry into force of the court decision on expulsion.

      26. Foreigners holding a residence permit of a foreigner in the Republic of Kazakhstan, leaving for permanent residence abroad, who have submitted a residence permit to the internal affairs bodies, shall receive in return migration cards with the necessary registration period for timely departure abroad.

      27. In case of loss of migration cards or unintentional spoilage, immigrants shall report this to the internal affairs authorities within three working days from the date of damage or loss of the migration card, which after checking the applicants shall issue duplicate migration cards and affix registration notes. At the same time, the entry (passport) stamp of the territorial divisions of the migration service of the Ministry of the Internal Affairs shall be affixed to the “Entry” column.

      28. When leaving the Republic of Kazakhstan, the Frontier Service of the National Security Committee shall verify identity of the person, verify the submitted migration card or certificate of temporary registration (when registering via the Visa-Migration Portal - an insert to the passport on the registration of the immigrant on paper) of an immigrant with passport data, affix a note of departure, after which a migration card and a certificate shall be withdrawn.

      29. When immigrants who do not have a migration card, arriving at a checkpoint for border control and leaving the Republic of Kazakhstan, apply, the Frontier Service of the National Security Committee through the Berkut UIS shall establish the date of crossing the state border of the Republic of Kazakhstan, if there is confirmation of border crossing and there is no fact violation of the terms and order of stay in the Republic of Kazakhstan, they shall pass through the border.

      In case of violation of the terms and order of immigrants' stay on the territory of the Republic of Kazakhstan, if the delay with departure occurred for reasons beyond their control (in natural and man-made emergencies, disruptions in the normal operation of the transport), immigrants shall pass through the border with the corresponding mark in the migration card.

      30. Migration cards withdrawn from immigrants, after reporting, shall be destroyed in accordance with the act of destruction of migration cards in the form in accordance with Appendix 5 to these Rules every month, on the 25th day.

4. The order of the movement of immigrants, entry into certain
areas (territories), closed for visiting by foreigners, as
well as the transit passage of foreigners and stateless persons through the
territory of the Republic of Kazakhstan

      31. Immigrants can freely move through the territory of the Republic of Kazakhstan, open for visiting by foreigners.

      32. The Rules for the Movement of Immigrants, as well as Entry into Certain Localities (Territories), which are Closed for Visiting by Foreigners, shall be carried out in accordance with the Rules for Issuing Permits for Entry into the Border Zone to Foreigners and Stateless Persons, approved by the Government of the Republic of Kazakhstan No. 734 dated July 23, 2013.

      33. The registration of immigrants traveling by air and rail and having made an emergency stop shall be carried out by the territorial internal affairs bodies.

      The validity of registration shall be determined by the time necessary to eliminate the reasons that caused the forced stop, but no more than the validity of the visa.

      34. Registration of passports of immigrants who are being treated at medical organizations shall be executed within 24 hours after their discharge.

      Members of their families or persons accompanying them, shall register their passports on a common basis for the period specified in the certificate of the medical organization, necessary for the treatment of a sick immigrant, but not more than the duration of the visa or the permitted length of stay.

      35. Immigrants traveling by personal or official vehicles, as well as those engaged in international road transport, shall freely move on roads in the territory open for visiting by foreigners.

      Within 5 calendar days after crossing the state border of the Republic of Kazakhstan, it is MANDATORY to register with the internal affairs bodies. Violation of the terms of stay in the Republic of Kazakhstan entails administrative liability. The migration card is kept by the immigrant and is subject to surrender upon departure from the Republic of Kazakhstan. Registration is carried out in units of the migration service or by receiving persons on the visa-migration portal (vmp.gov.kz; e.g.ov.kz).

      Foreign citizens must register with a local migration police office within five days upon arrival in the Republic of Kazakhstan. Violation of terms of stay will entail administrative liability under the civil law. Foreign citizens must keep this migration card and return it upon departure from the Republic of Kazakhstan. Registration is carried out in the migration service offices or on the visa-migration portal by receiving persons (vmp.gov.kz; e.g.ov.kz).

Foreigners, as well as Transit Travel of Foreigners and
Stateless Persons along the Territory of the
Republic of Kazakhstan

Migration Cards Filling Instruction

      1. Migration cards shall be issued to immigrants by members of train crews, crews of aircraft, ships at the entrance to the Republic of Kazakhstan in advance, with the calculation of the necessary time to fill them in before arriving at the border control point.

      2. The card shall be filled out legibly, without blots and corrections with an ink or ballpoint pen in blue or black paste. The surname and name shall be written strictly according to the passport with the alphabet used to fill it out (Kazakh, Latin or Cyrillic). Arabic or other graphics shall not be applicable.

      3. The column "purpose of the trip" shall indicate one of the following purposes:

      private - when traveling on a visit, on other matters of a personal nature;

      official - when following a business trip, for other business matters;

      work-related - when going to work;

      for studies - for students studying in higher and secondary special educational institutions of the Republic of Kazakhstan, as well as for persons following an internship or practice;

      for treatment - for persons following treatment in medical organizations of the Republic of Kazakhstan;

      tourism - for persons traveling as tourists.

      4. The column "inviting party" shall indicate the name of the receiving individual or the name of the legal entity acting as the host organization, as well as the region in which he resides (place of registration of the legal entity).

      For example: A. I. Sundetov, Kyzylorda Region.;

      NUR JSC, the city of Astana.

      5. The column "Residential Address " shall indicate the planned temporary location.

      For example: 6 apartment, 5 Abay Street, the city of Astana

      6. In the column “Accompanied by Children”, the number of children under the age of 16 years accompanied by the immigrant shall be written in words.

      For example: "three."

      7. Migration cards shall be presented at the border control along with a passport. Migrant cards shall be kept by the migrant until departure from the Republic of Kazakhstan and be presented upon the request of employees of the internal affairs bodies and border service.

      8. A note on registration with the internal affairs bodies shall be made by the employees of the migration service, as well as through the visa and migration portal EIS "Berkut" by means of a personal digital signature through the websites vmp.gov.kz or exampleov.kz. For persons whose stay in the Republic of Kazakhstan does not exceed 5 calendar days, registration of passports in the internal affairs bodies shall not be required.
