In accordance with Subparagraph 4) of Article 3 of the Law of the Republic of Kazakhstan dated February 18, 2011 "On Science", the Government of the Republic of Kazakhstan hereby DECREES AS FOLLOWS:

1. Approve the attached Rules for accreditation of subjects of scientific and (or) scientific and technical activity.

2. Declare to be no longer in force:

1) Decree of the Government of the Republic of Kazakhstan dated April 30, 2003 No. 421 "On approval of the Rules for accreditation of non-governmental scientific organizations" (Collected Acts of the President and the Government of the Republic of Kazakhstan, 2003, No. 18, Article 188);

2) Decree of the Government of the Republic of Kazakhstan dated May 19, 2003 No. 460 "On approval of the Regulation on certification of scientific organizations" (Collected Acts of the President and the Government of the Republic of Kazakhstan, 2003, No. 20, Article 206);

3) Decree of the Government of the Republic of Kazakhstan dated May 8, 2007 No. 370 "On amendments and additions to the Decree of the Government of the Republic of Kazakhstan dated May 19, 2003 No. 460 (Collected Acts of the President and the Government of the Republic of Kazakhstan, 2007, No. 14, Article 165).

3. This Decree shall be enforced upon expiry of ten calendar days after the first official publication.

Rules
for Accreditation of Actors Engaged in Scientific and/or Scientific-Technical Activities

Footnote. The Rules as reworded by Decree No. 834 of the Government of the Republic of Kazakhstan dated 24.11.2021 (shall be enacted ten calendar days after the date of its first official publication).

Chapter. 1. General provisions

1. These Rules for Accreditation of Actors Engaged in Scientific and (or) Scientific-Technical Activities (hereinafter referred to as Rules) are developed as per the Law of the Republic of Kazakhstan “On Science” and establish the procedure of accreditation of actors of scientific and (or) scientific-technical activity (hereinafter referred to as the actors), documents submission for accreditation, their review and issue of certificates on accreditation by the competent authority in the field of science (hereinafter referred to as the competent authority).

2. The following terms shall be used in these Rules:

1) accreditation certificate - a document confirming official recognition by the competent authority of the scientific, scientific and technical activities undertaken by a natural person or legal person, in the form as per Annex 1 hereto;

2) accreditation - a procedure whereby legal persons and natural persons being actors gain official recognition that their activities comply with the requirements and standards laid down by the legislation of the Republic of Kazakhstan.

3. The actors involved shall be:

1) legal persons - organisations engaged in scientific and/or scientific-technical activities;

2) natural persons involved in scientific and (or) scientific-technical activities - scientific, engineering and technical and other employees in labour relations with scientific organisations, organisations of higher and (or) postgraduate education engaged in scientific and (or) scientific-technical activities, as well as scientists independently involved in scientific and (or) scientific-technical activities

4. Organisations, where scientific and technical activities are not the main type of activities, having scientific departments in their structure, with a view to solving the objectives enshrined in their constituent documents, may undergo accreditation by the competent authority to obtain a certificate of accreditation.

5. Actors shall be accredited at their own expense.

6. The competent authority shall compile a database of accredited entities/persons that have received accreditation certificates as well as those that have expired, which shall be made available on the Internet resources of the competent authority.

Chapter 2: Procedures for accreditation

7. Procedure of accreditation of natural and legal persons shall be performed by order of the Minister of Education and Science of the Republic of Kazakhstan No. 196 of May 12, 2020 "On approval of the Rules of Public Service "Accreditation of Actors Engaged in Scientific and (or) Scientific and Technical Activities" (recorded in the Register of State Registration of Regulatory Legal Acts under No. 20626) (hereinafter - Order No. 196).

To obtain accreditation, natural persons shall submit to the competent authority the following documents:

1) an application in the form required by Order No. 196;

2) copies of identity card, diploma on higher education; master's degree and (or) diploma on awarding an academic degree (Candidate of Sciences, Doctor of Sciences), Doctor of Philosophy (PhD), Doctor in Science and (or) a certificate (diploma) on awarding an academic title of associated professor (Associate Professor) or professor (educational documents issued by foreign educational organisations shall be recognised in the Republic of Kazakhstan under the legislation in the field of education);

3) published research articles in the last 5 years: for engineering and science at least one (1) international patent or one (1) article in an international peer-reviewed academic journal with a non-zero impact factor as reported in Clarivate Analytics' Journal Citation Reports, or in publications with a CiteScore of at least 35 in at least one scientific field in the Scopus database; for the social sciences and humanities at least one (1) article in journals with a non-zero impact factor as per Clarivate Analytics' Journal Citation Reports or indexed in the Web of Science Core Collection (Arts and Humanities Citation Index, Science Citation Index Expanded, Social Sciences Citation Index sections), and at least three (3) articles in academic journals recommended by the Quality Assurance Committee in Education and Science of the Ministry of Education and Science of the Republic of Kazakhstan.

When accrediting legal persons, compliance shall be assessed based on a scoring system using a scoring scale (points) of compliance with the conditions for obtaining an accreditation certificate (for legal persons) as per Annex 2 hereto.

The threshold score for passing the accreditation shall be twenty-two (22) points and shall be the sum of the threshold scores for each criterion.

The branches (representative offices) of a legal person shall be accredited as part of the organisation.

8. The accreditation certificate shall be valid for five (5) years.

The accreditation certificate shall be issued:

to a legal person - to the head or an authorised person against signature under a power of attorney;

to a natural person - directly to the applicant or to an authorised person under a notarised power of attorney or to his/her representative, whose powers are executed as per article 68 of the Administrative Procedure Code of the Republic of Kazakhstan.

9. The competent authority shall ensure the production, accounting and storage of accreditation certificate forms.

10. Before the expiry date, the accreditation certificate shall expire in the following cases:

1) reorganisation (in the form of a separation or spin-off) or liquidation of a legal person;

2) the actor's written application for termination of the certificate;

3) death (entry into legal force of a court ruling declaring a person legally incompetent, whereby the person is deprived of the special right to practice a particular occupation) of a natural person who has been granted an accreditation certificate.

The threshold for passing the accreditation shall be determined by formula 1:

where Pmin is the threshold point, Pi(min) is the threshold points for the set i criteria, n is the number of criteria, i= 1,2,3,4,5,6.

The thresholds for the criteria shall be calculated by using the following formula 2:

where Npi is the value of the i-th indicator, units, Qi is the score in points.

If the applicant's actual values for the evaluation criteria are higher than the threshold values, the evaluation score shall be increased by 1 point (+1 point) as per formulas 3, 4.

where Pi(min+1) is the overall point score for the i-th indicator (min+1), Npi is the value of the i-th indicator, units, Qi +1 is the score in points.

where Pmin+1 is the overall point, Pi(min+1) is the points for the set i criteria, n is the number of criteria, i= 1,2,3,4,5,6.

В соответствии с подпунктом 4) статьи 3 Закона Республики Казахстан от 18 февраля 2011 года "О науке" Правительство Республики Казахстан ПОСТАНОВЛЯЕТ:

1. Утвердить прилагаемые Правила аккредитации субъектов научной и (или) научно-технической деятельности.

2. Признать утратившими силу:

1) постановление Правительства Республики Казахстан от 30 апреля 2003 года № 421 "Об утверждении Правил проведения аккредитации негосударственных научных организаций" (САПП Республики Казахстан, 2003 г., № 18, ст. 188);

2) постановление Правительства Республики Казахстан от 19 мая 2003 года № 460 "Об утверждении Положения об аттестации научных организаций" (САПП Республики Казахстан, 2003 г., № 20, ст. 206);

3) постановление Правительства Республики Казахстан от 8 мая 2007 года № 370 "О внесении дополнений и изменений в постановление Правительства Республики Казахстан от 19 мая 2003 года № 460 (САПП Республики Казахстан, 2007 г., № 14, ст. 165).

3. Настоящее постановление вводится в действие по истечении десяти календарных дней со дня первого официального опубликования.

Правила аккредитации субъектов научной и (или) научно-технической деятельности

Глава. 1. Общие положения

1. Настоящие Правила аккредитации субъектов научной и (или) научно-технической деятельности (далее – Правила) разработаны в соответствии с Законом Республики Казахстан "О науке" и устанавливают порядок проведения аккредитации субъектов научной и (или) научно-технической деятельности (далее – субъекты), подачи документов для проведения аккредитации, их рассмотрения и выдачи свидетельств об аккредитации уполномоченным органом в области науки (далее – уполномоченный орган).

2. В настоящих Правилах используются следующие понятия:

1) свидетельство об аккредитации – документ, подтверждающий официальное признание уполномоченным органом осуществляемой физическим либо юридическим лицом научной, научно-технической деятельности, по форме согласно приложению 1 к настоящим Правилам;

2) аккредитация – процедура, в результате которой юридические и физические лица, являющиеся субъектами, приобретают официальное признание соответствия их деятельности требованиям и стандартам, установленным законодательством Республики Казахстан.

3. Субъектами являются:

1) юридические лица – организации, осуществляющие научную и (или) научно-техническую деятельность;

2) физические лица, осуществляющие научную и (или) научно-техническую деятельность, – научные, инженерно-технические и иные работники, состоящие в трудовых отношениях с научными организациями, организациями высшего и (или) послевузовского образования, осуществляющими научную и (или) научно-техническую деятельность, а также ученые, самостоятельно осуществляющие научную и (или) научно-техническую деятельность.

4. Организации, для которых научно-техническая деятельность не является основным видом деятельности, имеющие в своей структуре научные подразделения, в целях решения задач, закрепленных в их учредительных документах, могут пройти аккредитацию в уполномоченном органе с целью получения свидетельства об аккредитации.

5. Аккредитация субъектов осуществляется за счет их собственных средств.

6. Уполномоченный орган формирует базу данных аккредитованных субъектов, получивших свидетельства об аккредитации, а также прекративших действие свидетельств, размещающуюся на интернет-ресурсах уполномоченного органа.

Глава 2. Порядок проведения аккредитации

7. Порядок проведения аккредитации физических и юридических лиц осуществляется согласно приказу Министра образования и науки Республики Казахстан от 12 мая 2020 года № 196 "Об утверждении Правил оказания государственной услуги "Аккредитация субъектов научной и (или) научно-технической деятельности" (зарегистрирован в Реестре государственной регистрации нормативных правовых актов под № 20626) (далее – приказ № 196).

Для получения аккредитации физические лица представляют уполномоченному органу следующие документы:

1) заявление по форме согласно приказу №196;

2) копии удостоверения личности, диплома о высшем образовании; диплома магистра и (или) диплома о присуждении ученой степени (кандидата наук, доктора наук), степени доктора философии (PhD), доктора по профилю и (или) аттестата (диплома) о присвоении ученого звания ассоциированного профессора (доцента) или профессора (документы об образовании, выданные зарубежными организациями образования, признаются на территории Республики Казахстан согласно законодательству в сфере образования);

3) опубликованные научные статьи за последние 5 лет: для технических и естественных наук не менее 1 (один) международного патента или 1 (один) статьи в международном рецензируемом научном журнале, имеющем ненулевой импакт-фактор по данным в Journal Citation Reports компании Clarivate Analytics, или в изданиях, имеющих в базе данных Scopus показатель процентиля по CiteScore не менее 35 хотя бы по одной из научных областей; для социальных и гуманитарных наук не менее 1 (один) статьи в изданиях, имеющих ненулевой импакт-фактор по данным Journal Citation Reports компании Clarivate Analytics или индексируемых в базе данных Web of Science Core Collection (разделы Arts and Humanities Citation Index, Science Citation Index Expanded, Social Sciences Citation Index), а также не менее 3 (три) статьей в научных изданиях, рекомендованных Комитетом по обеспечению качества в сфере образования и науки Министерства образования и науки Республики Казахстан.

При осуществлении аккредитации юридических лиц проводится оценка соответствия на основе балльной системы по шкале оценок (баллов) соответствия условиям для получения свидетельства об аккредитации (для юридических лиц) по форме согласно приложению 2 к настоящим Правилам.

Пороговый балл для прохождения аккредитации составляет 22 (двадцать два) балла и является суммой пороговых оценок по каждому критерию.

При этом аккредитация филиалов (представительств) юридического лица проводится в составе организации.

8. Свидетельство об аккредитации выдается сроком на 5 (пять) лет.

Свидетельство об аккредитации выдается:

юридическому лицу – руководителю или уполномоченному лицу под роспись на основании доверенности;

физическому лицу – непосредственно заявителю или уполномоченному лицу по нотариально засвидетельствованной доверенности или его представителю, полномочия которого оформлены в соответствии со статьей 68 Административного процедурно-процессуального кодекса Республики Казахстан.

9. Уполномоченный орган обеспечивает изготовление, учет и хранение бланков свидетельств об аккредитации.

10. До истечения срока свидетельство об аккредитации прекращает свое действие в случаях:

1) реорганизации (в формах разделения и выделения) или ликвидации юридического лица;

2) наличия письменного заявления субъекта о прекращении действия свидетельства;

3) смерти (вступления в законную силу решения суда о признании недееспособным, на основании которого субъект лишается специального права, связанного с занятием в определенной сфере) физического лица, получившего свидетельство об аккредитации.

Пороговый уровень для прохождения аккредитации определяется по формуле 1:

Пороговые уровни по критериям определяются по формуле 2:

где Npi –значение i-го показателя, единиц, Qi – оценка в баллах.

В случае, если у заявителя по критериям оценки фактические значения показателей выше пороговых, оценочный балл увеличивается на 1 балл (+1 балл) в соответствии с формулами 3, 4.
