On approval of the Rules for the Assignment of the Status of International Schools

In accordance with paragraph 4 of Article 65 of the Law of the Republic of Kazakhstan dated July 27, 2007 "On Education", the Government of the Republic of Kazakhstan HEREBY DECREES AS FOLLOWS:

1. That the attached Rules for the Assignment of the Status of International Schools shall be approved.

2. This decree shall become effective ten calendar days after the first official publication.

Rules for the Assignment of the Status of International Schools
1. General provisions

1. These Rules are developed in accordance with paragraph 4 of Article 65 of the Law of the Republic of Kazakhstan dated July 27, 2007 “On Education” and determine the procedure for assigning the status of international schools.

2. The assignment of the status of international schools shall be carried out with the aim of improving and integrating the experience of international education in the education system of the Republic of Kazakhstan, creating a legal framework for the established practice of functioning schools that implement independently developed general educational curricula of preschool, primary, basic secondary and general secondary education in the Republic Kazakhstan.

3. The requirement to assign the status of international schools shall be the conformity of the educational organization with the criteria set forth below:

1) school membership in international educational organizations;

2) the school has passed international institutional accreditation or authorization of educational programs by the International Baccalaureate organization ;

3) ensuring information transparency in all areas of activity;

4) ensuring the safety of life and health of students and school personnel in accordance with the requirements of international accreditation organizations;

5) implementation of integrated educational programs independently developed taking into account the requirements of the state compulsory education standard of the Republic of Kazakhstan and international general educational programs;

6) inclusion in the educational curriculum of schools of subjects of the Kazakhstan component: the Kazakh Language, Kazakh Literature, the History of Kazakhstan, the Geography of Kazakhstan;

7) obtaining by graduates of primary and secondary schools of international certificates and diplomas;

8) international examiners, trainers, experts that are the members of the teaching staff of the school;

9) compliance of the school’s material, technical and resource base with the requirements of international accreditation organizations.

2. Procedure for conferring the status of an international educational organization

4. An educational organization that intends to receive the status of an international school shall submit to the Authorized Body in the field of education (hereinafter referred to as the Authorized Body) materials and documents confirming compliance with the criteria established in paragraph 3 of these rules and a written application, which shall include:

1) the information about the founders;

2) the name, location (legal, actual address, contact phone numbers) of the educational organization;

3) the brief summary of the educational achievements of the educational organization;

4) the content of general educational curricula (the main objectives of the program, initial theoretical and methodological provisions, means of control, monitoring and ensuring the quality of student learning, a list of educational and methodological developments that provide an educational organization program);

5) the information on personnel, economic , material, technical and scientific support of the educational process; sources of financing.

5. In order to consider compliance with the declared status, a commission (hereinafter referred to as the “Commission”) shall be created to review the submitted applications of educational institutions. The deadline for consideration of the application shall be thirty calendar days.

6. The Commission shall consist of representatives of the Authorized Body, scientific organizations, pedagogical associations and teaching associations.

7. The composition and Regulation of the Commission shall be approved by the Authorized Body.

8. The Commission, on the basis of these rules and regulations, shall verify the conformity of the educational organization with the criteria established in paragraph 3 of these rules.

9. Based on the results of consideration of the submitted materials, the Commission shall develop a recommendation on refusal or assignment of the status of international schools and draw up a protocol that shall be signed by all members of the Commission indicating the dissenting opinion of members who disagree with this conclusion.

10. The recommendations of the Commission shall be adopted by a majority vote of those present at the meeting.

11. The Authorized Body shall send a notice of refusal (with justified justification) to assign the status of international schools within five working days.

12. In the event of a refusal an educational organization may submit an application to the Authorized Body no earlier than three years later.

13. The reason for refusal shall be the non-compliance of the educational organization with the established criteria.

14. Based on the results of a positive conclusion of the Commission, the Authorized Body shall develop and submit to the Government of the Republic of Kazakhstan a draft resolution on assigning the status of international schools within ten working days.

Постановление Правительства Республики Казахстан от 6 февраля 2012 года № 207.

В соответствии с пунктом 4 статьи 65 Закона Республики Казахстан от 27 июля 2007 года "Об образовании" Правительство Республики Казахстан ПОСТАНОВЛЯЕТ:

1. Утвердить прилагаемые Правила присвоения статуса международных школ.

2. Настоящее постановление вводится в действие по истечении десяти календарных дней после первого официального опубликования.

Правила
присвоения статуса международных школ
1. Общие положения

1. Настоящие Правила разработаны в соответствии с пунктом 4 статьи 65 Закона Республики Казахстан от 27 июля 2007 года "Об образовании" и определяют порядок присвоения статуса международных школ.

2. Присвоение статуса международных школ осуществляется с целью совершенствования и интеграции опыта международного образования в систему образования Республики Казахстан, создания правовой базы для сложившейся практики функционирования школ, реализующих самостоятельно разработанные общеобразовательные учебные программы дошкольного, начального, основного среднего и общего среднего образования в Республике Казахстан.

3. Требованием по присвоению статуса международных школ является соответствие организации образования установленным ниже критериям:

1) членство школы в международных образовательных организациях;

2) прохождение школой международной институциональной аккредитации или авторизации образовательных программ организацией Международного Бакалавриата;

3) обеспечение информационной открытости по всем направлениям деятельности;

4) обеспечение охраны жизни и здоровья учащихся и персонала школы в соответствии с требованиями международных аккредитационных организаций;

5) реализация интегрированных образовательных программ, самостоятельно разработанных с учетом требований государственного общеобязательного стандарта образования Республики Казахстан и международных общеобразовательных учебных программ;

6) включение в образовательную программу школ предметов казахстанского компонента: казахского языка, казахской литературы, истории Казахстана, географии Казахстана;

7) получение выпускниками основной и средней школы международных сертификатов и дипломов;

8) наличие в педагогическом составе школы международных экзаменаторов, тренеров, экспертов;

9) соответствие материально-технической и ресурсной базы школы требованиям международных аккредитационных организаций.

2. Порядок присвоения статуса международной
организации образования

4. Организация образования, желающая получить статус международной школы, представляет в Уполномоченный орган в области образования (далее - Уполномоченный орган) материалы и документы подтверждающие соответствие критериям установленных в пункте 3 настоящих правил и письменную заявку, которая включает:

1) сведения об учредителях;

2) наименование, место нахождения (юридический, фактический адреса, контактные телефоны) организации образования;

3) краткое резюме образовательных достижений организации образования;

4) содержание общеобразовательных учебных программ (основные цели программы, исходные теоретико-методологические положения, средства контроля, мониторинга и обеспечения качества обучения учащихся, перечень учебно-методических разработок, обеспечивающих программу организации образования);

5) сведения по кадровому, экономическому, материально-техническому и научному обеспечению учебно-воспитательного процесса; источники финансирования.

5. В целях рассмотрения на соответствие заявленному статусу создается комиссия (далее - Комиссия) по рассмотрению поданных заявок организаций образования. Срок рассмотрения заявки - тридцать календарных дней.

6. В состав Комиссии входят представители Уполномоченного органа, научных организаций, ассоциаций педагогов и учебно-методических объединений.

7. Состав и Положение Комиссии утверждается Уполномоченным органом.

8. Комиссия на основании настоящих правил и положения проверяет на соответствие организации образования критериям, установленных в пункте 3 настоящих правил.

9. По результатам рассмотрения представленных материалов Комиссией вырабатывается рекомендация об отказе или присвоении статуса международных школ и оформляется протоколом, который подписывается всеми членами Комиссии с указанием особого мнения членов, не согласных с данным заключением.

10. Рекомендация Комиссии принимаются большинством голосов присутствующих на заседании.

11. Уполномоченный орган направляет уведомление об отказе (с мотивированным обоснованием) в присвоении статуса международных школ в течение пяти рабочих дней.

12. В случае отказа организация образования может подать заявку в Уполномоченный орган не ранее, чем через три года.

13. Основанием для отказа является несоответствие организации образования установленным критериям.

14. По итогам положительного заключения Комиссии Уполномоченным органом в срок десяти рабочих дней разрабатывается и направляется в Правительство Республики Казахстан проект постановления о присвоении статуса международных школ.
