On approval of Rules for transfer and reinstatement at the Academy of Law Enforcement Agencies under the General Prosecutor's Office of the Republic of Kazakhstan

In accordance with Subparagraph 12) of Article 5-1 of the Law of the Republic of Kazakhstan dated July 27, 2007 "On Education", I HEREBY ORDER AS FOLLOWS:

1. Approve the attached Rules for transfer and reinstatement at the Academy of Law Enforcement Agencies under the General Prosecutor's Office of the Republic of Kazakhstan (hereinafter referred to as the Academy).

2. The Rector of the Academy Baizhanov U.S. shall provide:

1) State Registration of this Order with the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the State Registration of this Order with the Ministry of Justice of the Republic of Kazakhstan, the direction for official publication in periodicals and the Legal Information System "Adіlet";

3) within five working days from the date of receipt of this Order at the Ministry of Justice of the Republic of Kazakhstan, the direction to the Republican State Enterprise on the Right of Economic Use "Republican Legal Information Center of the Ministry of Justice of the Republic of Kazakhstan" for placement in the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;

4) placement of this Order on the Internet resource of the General Prosecutor's Office of the Republic of Kazakhstan.

3. The control over the execution of this Order shall be assigned to I. D Merkel, First Deputy Prosecutor General of the Republic of Kazakhstan.

4. This Order shall be enforced upon expiry of ten calendar days after the day its first official publication.

Rules
for transfer and reinstatement at the Academy of Law Enforcement Agencies
under the General Prosecutor's Office of the Republic of Kazakhstan
1. General Provisions

1. These Rules for transfer and reinstatement at the Academy of Law Enforcement Agencies under the General Prosecutor's Office of the Republic of Kazakhstan (hereinafter referred to as the “Rules”) shall be developed in accordance with Subparagraph 12) of Article 5-1 of the Law of the Republic of Kazakhstan dated July 27, 2007 “On Education”.

2. The Rules shall determine the procedure for transferring and restoring students in the postgraduate and doctoral studies of the Academy of Law Enforcement Agencies under the General Prosecutor's Office of the Republic of Kazakhstan (hereinafter referred to as the Academy).

3. The transfer of students shall be carried out from course to course, from one educational program to another at the Academy, from the Academy to other higher educational institutions (hereinafter referred to as the University), from other universities to the Academy.

4. A prerequisite for transfer and reinstatement at the Academy shall be the fulfillment of all the requirements of the working curriculum studied for previous academic periods and passing the intermediate certification.

5. Students shall be transferred from one course to another based on the results of the academic year (intermediate certification), taking into account the results of the summer semester and the Grade-Point Average (GPA), not lower than the transfer point set by the Academic Council of the Academy for the current academic year.

6. Transfer of students from the Academy to other HEIs shall be carried out in accordance with the requirements of the host educational institution.

7. Reinstatement at the Academy shall be carried out from among those who previously studied at the Academy, as well as those who studied at other HEIs.

Persons previously expelled from the Academy or other HEIs for poor performance or for negative reasons cannot be reinstated at the Academy.

8. When transferring or reinstating a student from a foreign educational organization, the following documents must be submitted:

1) a document on mastered training programs (academic certificate or transcript);

2) a document on completion of the previous level of education, which goes through the nostrification procedure in the Republic of Kazakhstan in the manner established by the Rules for recognition and nostrification of education documents, approved by the Order of the Minister of Education and Science of the Republic of Kazakhstan No. 8 dated January 10, 2008 (registered in the Register of State Registration of Normative legal acts under No. 5135);

3) the results of entrance tests for admission to foreign educational organizations.

9. Transfer and reinstatement to the Academy shall be carried out in the presence of vacancy on the corresponding course.

10. The issue of transfer and reinstatement shall be considered by the Rector of the Academy during the winter and summer holidays within five calendar days before the start of the next academic period.

11. During transfer and reinstatement, the academic difference in the disciplines of the work curriculum studied by students and/or candidates for study for previous academic periods shall be determined.

When determining the difference in disciplines, the difference in the forms of the final control shall not be taken into account.

12. If there are several candidates for transfer or reinstatement for a vacancy, the person with the highest Grade Point Average (GPA) shall be the advantage.

13. The academic difference in the disciplines of working curricula shall be determined by the Academy based on the list of disciplines studied, their programs and volumes in academic hours or credits reflected in the transcript.

14. The elimination of the academic difference in the disciplines of the work curriculum shall be carried out by students according to an individual schedule developed by the department of educational and methodical work of the Institute for Postgraduate Education of the Academy (hereinafter - IPEA) and approved by the supervising Vice-Rector of the Academy.

The student during the current academic period passes all types of current control, receives admission to the final control.

15. In the case of receiving unsatisfactory marks in eliminating the academic difference in discipline, re-passing shall not be allowed and the student shall be subject to expulsion for academic failure from the Academy.

16. Information on availability of vacancy in the Academy shall be published on the Academy's Internet resource.

2. Transfer procedure

17. When transferring from another university to the Academy, the student submits a transfer report in arbitrary writing to the rector of the Academy with a copy of the transcript signed by the Vice-Rector for Academic Affairs and the Office Registrar, an application for transfer to the head of the university where he studied (with the signature of the head and seal).

When transferring a student, the direction of training, the profile of the educational program, educational achievements, as well as cases of violation of academic integrity of students are taken into account.

18. The teaching and methodological division of the Academy, within three calendar days, on the basis of the provided copy of the transcript, determines the academic difference in the subjects in the work curriculum, transfers the completed credits provided that they correspond to the content and volume of the discipline, and sets the course in accordance with the mastered prerequisites.

19. Enrollment to study at the Academy in the transfer order shall be executed by the Order of the Rector of the Academy, previously agreed with the supervising Vice-Rector, Director of the IPE and the Head of the educational-methodical work department of the IPE.

20. Within three working days after issuance of the Order on admission, a copy shall be sent to the HEI at the place of study of the student.

21. The transfer of the student from one educational program to another at the Academy shall be carried out in a procedure similar to the transfer of the student from another university to the Academy.

When a student applies for transfer from one educational program to another, the presence of an application addressed to the head of another university is not required.

3. Reinstatement procedure

22. To be restored to study at the Academy, the candidate shall submit a report on restoration in arbitrary writing to the rector of the Academy with the application of a transcript.

23. After receiving the candidate's report within three calendar days on the basis of the provided transcript, the IPE (institute of postgraduate education) educational and methodological work subdivision shall determine the academic difference of disciplines in the working curricula, shall reload the mastered loans, provided that they correspond to the content and scope of the discipline, and shall establish a training course in accordance with the mastered pre-visits.

24. Admission to study at the Academy in the order of reinstatement shall be executed by the Order of the Rector of the Academy, previously agreed with the supervising Vice-Rector, Director of the IPE and the Head of the educational-methodical department of the IPE.

Об утверждении Правил перевода и восстановления в Академии правоохранительных органов при Генеральной прокуратуре Республики Казахстан

Приказ Генерального Прокурора Республики Казахстан от 31 марта 2016 года № 59. Зарегистрирован в Министерстве юстиции Республики Казахстан 29 апреля 2016 года № 13656.

В соответствии с подпунктом 12) статьи 5-1 Закона Республики Казахстан от 27 июля 2007 года "Об образовании", ПРИКАЗЫВАЮ:

1. Утвердить прилагаемые Правила перевода и восстановления в Академии правоохранительных органов при Генеральной прокуратуре Республики Казахстан (далее – Академия).

2. Ректору Академии Байжанову У.С. обеспечить:

1) государственную регистрацию настоящего приказа в Министерстве юстиции Республики Казахстан;

2) в течение десяти календарных дней после государственной регистрации настоящего приказа в Министерстве юстиции Республики Казахстан направление на официальное опубликование в периодических печатных изданиях и информационно-правовой системе "Әділет";

3) в течение пяти рабочих дней со дня получения настоящего приказа в Министерстве юстиции Республики Казахстан направление в Республиканское государственное предприятие на праве хозяйственного ведения "Республиканский центр правовой информации Министерства юстиции Республики Казахстан" для размещения в Эталонном контрольном банке нормативных правовых актов Республики Казахстан;

4) размещение настоящего приказа на интернет-ресурсе Генеральной прокуратуры Республики Казахстан.

3. Контроль за исполнением настоящего приказа возложить на первого заместителя Генерального Прокурора Республики Казахстан Меркеля И.Д.

4. Настоящий приказ вводится в действие по истечении десяти календарных дней после дня его первого официального опубликования.

Правила
перевода и восстановления в Академии правоохранительных органов
при Генеральной прокуратуре Республики Казахстан
1. Общие положения

1. Настоящие Правила перевода и восстановления в Академии правоохранительных органов при Генеральной прокуратуре Республики Казахстан (далее –Правила) разработаны в соответствии с подпунктом 12) статьи 5-1 Закона Республики Казахстан от 27 июля 2007 года "Об образовании".

2. Правила определяют порядок перевода и восстановления обучающихся в магистратуре и докторантуре Академии правоохранительных органов при Генеральной прокуратуре Республики Казахстан (далее – Академия).

3. Перевод обучающихся осуществляется с курса на курс, с одной образовательной программы на другую в Академии, из Академии в другие высшие учебные заведения (далее – ВУЗ), из других ВУЗов в Академию,.

4. Обязательным условием перевода и восстановления в Академии является выполнение всех требований рабочего учебного плана, изученных за предыдущие академические периоды и сдача промежуточной аттестации.

5. Перевод обучающихся с курса на курс осуществляется по итогам учебного года (промежуточных аттестаций) с учетом результатов летнего семестра и набранного среднего балла успеваемости (GPA), не ниже установленного Ученым советом Академии переводного балла на текущий учебный год.

6. Перевод обучающихся из Академии в другие ВУЗы осуществляется в соответствии с требованиями принимающей организации образования.

7. Восстановление в Академии осуществляется из числа лиц, ранее обучавшихся в Академии, а также обучавшихся в других ВУЗах.

Восстановлению в Академию не подлежат лица, ранее отчисленные из Академии или других ВУЗов за неуспеваемость или по отрицательным мотивам.

8. При переводе или восстановлении обучающегося из зарубежной организации образования представляются следующие документы:

1) документ об освоенных учебных программах (академическая справка или транскрипт);

2) документ о завершении предыдущего уровня образования, который проходит процедуру нострификации в Республике Казахстан в порядке, установленном Правилами признания и нострификации документов об образовании, утвержденными приказом Министра образования и науки Республики Казахстан от 10 января 2008 года № 8 (зарегистрирован в Реестре государственной регистрации нормативных правовых актов под № 5135);

3) результаты вступительных испытаний при поступлении в зарубежные организации образования.

9. Перевод и восстановление в Академию осуществляется при наличии вакантных мест на соответствующем курсе.

10. Вопрос о переводе и восстановлении рассматривается ректором Академии в период зимних и летних каникул в течение пяти календарных дней до начала очередного академического периода.

11. При переводе и восстановлении определяется академическая разница в дисциплинах рабочих учебных планов, изученных обучающимися и/или кандидатами на учебу за предыдущие академические периоды.

При определении разницы в дисциплинах различие в формах итогового контроля не учитывается.

12. При наличии на перевод или восстановление нескольких кандидатов на одно вакантное место преимуществом обладает лицо, имеющее наибольший средний балл успеваемости (GPA).

13. Академическая разница в дисциплинах рабочих учебных планов определяется Академией на основе перечня изученных дисциплин, их программ и объемов в академических часах или кредитах, отраженных в транскрипте.

14. Ликвидация академической разницы в дисциплинах рабочих учебных планов осуществляется обучающимся по индивидуальному графику, разрабатываемому подразделением учебно-методической работы Института послевузовского образования Академии (далее – ИПВО) и утвержденному курирующим проректором Академии.

Обучающийся в течение текущего академического периода сдает все виды текущего контроля, получает допуск к итоговому контролю.

15. В случае получения неудовлетворительной оценки при ликвидации академической разницы по дисциплине, повторная сдача не допускается и обучающийся подлежит отчислению за академическую неуспеваемость из Академии.

16. Информация о наличии вакантных мест в Академии публикуется на интернет-ресурсе Академии.

2. Порядок перевода

17. При переводе из другого ВУЗа в Академию обучающийся подает рапорт о переводе в произвольной письменной форме на имя ректора Академии с приложением копии транскрипта, подписанного проректором по учебной работе и офис-регистратором, заявления о переводе на имя руководителя ВУЗа, где он обучался (с подписью руководителя и печатью).

При переводе обучающегося учитываются направление подготовки, профиль образовательной программы, учебные достижения, а также случаи нарушения академической честности обучающимся.

18. Учебно-методическое подразделение Академии в течение трех календарных дней на основании предоставленной копии транскрипта определяет академическую разницу дисциплин в рабочих учебных планах, проводит перезачет освоенных кредитов при условии их соответствия содержанию и объему дисциплины и устанавливает курс обучения в соответствии с освоенными пререквизитами.

19. Зачисление на учебу в Академию в порядке перевода оформляется приказом ректора Академии, предварительно согласованным с курирующим проректором, директором ИПВО и руководителем подразделения учебно-методической работы ИПВО.

20. В течение трех рабочих дней после издания приказа о зачислении, его копия направляется в ВУЗ по прежнему месту обучения обучающегося.

21. Перевод обучающегося с одной образовательной программы на другую в Академии осуществляется в порядке, аналогичном переводу обучающегося из другого ВУЗа в Академию.

При обращении обучающегося о переводе с одной образовательной программы на другую, наличие заявления, адресованного руководителю другого ВУЗа, не требуется.

3. Порядок восстановления

22. Для восстановления на учебу в Академию кандидат подает рапорт о восстановлении в произвольной письменной форме на имя ректора Академии с приложением транскрипта.

23. Подразделение учебно-методической работы ИПВО после поступления рапорта кандидата в течение трех календарных дней на основании предоставленной транскрипта определяет академическую разницу дисциплин в рабочих учебных планах, проводит перезачет освоенных кредитов при условии их соответствия содержанию и объему дисциплины и устанавливает курс обучения в соответствии с освоенными пререквизитами.

24. Зачисление на учебу в Академию в порядке восстановления оформляется приказом ректора Академии, предварительно согласованным с курирующим проректором, директором ИПВО и руководителем учебно-методического подразделения ИПВО.
