In accordance with subparagraph 5) of Article 5-3 of the Law of the Republic of Kazakhstan "On Education" and with subparagraph 10) of paragraph 15 of the Regulations on the Ministry of Science and Higher Education of the Republic of Kazakhstan, approved by the resolution of the Government of the Republic of Kazakhstan dated August 19, 2022 №580 "On some issues of the Ministry of Science and Higher Education of the Republic of Kazakhstan", I HEREBY ORDER:

1. To approve the attached Rules of monitoring the results of the admission of students to the organizations of higher and (or) postgraduate education under educational programs.

2. The Department of higher and postgraduate education of the Ministry of Education and Science of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, to ensure:

1) the state registration of this order at the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of the state registration of this order to send its copy in paper and electronic form in the Kazakh and Russian languages to the Republican state enterprise on the basis of the right of economic management “Republican Center for Legal Information” for official publication and inclusion into the Reference Control Bank of regulatory legal acts of the Republic of Kazakhstan;

3) the placement of this order on the Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan after its official publication;

4) within ten working days after the state registration of this order, to submit the information to the Legal Department of the Ministry of Education and Science of the Republic of Kazakhstan on the implementation of measures provided for in subparagraphs 1), 2) and 3) of this paragraph.

3. Vice-Minister of Education and Science of the Republic of Kazakhstan Aimagambetova A.K. shall be authorized to oversee the execution of this order.

4. This order shall come into force after the day of its first official publication.

for monitoring based on the results of the admission of students to the organizations
of higher and (or) postgraduate education under educational programs

Chapter 1. General provisions

1. These Rules for monitoring based on the results of the admission of students to the organizations of higher and (or) postgraduate education under educational programs have been developed in accordance with subparagraph 5) of Article 5-3 of the Law of the Republic of Kazakhstan "On Education" and with subparagraph 10) of paragraph 15 of the Regulations on the Ministry of Science and Higher Education of the Republic of Kazakhstan, approved by the resolution of the Government of the Republic of Kazakhstan dated August 19, 2022 №580 "On some issues of the Ministry of Science and Higher Education of the Republic of Kazakhstan" and determine the procedure for conducting the monitoring based on the results of the admission of students to the organizations of higher and (or) postgraduate education (hereinafter referred to as the OHPGE) under educational programs.

2. Monitoring based on the results of admission of students to OHPGE in educational programs (hereinafter referred to as monitoring) shall be carried out by the Ministry of Science and Higher Education of the Republic of Kazakhstan (hereinafter referred to as the Ministry) in order to collect, summarize and analyze information for compliance with regulatory legal acts governing the admission of students to OHPGE.

Chapter 2. Procedure for the monitoring based on the results
of admission of students to OHPGE under educational programs

3. To conduct monitoring, the Ministry makes a decision, which is formalized by order of the Minister of Science and Higher Education of the Republic of Kazakhstan or the person performing his duties until November 1 (first) of the calendar year and is carried out at OHPGE in accordance with the approved schedule.

4. To conduct the monitoring, a commission shall be established (hereinafter referred to as the commission), the composition of which shall be approved by the order of the Minister of Science and Higher Education of the Republic of Kazakhstan or by the person, performing his/her duties

The commission shall include the representatives of the Ministry, OHPGE and subordinated organizations of the Ministry. The number of committee members shall be at least 5 (five) and no more than 25 (twenty-five) people.

The commission shall be headed by a manager, appointed from among the employees of the Ministry.

5. The head of the OHPGE shall ensure the conditions for monitoring and timely provision of information for collecting, summarizing and analyzing compliance with the regulatory legal acts, governing the admission of students to the OHPGE.

6. The head of the OHPGE shall ensure the reliability of the provided information to the members of the commission.

7. Based on the results of the monitoring, the commission shall draw up a certificate on the results of monitoring in 2 (two) copies in Kazakh or Russian languages, which is signed by the members of the commission.

In case of discrepancies, the copies of supporting documents shall be attached to the certificate on the results of the monitoring.

8. The commission shall submit a certificate on the results of the monitoring for review and signing to the first head of OHPGE, which is certified by the seal of OHPGE.

One copy of the certificate on the results of the monitoring remains with the head of the commission, and the second - in OHPGE.

9. Based on the results of monitoring, OHPGE shall develop and approve an action plan to eliminate comments if a non-compliance is identified within 10 (ten) calendar days. OHPGE shall submit a report on eliminating comments or a refutation of identified inconsistencies to the Ministry within 30 (thirty) calendar days from the date of completion of monitoring in OHPGE.

In case of failure to provide a report on the elimination of comments or a refutation, the Ministry conducts repeated monitoring in this OHPGE within 3 (three) months.

10. Results of the monitoring shall be considered at the meeting of the commission chaired by the supervising vice-minister of Science and Higher Education of the Republic of Kazakhstan.

В соответствии с подпунктом 5) статьи 5-3 Закона Республики Казахстан "Об образовании" и с подпунктом 10) пункта 15 Положения о Министерстве науки и высшего образования Республики Казахстан, утвержденного постановлением Правительства Республики Казахстан от 19 августа 2022 года № 580 "О некоторых вопросах Министерства науки и высшего образования Республики Казахстан", ПРИКАЗЫВАЮ:

1. Утвердить прилагаемые Правила проведения мониторинга по итогам приема обучающихся в организации высшего и (или) послевузовского образования по образовательным программам.

2. Департаменту высшего и послевузовского образования Министерства образования и науки Республики Казахстан в установленном законодательством Республики Казахстан порядке обеспечить:

1) государственную регистрацию настоящего приказа в Министерстве юстиции Республики Казахстан;

2) в течение десяти календарных дней со дня государственной регистрации настоящего приказа направление его копии в бумажном и электронном виде на казахском и русском языках в Республиканское государственное предприятие на праве хозяйственного ведения "Республиканский центр правовой информации" для официального опубликования и включения в Эталонный контрольный банк нормативных правовых актов Республики Казахстан;

3) размещение настоящего приказа на интернет-ресурсе Министерства образования и науки Республики Казахстан после его официального опубликования;

4) в течение десяти рабочих дней после государственной регистрации настоящего приказа представление в Департамент юридической службы Министерства образования и науки Республики Казахстан сведений об исполнении мероприятий, предусмотренных подпунктами 1), 2) и 3) настоящего пункта.

3. Контроль за исполнением настоящего приказа возложить на вице-министра образования и науки Республики Казахстан Аймагамбетова А.К.

4. Настоящий приказ вводится в действие после дня его первого официального опубликования.

Правила проведения мониторинга по итогам приема обучающихся в организации высшего и (или) послевузовского образования по образовательным программам

Глава 1. Общие положения

1. Настоящие Правила проведения мониторинга по итогам приема обучающихся в организации высшего и (или) послевузовского образования по образовательным программам разработаны в соответствии с подпунктом 5) статьи 5-3 Закона Республики Казахстан "Об образовании" и с подпунктом 10) пункта 15 Положения о Министерстве науки и высшего образования Республики Казахстан, утвержденного постановлением Правительства Республики Казахстан от 19 августа 2022 года № 580 "О некоторых вопросах Министерства науки и высшего образования Республики Казахстан" и определяют порядок проведения мониторинга по итогам приема обучающихся в организации высшего и (или) послевузовского образования (далее – ОВПО) по образовательным программам.

2. Мониторинг по итогам приема обучающихся в ОВПО по образовательным программам (далее – мониторинг) проводится Министерством науки и высшего образования Республики Казахстан (далее – Министерство) с целью осуществления сбора, обобщения и анализа информации на предмет соответствия нормативным правовым актам, регулирующим вопросы приема обучающихся в ОВПО.

Глава 2. Порядок проведения мониторинга по итогам приема обучающихся в ОВПО по образовательным программам

3. Для проведения мониторинга Министерство принимает решение, которое оформляется приказом Министра науки и высшего образования Республики Казахстан или лицом, исполняющим его обязанности в срок до 1 (первого) ноября календарного года и проводится в ОВПО в соответствии с утвержденным графиком.

4. Для проведения мониторинга создается комиссия (далее – комиссия), состав которой утверждается приказом Министра науки и высшего образования Республики Казахстан или лицом, исполняющим его обязанности.

В состав комиссии входят представители Министерства, ОВПО и подведомственных организаций Министерства. Количество членов комиссии составляет не менее 5 (пяти) и не более 25 (двадцати пяти) человек.

Комиссию возглавляет руководитель, назначаемый из числа сотрудников Министерства.

5. Руководитель ОВПО обеспечивает условия для проведения мониторинга и своевременное предоставление информации для осуществления сбора, обобщения и анализа на предмет соответствия нормативным правовым актам, регулирующим вопросы приема обучающихся в ОВПО.

6. Руководитель ОВПО обеспечивает достоверность предоставляемой информации членам комиссии.

7. По результатам мониторинга комиссия составляет справку об итогах проведения мониторинга в 2 (двух) экземплярах на казахском или русском языках, которая подписывается всеми членами комиссии.

В случае выявления несоответствия, к справке об итогах проведения мониторинга прилагаются копии подтверждающих документов.

8. Комиссия представляет справку об итогах проведения мониторинга для ознакомления и подписания первому руководителю ОВПО, которая заверяется печатью ОВПО.

Один экземпляр справки об итогах проведения мониторинга остается у руководителя комиссии, а второй – в ОВПО.

9. По результатам мониторинга ОВПО разрабатывает и утверждает план мероприятий по устранению замечаний, в случае выявления несоответствия в течение 10 (десяти) календарных дней. Отчет об устранении замечаний либо опровержение по выявленным несоответствиям ОВПО представляет в Министерство в течение 30 (тридцати) календарных дней со дня завершения мониторинга в ОВПО.

В случае не предоставления отчета об устранении замечаний, либо опровержения Министерство проводит повторный мониторинг в данном ОВПО в течение 3 (трех) месяцев.

10. Результаты мониторинга рассматриваются на заседании комиссии под председательством курирующего вице-министра науки и высшего образования Республики Казахстан.
