Қазақстан Республикасының Үкіметі ҚАУЛЫ ЕТЕДІ:

1. Қоса беріліп отырған:

1) Шетелдіктердің және азаматтығы жоқ адамдардың шекаралық аймаққа кіруіне рұқсаттама беру қағидалары;

2) Қазақстан Республикасы Үкіметінің кейбір шешімдеріне енгізілетін өзгерістер мен толықтырулар бекітілсін.

3. Осы қаулы алғашқы ресми жарияланғанынан кейін күнтізбелік он күн өткен соң қолданысқа енгізіледі.

кіруіне рұқсаттама беру қағидалары
1. Жалпы ережелер

1. Осы Шетелдіктердің және азаматтығы жоқ адамдардың шекаралық аймаққа кіруіне рұқсаттама беру қағидалары (бұдан әрі – Қағидалар) "Қазақстан Республикасының Мемлекеттік шекарасы туралы" 2013 жылғы 16 қаңтардағы Қазақстан Республикасы Заңының 40-бабына сәйкес әзірленді және шетелдіктер мен азаматтығы жоқ адамдардың шекаралық аймаққа кіруіне рұқсаттама беру тәртібін айқындайды.

2. Шетелдіктердің және азаматтығы жоқ адамдардың шекаралық аймаққа кіруіне осы Қағидаларға 1-қосымшадағы нысанға сәйкес ішкі істер органдары беретін рұқсаттамалар бойынша рұқсат етіледі.

3. Рұқсаттамалардың бланкілерін дайындауды облыстардың, Астана, Алматы қалаларының ішкі істер департаменттері (бұдан әрі – ІІД) жүзеге асырады.

2. Шетелдіктердің азаматтығы жоқ адамдардың шекаралық аймаққа
кіруіне рұқсаттама беру тәртібі

4. Шетелдіктерге және азаматтығы жоқ адамдарға шекаралық аймаққа кіру құқығына рұқсаттамаларды Қазақстан Республикасында уақытша немесе тұрақты болатын жері бойынша ІІД көші-қон полициясы басқармалары береді.

5. Шетелдіктерге және азаматтығы жоқ адамдарға рұқсаттамалар:

1) тұрақты тұру үшін келетіндерге – ішкі істер органдары беретін тұрақты тұруға арналған рұқсаттың немесе тиісті санаттағы визаның негізінде;

2) туризм мақсатында келетіндерге – тиісті санаттағы виза немесе туроператорлық немесе турагенттік қызметті жүзеге асыратын ұйымның растауы болған кезде қолдаухат негізінде;

3) оқу мақсатында келетіндерге – Қазақстан Республикасы оқу орнының немесе Қазақстан Республикасының білім беру мәселелері жөніндегі уәкілетті органының қолдаухаты болған кезде;

4) жұмыс мақсатында келетіндерге – қолданыстағы заңнамаға сәйкес алынған шетелдік жұмыс күшін тартуға рұқсат болған кезде жұмыс берушінің қолдаухаты негізінде, ал Еуразиялық экономикалық одаққа мүше мемлекеттердің (бұдан әрі – мүше мемлекеттер) азаматтары мен олардың отбасы мүшелері үшін мүше мемлекеттің еңбекшісі жұмыс берушімен немесе жұмыстарға (көрсетілетін қызметтерге) тапсырыс берушімен жасаған еңбек немесе азаматтық-құқықтық шарт негізінде;

5) емделуге келетіндерге – медициналық ұйымдар куәландырған растау құжаттарының немесе шекаралық аймақта орналасқан санаторий-курорт ұйымдарының жолдамалары негізінде;

6) жеке істері бойынша келетіндерге – шекаралық аймақта тұратын Қазақстан Республикасы азаматтарының шақыруы негізінде беріледі.

Жақын туыстары қайтыс болған (ауырған) жағдайда, шетелдіктер және азаматтығы жоқ адамдар шекаралық аймаққа (қолданыстағы заңнамаға сәйкес) рұқсаттама ресімдемей, өздерінің жеке басын куәландыратын құжаттары және медициналық ұйымдар куәландырған тиісті жеделхаттар (анықтамалар) бойынша, ал туысқандары жерленген жерлерге барған кезде – жерленген жерін растайтын мәліметтер бойынша кіреді.

6. Рұқсаттама 1 айға дейінгі мерзімге беріледі және қажет болған жағдайда дәл осындай мерзімге ұзартылады.

Шекаралық аймақта екі айдан астам болу қажет болған жағдайда жаңа рұқсаттама ресімделеді.

Оқу мақсатында келген кезде рұқсаттама бір оқу жылы мерзіміне беріледі.

Тұрақты тұру мақсатында келген кезде рұқсаттама шетелдіктің Қазақстан Республикасында тұруына ықтиярхатты және шекаралық аймақ тұрғынының куәлігін ресімдеу үшін қажетті мерзімге беріледі.

Еңбек қызметін жүзеге асыру мақсатында кірген кезде рұқсаттама рұқсаттың қолданылу мерзіміне, ал мүше мемлекеттердің азаматтары мен олардың отбасы мүшелері үшін мүше мемлекеттің еңбекшісі жұмыс берушімен немесе жұмыстарға (көрсетілетін қызметтерге) тапсырыс берушімен жасаған еңбек немесе азаматтық-құқықтық шарттың қолданылу мерзіміне беріледі.

7. Рұқсаттамалар бір адамға беріледі. Шекаралық аймаққа ата-аналарымен немесе өздерімен ілесіп жүретін адамдармен келетін 16 жасқа дейінгі балалар туралы мәліметтер осы адамдардың рұқсаттамасына енгізіледі.

8. Шекаралық аймаққа кіретін адамдар межеленген жерге келген соң Қазақстан Республикасы ратификациялаған халықаралық шарттарда көзделген жағдайларды қоспағанда, тұрақты немесе уақытша тұратын жеріндегі ішкі істер органдарында күнтізбелік бес күн ішінде тіркеледі.

9. Шекаралық аймаққа кіруге рұқсаттамалар белгілі бір елді мекенге беріледі. Бірнеше аудандардың немесе облыстардың аумағына кіру қажеттілігіне байланысты жұмыстарды жүзеге асыру туралы қолдаухат болған кезде рұқсаттамалар шекаралық аймақтың бірнеше елді мекеніне беріледі.

10. Шетелдіктер немесе азаматтығы жоқ адамдар жоғалтқан рұқсаттамалардың орнына жаңасы тек олардың берілгенін тиісті ішкі істер органы растағаннан кейін берілуі мүмкін.

11. Шекаралық аймаққа кіруге рұқсаттамалар алу үшін шетелдіктер және азаматтығы жоқ адамдар кіргенге дейін күнтізбелік 7 күн бұрын тұрғылықты жеріндегі ІІД көші-қон полициясы басқармасына мынадай құжаттарды ұсынады:

1) жеке тұлғалардан – осы Қағидаларға 2-қосымшаға сәйкес нысан бойынша жазбаша өтініш және осы Қағидалардың 5-тармағында көрсетілген, кіру мақсатын растайтын құжаттар;

2) заңды тұлғалардан – осы Қағидаларға 3-қосымшаға сәйкес нысан бойынша кәсіпорын немесе ұйым әкімшілігінің атынан қолдаухат.

Егер азаматтар тобы шекаралық аймақта жұмыстар жүргізуге жіберілсе, тізімдер қолдаухатқа қоса беріледі және үш данада ұсынылады. Тізімнің бірінші данасы көші-қон полициясы басқармасы бастығының немесе оның орынбасарының қолымен расталады, визалық мөрмен бекітіледі, топ жетекшісіне беріледі, екінші данасы ішкі істер органында қалады, үшінші данасы адамдарды тексеру үшін жолданады және ұлттық қауіпсіздік органдарының аумақтық бөлімшелерінде қалады.

12. Шекаралық аймаққа кіретін шетелдіктер және азаматтығы жоқ адамдар ішкі істер органдарының және Қазақстан Республикасы Ұлттық қауіпсіздік комитетінің есептері бойынша тексеріледі.

Шекаралық аймаққа өз бетінше, сондай-ақ ата-аналарымен немесе өздерімен ілесіп жүретін адамдармен бірге келетін 16 жасқа толмаған балалар жедел есептер бойынша тексерілмейді.

13. Өтініштер немесе қолдаухаттар оң қаралған кезде жеке тұлғаға немесе заңды тұлғаның өкіліне шекаралық аймаққа кіруге рұқсаттама беріледі. Рұқсаттамалар жеке тұлғаның жеке басын куәландыратын немесе заңды тұлға өкілінің өкілеттілігін растайтын құжаттарды тексергеннен кейін осы Қағидаларға 4-қосымшаға сәйкес нысан бойынша шекаралық аймаққа кіруге берілген рұқсаттамаларды есепке алу кітабында қол қоя отырып беріледі.

Рұқсаттаманы берген кезде көші-қон полициясының қызметкерлері алушыны рұқсаттаманың сыртқы жағында жазылған ережелермен қолын қойғыза отырып таныстырады.

14. Шекаралық аймаққа кіру және онда болу үшін қажетті құжаттар тізбесін толық ұсынбау шекаралық аймаққа кіруге рұқсаттаманы беруден бас тарту үшін негіз болып табылады.

Рұқсаттаманы беруден бас тарту туралы шешім қабылданған жағдайда, шетелдіктерді және азаматтығы жоқ адамдарды бұл туралы уәкілетті орган хабардар етеді.

15. Қажетті құжаттарды тапсыру сәтінен бастап шекаралық аймаққа кіруге рұқсаттаманы беру немесе оны беруден бас тарту туралы шешімді қабылдау мерзімі 7 жұмыс күнін құрайды.

Шекаралық аймаққа кіруге рұқсаттама беру немесе оны беруден бас тарту, сондай-ақ рұқсаттаманың жарамдылық мерзімін ұзарту туралы шешімдерді ІІД көші-қон полициясы бөлімшелерінің бастықтары растайды.

The Government of the Republic of Kazakhstan hereby DECREES AS FOLLOWS:

1. Approve the attached:

1) Rules for issuing permits for entry into border zone to foreigners and stateless persons;

2) amendments and additions to some decisions of the Government of the Republic of Kazakhstan.

2. This Decree shall be enforced upon expiry of ten calendar days after the first official publication.

1. General Provisions

1. These Rules for issuing permits for entry into border zone to foreigners and stateless persons (hereinafter referred to as - the Rules) shall be developed in accordance with Article 40 of the Law of the Republic of Kazakhstan dated January 16, 2013 "On the State Border of the Republic of Kazakhstan" and determine the procedure for issuing permits for entry into border zone for foreigners and stateless persons.

2. Entry of foreigners and stateless persons into the border zone shall be permitted by permits issued by the internal affairs authorities, in accordance with the form of Appendix 1 to these Rules.

3. Production of permits forms shall be carried out by the departments of internal affairs of regions, cities of Astana, Almaty (hereinafter referred to as – the DIA).

2. The procedure for issuing permits for entry into border zone to foreigners and stateless persons

4. Permits for the right to enter the border zone shall be issued to foreigners and stateless persons by the departments of migration police of the Department of Internal Affairs at the place of temporary or permanent residence in the Republic of Kazakhstan.

5. Permits shall be issued to foreigners and stateless persons to:

1) entrants for permanent residence - on the basis of a permit for permanent residence issued by the internal affairs authorities, or a visa of appropriate category;

2) entrants with the purpose of tourism – in existence of a visa of appropriate category or confirmation from the organization carrying out tour operator or travel agent activities on the basis of an application;

3) entrants for the purpose of study - in existence of a request from an educational institution of the Republic of Kazakhstan or an authorized agency of the Republic of Kazakhstan on educational affairs;

4) entrants for the purpose of work - on the basis of an application from the employer, in existence of a permit to engage foreign labour, obtained in accordance with applicable law, and for citizens of Member States of the Eurasian Economic Union (hereinafter referred to as - Member States) and their family members on the basis of labor or civil law contract entered into by a worker of the Member State with the employer or customer of work (service);

5) entrants for treatment - on the basis of supporting documents certified by medical organizations, or vouchers to sanatorium-resort organizations located in border zone;

6) entrants for private affairs - on the basis of an invitation from citizens of the Republic of Kazakhstan living in border zone.

Without obtaining a permit, foreigners and stateless persons shall enter the border zone on the occasion of death (illness) of close relatives (in accordance with applicable law) according to their identification documents and relevant telegrams (certificates) certified by medical organizations, and when following to burial places of relatives - according to information confirming the burial place.

6. Permit shall be issued for a period of up to 1 month and, if necessary, shall be extended for the same period.

If it is necessary to stay in border zone for more than two months, a new permit shall be issued.

When entering for study purposes, a permit shall be issued for a period of one academic year.

Upon entry for permanent residence, a permit shall be issued for a period necessary to apply for a residence permit of foreigner in the Republic of Kazakhstan and a certificate of a resident of border zone.

When entering for the purpose of carrying out labor activities, a permit shall be issued for the duration of permit and for citizens of the Member States and their family members for the duration of labor or civil law contract entered into by a worker of the Member State with the employer or customer of work (service).

7. Permit shall be issued for one person. Information about children under 16 years of age entering the border zone with their parents or their accompanying persons shall be entered in the permits of these persons.

8. Persons entering the border zone, upon arrival at their destination within five calendar days, shall be registered at their permanent or temporary place of residence in the internal affairs authorities, with the exception of cases provided by international treaties ratified by the Republic of Kazakhstan.

9. Permits for entry the border zone shall be issued in one particular locality. If there is a request for work related to the need for entry into the territory of several districts or regions, permits shall be issued to several settlements of border zone.

10. In exchange for permits lost by foreigners or stateless persons, new ones can be issued only after confirmation of their issuance by relevant internal affairs authorities.

11. In order to obtain permits for entry into border zone, foreigners and stateless persons, 7 calendar days before entry, shall submit the following documents to the Office of Migration Police of the Department of Internal Affairs at the place of residence:

1) from individuals - written statements in the form in accordance with Appendix 2 to these Rules, and documents confirming the purpose of entry specified in Paragraph 5 of these Rules;

2) from legal entities - an application on behalf of the administration of an enterprise or organization in the form in accordance with Appendix 3 to these Rules.

If groups of citizens are sent to work in the border zone, the lists shall be attached to the application and submitted in in three copies. The first copy of the list shall be certified by signature of the head of the Office of Migration Police or his/her deputy, sealed with a visa stamp, handed to the head of group, the second copy remains with the internal affairs authority, the third copy shall be sent for verification of persons and remains in the territorial divisions of the national security authority.

12. Foreigners and stateless persons entering the border zone shall be checked according to the records of the internal affairs authorities and the National Security Committee of the Republic of Kazakhstan.

Children under the age of 16 entering the border zone on their own, as well as with parents or persons accompanying them according to operational records, shall not be checked.

13. In case of a positive consideration of applications or petitions, an individual or representative of a legal entity shall be issued a permit for entry border zone. Permits shall be issued to them after checking documents proving the identity of an individual or confirming the authority of a representative of a legal entity against a receipt in the book of registration of issued permits for entry border zone in the form in accordance with Appendix 4 to these Rules.

Upon delivery of the permit, the employees of migration police shall require recipient to read, and acknowledge in writing that he/she understand the rules set forth on back of the permit.

14. The basis for refusal to issue a permit for entry the border zone shall be the submission of an incomplete list of documents required for entry and stay in the border zone.

In the event of a decision to refuse for issuance the permits, foreigners and stateless persons shall be notified of this by the authorized person.

15. The deadline for making a decision on issuance or refusal to issue a permit for entry the border zone from the date of delivery of the necessary documents shall be 7 business days.

Decisions on issuance or refusal of a permit for entry the border zone, as well as the extension of validity of the permits shall be confirmed by the heads of the Units of Migration Police of the Department of Internal Affairs.

permit and passport to the person responsible for registration (person) manager
of the house, the commandant of the hostel, the administration of the hotel, sanatorium, rest house or

3. In case of loss of the permit, this should be immediately
