О создании Государственного центра поддержки национального кино

В соответствии с подпунктом 2) статьи 4 Закона Республики Казахстан "О кинематографии" Правительство Республики Казахстан ПОСТАНОВЛЯЕТ:

1. Создать некоммерческое акционерное общество "Государственный центр поддержки национального кино" (далее - общество) со стопроцентным участием государства в его уставном капитале.

2. Определить основным предметом деятельности общества:

1) предоставление государственной поддержки в виде финансирования кинопроектов, претендующих на признание их национальными фильмами, и национальных фильмов, в том числе юридическому лицу со стопроцентным участием государства в уставном капитале, основным предметом деятельности которого является производство фильмов, в размере не менее тридцати пяти процентов от общего объема ежегодной суммы государственной финансовой поддержки;

Подпункт 2) действует до 31.12.2025 в соответствии с п. 8 настоящего постановления.

2) выплату субсидий в сфере кинематографии;

3) финансирование дубляжа на казахский язык детских анимационных фильмов и фильмов для семейного просмотра, ввозимых на территорию Республики Казахстан.

3. Уставной капитал общества сформировать за счет республиканского имущества, находящегося на балансе республиканского государственного казенного предприятия "Национальный музей Республики Казахстан", согласно приложению 1 к настоящему постановлению.

4. Создать Экспертный совет при обществе (далее – Экспертный совет) в составе согласно приложению 2 к настоящему постановлению.

5. Утвердить прилагаемое Положение об Экспертном совете.

6. Комитету государственного имущества и приватизации Министерства финансов Республики Казахстан совместно с Министерством культуры и спорта Республики Казахстан в установленном законодательством порядке обеспечить:

1) разработку и утверждение устава общества и его государственную регистрацию в органах юстиции Республики Казахстан;

2) передачу Министерству культуры и спорта Республики Казахстан прав владения и пользования государственным пакетом акций общества;

3) принятие иных мер, вытекающих из настоящего постановления.

7. Утвердить прилагаемые дополнения, которые вносятся в некоторые решения Правительства Республики Казахстан.

8. Настоящее постановление вводится в действие со дня его подписания.

Подпункт 2) пункта 2 настоящего постановления действует до 31 декабря 2025 года в соответствии с Законом Республики Казахстан "О кинематографии".

Положение об Экспертном совете при Государственном центре поддержки национального кино

Глава 1. Общие положения

1. Настоящее Положение об Экспертном совете при Государственном центре поддержки национального кино определяет статус и полномочия Экспертного совета (далее − Совет), который является консультативно-совещательным органом при Государственном центре поддержки национального кино.

2. В своей деятельности Совет руководствуется Конституцией Республики Казахстан, законами Республики Казахстан, актами Президента и Правительства Республики Казахстан, иными нормативными правовыми актами Республики Казахстан, а также настоящим Положением.

3. Рабочим органом Совета является Государственный центр поддержки национального кино (далее – Центр).

4. Заседания Совета проводятся по мере необходимости.

Глава 2. Задача и функции Совета

5. Основной задачей Совета является выработка предложений по признанию фильма национальным и финансированию дубляжа на казахский язык детских анимационных фильмов и фильмов для семейного просмотра, ввозимых на территорию Республики Казахстан.

6. Для реализации задачи, указанной в пункте 5 настоящего Положения, Совет осуществляет следующие функции:

1) рассматривает кинопроекты, претендующие на признание их национальными фильмами;

2) рассматривает детские анимационные фильмы и фильмы для семейного просмотра, ввозимые на территорию Республики Казахстан, для финансирования их дубляжа на казахский язык;

3) готовит заключения по финансированию кинопроектов, претендующих на признание их национальными фильмами;

4) готовит заключения по финансированию дубляжа на казахский язык детских анимационных фильмов и фильмов для семейного просмотра, ввозимых на территорию Республики Казахстан;

5) готовит рекомендации о признании фильма национальным или об отказе в признании фильма национальным;

6) осуществляет просмотр чернового монтажа кинопроектов, получивших государственную поддержку в виде финансирования кинопроектов, на любом этапе производства;

7) осуществляет иные функции, отнесенные к компетенции Совета.

Глава 3. Организация и порядок работы Совета

7. Состав Совета состоит из председателя, заместителя председателя и членов Совета, формируемых из числа творческих работников, работников культуры и экспертов в сфере кинематографии. Председатель Совета избирается из числа членов Совета простым большинством голосов членов на первом заседании Совета. Секретарь не является членом Совета.

8. Председатель Совета:

1) осуществляет руководство и контроль за деятельностью Совета;

2) утверждает план работы Совета;

3) проводит заседания и подписывает протоколы заседаний Совета;

4) несет ответственность за принимаемые Советом решения.

9. В случае отсутствия председателя его функции выполняет заместитель председателя.

10. Общее количество членов Совета составляет не менее 10 (десяти) членов.

11. Члены Совета участвуют в заседаниях Совета без права замены.

При невозможности участия в заседании член Совета не позднее, чем за день до заседания Совета направляет об этом письмо в рабочий орган Совета с указанием причины неявки либо принимает необходимые меры по оповещению рабочего органа Совета о невозможности принятия участия в заседании Совета в случае, если такая невозможность была установлена в день проведения заседания Совета.

12. Председатель Совета вносит в уполномоченный орган в сфере кинематографии предложения об исключении из состава Совета членов, допустивших систематическую неявку на его заседания (более 3 раз подряд) без уважительных причин.

13. Решения Совета оформляются в форме протокола, который носит рекомендательный характер.

14. Решения Совета принимаются открытым голосованием и считаются принятыми, если за них подано не менее двух третей голосов от общего количества присутствующих членов Совета. В случае равенства голосов принятым считается решение, за которое проголосовал председатель Совета.

Члены Совета имеют право на особое мнение, которое, в случае его выражения должно быть изложено в письменном виде.

По результатам проведения заседаний Совета и на основании листов голосования в течение трех рабочих дней составляется протокол, подписываемый председателем, членами и секретарем Совета.

15. Член Совета не может участвовать в рассмотрении и голосовании если он:

1) входит в состав авторов кинопроекта, фильма и съемочной группы;

2) является родственником, супругом (супругой) или свойственником кого-либо из лиц, входящих в состав авторов кинопроекта, фильма и съемочной группы.

16. Организация заседания, подготовка протокола, а также рассылка соответствующих документов и материалов членам Совета для предварительного ознакомления осуществляется секретарем Совета.

Направление документов и материалов осуществляется не менее чем за месяц до проведения очередного заседания Совета.

17. Заседания Совета фиксируются с помощью технических средств записи.

Материалы, зафиксированные в ходе заседания Совета с помощью технических средств записи, хранятся в Центре не менее трех лет со дня завершения заседания Совета.

1. В постановлении Правительства Республики Казахстан от 12 апреля 1999 года № 405 "О видах государственной собственности на государственные пакеты акций и государственные доли участия в организациях" (САПП Республики Казахстан, 1999 г., № 13, ст. 124):

в перечне акционерных обществ и хозяйственных товариществ, государственные пакеты акций и доли участия которых остаются в республиканской собственности, утвержденном указанным постановлением:

раздел "г. Астана" дополнить строкой, порядковый номер 21-190, следующего содержания:

"21-190. Некоммерческое акционерное общество "Государственный центр поддержки национального кино".

2. В постановлении Правительства Республики Казахстан от 27 мая 1999 года № 659 "О передаче прав по владению и пользованию государственными пакетами акций и государственными долями в организациях, находящихся в республиканской собственности":

в перечне государственных пакетов акций и государственных долей участия в организациях республиканской собственности, право владения и пользования которыми передается отраслевым министерствам и иным государственным органам, утвержденном указанным постановлением:

раздел "Министерству культуры и спорта Республики Казахстан" дополнить строкой, порядковый номер 224-33-10, следующего содержания:

In accordance with subclause 2) of Article 4 of the Law of the Republic of Kazakhstan "On cinematography" the Government of the Republic of Kazakhstan HEREBY RESOLVES:

1. To create the Non-Profit Joint Stock Company “State Center for the Support of National Cinema” (hereinafter referred to as the company) with one hundred percent participation of the state in its authorized capital.

2. To determine the major core activities of the company:

1) provision of state support in the form of financing of film projects claiming recognition as national films, and national films, including a legal entity with a wholly owned state participation in the authorized capital, the main activity of which is the production of films, in the amount of at least thirty-five percent of the total annual amount of state financial support;

2) payment of subsidies in the field of cinematography;

3) financing of dubbing into the Kazakh language of children's animated films and films for family viewing imported into the territory of the Republic of Kazakhstan.

3. To form the authorized capital of the company at the expense of the republican property, being at the balance of the Republican State Budget-supported Enterprise "National Museum of the Republic of Kazakhstan", according to Appendix 1 to this resolution.

4. To create an Expert Council in the company (hereinafter referred to as the Expert Council) in the composition, according to this resolution.

5. To approve the attached Regulations on the Expert Council.

6. The State Property and Privatization Committee of the Ministry of Finance of the Republic of Kazakhstan jointly with the Ministry of Culture and Sports of the Republic of Kazakhstan, in accordance with the procedure, established by the legislation, shall ensure:

1) development and approval of the charter of the company and its state registration with the bodies of justice of the Republic of Kazakhstan;

2) transfer the rights of ownership and use of the state-owned stake of shares of the company to the Ministry of Culture and Sports of the Republic of Kazakhstan;

3) taking other measures arising from this resolution.

7. To approve the attached additions, which are made to certain decisions of the Government of the Republic of Kazakhstan.

8. This Resolution shall come into force from the date of signing.

Subparagraph 2) of paragraph 2 of this Resolution shall be valid until December 31, 2025 in accordance with the Law of the Republic of Kazakhstan “On cinematography”.

Regulations on the Expert Council under the State Center of Support of National Cinema

Chapter 1. General provisions

1. These Regulations on the Expert Council under the State Center of Support of National Cinema shall determine the status and the powers of the Expert Council (hereinafter referred to as the Council), which is aт advisory body under the State Center of Support of National Cinema.

2. In its activities, the Council shall be governed by the Constitution of the Republic of Kazakhstan, laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan, as well as these Regulations.

3. The working body of the Council is the State Center for the Support of National Cinema (hereinafter referred to as the Center).

4. Meetings of the Council shall be held as necessary.

Chapter 2. Mission and functions of the Council

5. The main mission of the Council is to develop proposals for recognizing the film as national and financing dubbing into the Kazakh language of children's animated films and films for family viewing imported into the territory of the Republic of Kazakhstan.

6. To implement the mission specified in paragraph 5 of these Regulations, the Council shall carry out the following functions:

1) considers film projects that claim to be recognized as national films;

2) considers children's animation films and films for family viewing, imported into the territory of the Republic of Kazakhstan, to finance their dubbing into the Kazakh language;

3) prepares opinions on the financing of film projects claiming to be recognized as national films;

4) prepares opinions on the financing of dubbing into the Kazakh language of children's animated films and films for family viewing imported into the territory of the Republic of Kazakhstan;

5) prepares recommendations on the recognition of the film as national or on the refusal to recognize the film as national;

6) views breakdown footages of film projects that have received state support in the form of film project financing at any stage of production;

7) performs other functions within the competence of the Council.

Chapter 3. Organization and the operating procedure of the Council

7. The composition of the Council consists of the chairman, deputy chairman and members of the Council, formed from among creative workers, cultural workers and experts in the field of cinematography. The Chairman of the Council is elected from among the members of the Council by a simple majority of votes of the members at the first meeting of the Council. The Secretary is not a member of the Council..

8. The Chairman of the Council shall:

1) carry out guidance and control over the activities of the Council;

2) approve the work plan of the Council;

3) hold meetings and sign minutes of meetings of the Council;

4) bear responsibility for the decisions taken by the Council.

9. In the absence of the chairman, his functions shall be performed by the deputy chairman.

10. The total number of members of the Council shall be at least 10 (ten) members.

11. Members of the Council shall take part in the meetings of the Council without the right of substitution.

If it is impossible to participate in the meeting, a member of the Council no later than one day before the meeting of the Council shall send a letter to the working body of the Council indicating the reason for non-attendance, or takes the necessary measures to notify the working body of the Council about the impossibility of taking part in the meeting. meeting of the Council if such impossibility was established on the day of the meeting of the Council.

12. The chairman of the Council shall submit proposals to the authorized body in the field of cinematography to exclude members from the Council of the Council who have systematically failed to attend its meetings (more than 3 times in a row) without good reason.

13. Decisions of the Council shall be drawn up in the form of a protocol, which is of a recommendatory nature.

14. Decisions of the Council shall be taken by an open vote and are considered adopted if they are supported by at least two-thirds of the votes of the total number of members of the Council present. In the event of a tie, the decision is deemed to have been voted for by the chairman of the Council.

Members of the Council shall have the right for a special opinion, which, in case of its expression, must be set down in writing.

Based on the results of the meetings of the Council and on the basis of voting sheets, a protocol shall be drawn up within three working days, signed by the chairman, members and secretary of the Council.

15. A member of the Council may not participate in consideration and voting if he/she:

1) is a member of the authors of the film project, film and crew;

2) is a relative, spouse (wife) or in-law of one of the persons who are part of the authors of the film project, film and film crew.

16. The organization of the meeting, preparation of the minutes, as well as the distribution of relevant documents and materials to the members of the Council for preliminary acquaintance shall be carried out by the Secretary of the Council.

Submission of documents and materials shall be made at least one month before the next meeting of the Council.

17. Meetings of the Council shall be recorded by technical recording.

Materials recorded during a meeting of the Council with the help of technical recording means shall be kept at the Center for at least three years from the date of the conclusion of the meeting of the Council.

1. In the resolution of the Government of the Republic of Kazakhstan dated April 12, 1999 No. 405 " On the types of state ownership of state blocks of shares and state participation interests in organizations " (Collected Acts of the President and the Government of the Republic of Kazakhstan, 1999, No. 13, art. 124):

In the list of joint stock companies and business partnerships, blocks of shares and state participation interests of which remain in the republican ownership, approved by the specified resolution:

The section "Astana city" shall be added a line, serial number 21-190, as follows:

2. In the resolution of the Government of the Republic of Kazakhstan dated May 27, 1999 No. 659 " On the transfer of rights for owning and using state blocks of shares and state shares in organizations that are in republican ownership ":
