Постановление Правительства Республики Казахстан от 5 августа 2021 года № 528.

В соответствии с пунктом 4 статьи 70-1 Бюджетного кодекса Республики Казахстан Правительство Республики Казахстан ПОСТАНОВЛЯЕТ:

1. Утвердить прилагаемые Правила распределения резерва на инициативы Президента Республики Казахстан.

2. Настоящее постановление вводится в действие со дня его первого официального опубликования.

Правила распределения резерва на инициативы Президента Республики Казахстан

Глава 1. Общие положения

1. Настоящие Правила распределения резерва на инициативы Президента Республики Казахстан (далее – Правила) разработаны в соответствии с пунктом 4 статьи 70-1 Бюджетного кодекса Республики Казахстан и определяют порядок распределения резерва на инициативы Президента Республики Казахстан.

2. Резерв на инициативы Президента Республики Казахстан формируется в составе республиканского бюджета на первый год планового периода для финансирования ежегодных посланий Президента Республики Казахстан народу Казахстана и других инициатив Президента Республики Казахстан.

3. Резерв на инициативы Президента Республики Казахстан планируется в размере до двух процентов от планируемого объема расходов республиканского бюджета на очередной финансовый год.

4. Резерв на инициативы Президента Республики Казахстан предусматривается по отдельной распределяемой бюджетной программе, администрируемой центральным уполномоченным органом по бюджетному планированию.

Глава 2. Порядок распределения резерва на инициативы Президента Республики Казахстан

5. В рамках ежегодных посланий Президента Республики Казахстан народу Казахстана Правительство Республики Казахстан и государственные органы, непосредственно подчиненные и подотчетные Президенту Республики Казахстан, при направлении в Администрацию Президента Республики Казахстан предложений по тематике и содержанию проекта послания Президента Республики Казахстан в соответствии с пунктом 6 главы 2 Правил подготовки и реализации послания, работы с актами и поручениями Президента Республики Казахстан и осуществления контроля за их исполнением, проведения мониторинга нормативных правовых указов, утвержденных Указом Президента Республики Казахстан от 27 апреля 2010 года № 976, предоставляют потребности бюджетных средств по предложениям, предусматривающим финансирование.

6. После озвученных ежегодных посланий Президента Республики Казахстан народу Казахстана и других инициатив Президента Республики Казахстан соответствующий администратор бюджетных программ направляет в центральный уполномоченный орган по бюджетному планированию проект постановления Правительства Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан с указанием суммы средств и направлений расходов с приложением расчетов и обоснований в соответствии с бюджетным законодательством Республики Казахстан.

При одновременном распределении средств нескольким администраторам бюджетных программ проект постановления Правительства Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан разрабатывается центральным уполномоченным органом по бюджетному планированию.

7. Рассмотрение проекта постановления Правительства Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан центральным уполномоченным органом по бюджетному планированию, представленного администратором бюджетных программ, осуществляется в течение 5 рабочих дней с даты его поступления.

8. В случае представления неполного пакета и/или наличия замечаний по представленным документам к проекту постановления Правительства Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан, центральный уполномоченный орган по бюджетному планированию возвращает на доработку проект постановления Правительства Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан.

Администратор бюджетных программ представляет доработанный проект постановления Правительства Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан в центральный уполномоченный орган по бюджетному планированию в течение 5 рабочих дней с даты его возврата.

9. Администратор бюджетных программ обеспечивает полноту и достоверность информации и расчетов, прилагаемых к проекту постановления Правительства Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан.

10. Центральный уполномоченный орган по бюджетному планированию по итогам рассмотрения материалов формирует заключение по проекту постановления Правительства Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан и в течение 5 рабочих дней вносит заключение на согласование в Администрацию Президента Республики Казахстан.

После согласования заключения Администрацией Президента Республики Казахстан центральный уполномоченный орган по бюджетному планированию вносит проект постановления Правительства Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан с заключением на рассмотрение Республиканской бюджетной комиссии в порядке, установленном бюджетным законодательством Республики Казахстан.

11. После принятия решения Правительством Республики Казахстан о выделении средств из резерва на инициативы Президента Республики Казахстан в ходе исполнения бюджета администраторы бюджетных программ в течение 5 рабочих дней вносят изменения в соответствующие планы финансирования.

12. Использование средств, выделенных из резерва на инициативы Президента Республики Казахстан, осуществляется в соответствии с требованиями Бюджетного кодекса, положениями Правил исполнения бюджета и его кассового обслуживания, утвержденных приказом Министра финансов Республики Казахстан от 4 декабря 2014 года № 540 (зарегистрирован в реестре государственной регистрации нормативных правовых актов за № 9934).

13. Государственные органы, получившие средства из резерва на основании решения Правительства Республики Казахстан, осуществляют возврат неиспользованных средств путем восстановления кассовых расходов распределяемой бюджетной программы в соответствии с бюджетным законодательством Республики Казахстан.

14. Финансирование инициатив Президента Республики Казахстан, имеющих среднесрочный характер, на второй и последующие годы будет осуществляться в соответствии с бюджетным законодательством Республики Казахстан.

In accordance with paragraph 4 of Article 70-1 of the Budget Code of the Republic of Kazakhstan dated December 4, 2008, the Government of the Republic of Kazakhstan HEREBY RESOLVES:

1. To approve the attached Rules for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan.

2. This Resolution shall enter into force from the date of its first official publication.

Rules for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan

Chapter 1. General provisions

1. These Rules for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan (hereinafter- the Rules) have been developed in accordance with paragraph 4 of Article 70-1 of the Budget Code of the Republic of Kazakhstan and shall determine the procedure for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan.

2. The reserve for the initiatives of the President of the Republic of Kazakhstan shall be formed as part of the republican budget for the first year of the planning period to finance the annual addresses of the President of the Republic of Kazakhstan to the people of Kazakhstan and other initiatives of the President of the Republic of Kazakhstan.

3. The reserve for the initiatives of the President of the Republic of Kazakhstan shall be planned in the amount of up to two percent of the planned volume of expenditures of the republican budget for the next financial year.

4. The reserve for the initiatives of the President of the Republic of Kazakhstan shall be provided for under a separate allocated budget program administered by the central authorized body for budget planning.

Chapter 2. The procedure for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan

5. As part of the annual addresses of the President of the Republic of Kazakhstan to the people of Kazakhstan, the Government of the Republic of Kazakhstan and state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, when sending proposals to the Administration of the President of the Republic of Kazakhstan on the subject and content of the draft address of the President of the Republic of Kazakhstan in accordance with paragraph 3-2 section 1-1 of the Rules for the preparation, approval and submission to the President of the Republic of Kazakhstan of a draft address of the President of the Republic of Kazakhstan to the people of Kazakhstan, preparation, approval, submission for signature of draft acts and instructions of the President of the Republic of Kazakhstan, implementation of the address of the President of the Republic of Kazakhstan to the people of Kazakhstan, control over execution of acts and instructions of the President of the Republic of Kazakhstan, as well as instructions contained in the decisions of the Security Council of the Republic of Kazakhstan and the Assembly of the People of Kazakhstan, monitoring regulatory legal decrees of the President of the Republic of Kazakhstan, approved by the Decree of the President of the Republic of Kazakhstan dated April 27, 2010 No. 976, shall grant the needs of budgetary funds according to the proposals providing for financing.

6. After the announced annual addresses of the President of the Republic of Kazakhstan to the people of Kazakhstan and other initiatives of the President of the Republic of Kazakhstan, the relevant administrator of budget programs shall send to the central authorized body for budget planning a draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan, indicating the amount of funds and directions of expenses with the application of calculations and justifications in accordance with the budgetary legislation of the Republic of Kazakhstan.

With the simultaneous allocation of funds to several administrators of budget programs, a draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan shall be developed by the central authorized body for budget planning.

7. Consideration of the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan by the central authorized body for budget planning, submitted by the administrator of budget programs shall be carried out within 5 working days from the date of its receipt.

8. In case of submission of an incomplete package and/or comments on the submitted documents to the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan, the central authorized body for budget planning shall return the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from reserve for the initiatives of the President of the Republic of Kazakhstan for revision.

The administrator of budget programs shall submit a finalized draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan to the central authorized body for budget planning within 5 working days from the date of its return.

9. The administrator of budget programs shall ensure the completeness and reliability of the information and calculations attached to the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan.

10. The central authorized body for budget planning, based on the results of consideration of materials shall form a conclusion on the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan and within 5 working days shall submit a conclusion for approval to the Administration of the President of the Republic of Kazakhstan.

After the approval of the conclusion by the Administration of the President of the Republic of Kazakhstan, the central authorized body for budget planning shall submit a draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan with a conclusion for consideration by the Republican budget commission in the manner established by the budget legislation of the Republic of Kazakhstan.

11. After taking the decision by the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan in the course of budget execution, the administrators of budget programs within 5 working days shall make changes to the relevant financing plans.

12. The use of funds allocated from the reserve for the initiatives of the President of the Republic of Kazakhstan shall be carried out in accordance with the requirements of the Budget Code, the provisions of the Rules for execution of the budget and its cash services, approved by the order of the Minister of Finance of the Republic of Kazakhstan dated December 4, 2014 No. 540 (registered in the register of state registration of regulatory legal acts under No. 9934).

13. State bodies that have received funds from the reserve on the basis of a decision of the Government of the Republic of Kazakhstan shall return unused funds by restoring cash expenses of the allocated budget program in accordance with the budget legislation of the Republic of Kazakhstan.

14. Financing of the initiatives of the President of the Republic of Kazakhstan, which have a medium-term nature, for the second and subsequent years shall be carried out in accordance with the budget legislation of the Republic of Kazakhstan.
