Accreditation Rules
for republican associations of public associations of fishers and fishery subjects
1. General Provisions
1. These Accreditation Rules for republican associations of public associations of fishers and fishery subjects (hereinafter -the Rules) are developed in accordance with subparagraph 24-9) of Article 8 of the Law of the Republic of Kazakhstan dated July 9, 2004 “On Protection, Reproduction and Use of Animal World” (hereinafter – the Law) and establish the procedure for organizing and accrediting republican associations of public associations of fishers and fishery subjects.
2. The following basic concepts are used in these Rules:
1) commission - an accreditation commission established in the department of the authorized state body in the field of protection, reproduction and use of the animal world (wildlife);
2) accreditation - procedure for official recognition of the competence of the accreditation subject to carry out activities established by the Law;
3) accreditation body - a department of the authorized state body in the field of protection, reproduction and use of wildlife;
4) subject of accreditation - republican associations of public organizations of fishers and fishery subjects (hereinafter - the association).
3. Accreditation shall be carried out by the accreditation body to confirm eligibility of the accreditation subject to carry out activities provided for by the Law.
4. Accreditation requires availability of:
1) branches and (or) representative offices registered at least with eight regional centers at the location of the territorial units of the accreditation body;
2) website;
3) special literature in the field of conservation, reproduction and use of wildlife, resource materials and manuals on fishery;
4) corresponding staff with higher or secondary education, including specialists in the field of conservation, reproduction and use of wildlife;
5) public associations of amateur fishers and sport fishing as part of the association.
5. Stages of accreditation:
1) posting of announcement in print periodicals on carrying out accreditation;
2) submission by the association to the accreditation body of the documents referred to in paragraph 8 of these Rules;
3) examination by the commission of the accreditation materials;
4) decision making on accreditation or on denial of accreditation;
5) issuance of a certificate of accreditation or a motivated written response on denied accreditation.
2. Procedure for conducting accreditation
6. The accreditation body shall post an announcement on the terms and conditions of carrying out accreditation in the state and Russian languages in print periodicals distributed throughout the Republic of Kazakhstan and on the official website of the authorized body.
7. In order to conduct accreditation, a commission shall be formed of the staff members of the accreditation body.
The commission membership shall be approved by the order of the head of the accreditation body.
The commission shall have an odd number of members, comprised of at least five people.
The chairman of the commission shall be the head of the accreditation body.
The secretary of the commission shall be appointed from among the staff of the accreditation body and shall not be a member of the commission, maintain all documentation on the organization and conduct of accreditation.
The commission shall adopt a decision on accreditation or on denied accreditation by majority of votes in an open vote.
8. To pass the accreditation, within ten working days after the posted announcement, the association shall provide the following documents to the accreditation body:
1) application according to the form in Appendix 1 to these Rules;
2) notarized copies of constituent documents and certificates of state registration of the association as a legal entity, in the presence of branches and (or) representative offices - copies of certificates of accounting registration of branches and (or) representative offices of the association;
3) supporting documents on compliance with the requirements of paragraph 4 of these Rules;
4) list of the association members.
9. Consideration of documents shall be carried out at the meeting of the commission, upon the results of which the Commission recommends the following:
1) to accredit the association;
2) to deny accreditation.
10. Proceeding from the recommendation of the commission, the accreditation body shall make a decision on the issuance of a certificate of accreditation or denial of accreditation.
An accreditation certificate or a written notice of denied accreditation with indicated causes for it shall be issued for the association within five working days from the date the accreditation body adopts the relevant decision.
11. Accreditation may be denied if:
1) submitted documents do not comply with paragraph 8 of these Rules;
2) submitted documents contain false or incomplete information.
12. The deadline for examination of documents (from the moment of accepting applications) and decisionmaking on issuing a certificate of accreditation or denying accreditation shall not exceed fifteen working days.
13. The accreditation certificate shall be issued for a term of 4 years, in accordance with the form in Appendix 2 to these Rules.
14. The accreditation certificate shall be inalienable and not transferable to other persons.
15. In the event of a change in the name and location, within five working days the association shall submit an application to the accreditation body for renewal of the certificate of accreditation.
No later than ten working days from the date of submitting a corresponding written application, the accreditation body shall renew the certificate of accreditation.
16. In the event of loss or damage of the certificate of accreditation, the accreditation body on the basis of the written application, shall issue a duplicate of the accreditation certificate to the association within the term established by paragraph 15 of these Rules.
17. The decision on accreditation or on denial of accreditation of the association may be appealed in the manner established by the legislation of the Republic of Kazakhstan.
18. The certificate of accreditation shall be terminated in the following cases:
1) expiration of its validity;
2) reorganization or liquidation of the accredited association;
3) application of the association for voluntary termination of the certificate;
4) identification by the accreditation body of facts of improper implementation of activities provided for by the Law.
19. Upon the termination of the certificate of accreditation on the grounds specified in paragraph 18 of these Rules, the accreditation body shall again conduct accreditation in the manner prescribed by these Rules.
20. In accordance with paragraph 2 of Article 33-1 of the Law, accreditation shall be carried out by the accreditation body at the expense of own funds of the accredited associations.

9) conclusion of contracts with foreign individuals for organization of amateur (sports) fishing;
10) other activities provided for by the Charter and not prohibited by
the legislation of the Republic of Kazakhstan.
