      In compliance with subparagraph 38-4) of Article 5 of the Law of the Republic of Kazakhstan of July 27, 2007 "On Education" I hereby ORDER:

      1. That the attached Rules for the recognition of organizations providing non-formal education and the formation of a list of recognized organizations providing non-formal education shall be approved.

      2. Under the statutory procedure of the Republic of Kazakhstan, the Department of Higher and Postgraduate Education of the Ministry of Education and Science of the Republic of Kazakhstan, shall:

      1) ensure the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

      2) within ten calendar days from the date of state registration of this order, send its copy in paper and electronic form, both in the Kazakh and Russian languages to the Republican State Enterprise on the Right of Economic management "Republican Center of Legal Information" for official publication and inclusion into the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;

      3) placement this order on the Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan after its official publication;

      4) within ten working days after the state registration of this order, submit the information on the implementation of measures provided for in subparagraphs 1), 2) and 3) of this paragraph to the Legal Department of the Ministry of Education and Science of the Republic of Kazakhstan.

      3. The control over the execution of this order shall be entrusted to Vice-Minister of Education and Science of the Republic of Kazakhstan Aimagambetov A.K.

      4. This order shall enter into force upon the expiry of ten calendar days after the day of its first official publication.

Rules for the recognition of organizations providing non-formal education, and the formation
of a list of recognized organizations providing non-formal education
Chapter 1. General provisions

      1. These Rules (hereinafter referred to as the Rules) are developed in accordance with sub-paragraph 38-4) of Article 5 of the Law of the Republic of Kazakhstan of July 27, 2007 “On Education” and determine the procedure for recognizing the organizations providing non-formal education and the formation of a list of recognized organizations providing non-formal education.

      2. The following concepts shall be used in these Rules:

      1) non-formal adult education - a type of education carried out by organizations that provide educational services that are rendered without regard to the place, period and form of education, and is accompanied by the issuance of a document confirming the learning outcomes;

      2) the list of recognized organizations providing non-formal education (hereinafter referred to as the List) - the list of Kazakhstani and foreign organizations that provide non-formal education irrespective of the form of ownership, compiled by the authorized body in the field of education;

      3) recognition of organizations providing non-formal education - a procedure for confirming the powers of organizations providing educational services for non-formal education.

Chapter 2. Procedure for recognizing organizations providing non-formal education
and forming a list of recognized organizations providing non-formal education

      3. For the recognition of organizations providing non-formal education and the formation of the List by the authorized body in the field of education, a Commission shall be created (hereinafter referred to as the Commission).

      4. The Commission shall consist of an odd number of members, which consists of heads of structural divisions of authorized bodies and independent experts in the field of education.

      5. From among the members of the Commission a majority of votes shall elect a chairperson of the Commission who directs the activity of the Commission and in case of his/her absence, the deputy chairman.

      The functions of the secretary of the Commission shall be performed by a specialist of the authorized body in the field of education, who is not a member of the Commission.

      6. The decision of the Commission shall be taken by a majority of votes of the total number of persons participating in the meeting of the Commission.

      7. The decision of the Commission shall be drawn up with a protocol in any form.

      8. Organizations providing non-formal education shall meet the following criteria for their recognition:

      1) the provision of educational services;

      2) availability of material and technical resources necessary for the fulfilment of obligations on the provision of educational services;

      3) availability of qualified specialists necessary for the fulfilment of obligations on the provision of educational services.

      9. For the formation of the List of organizations providing non-formal education, the organizations shall submit the following documents:

      1) an application in any form;

      2) notarized copies of constituent documents. When submitting documents in foreign languages, their notarized translation into Kazakh or Russian languages shall be submitted as well;

      3) notarized documents confirming the availability of their own classrooms or those that are in possession on other legal grounds, as well as the classrooms, equipped with computers connected to the Internet;

      4) availability of agreements with individuals for the provision of educational services.

      10. Documents submitted in accordance with paragraph 9 of these Rules shall be signed by the head of the organization or the legal representative of the organization.

      11. The time allowed for consideration of the documents submitted by the organization for the recognition shall be thirty working days from the date of the adoption of the documents, stipulated by paragraph 9 of these Rules.

      12. Following the results of consideration of the documents, the Commission shall decide:

      on the recognition of the organization and inclusion in the List;

      on refusal.

      13. The authorized body shall take a decision on the recognition of organizations and inclusion in the list by the commission according to the protocol for a period of five years.

      14. Recognition of the organization in the List shall be confirmed once every five years.

      15. Thirty calendar days before the expiration of the term of recognition, for confirmation of powers, the organization shall send to the authorized body in the field of education the documents stipulated by paragraph 9 of these Rules.

      16. The decision to extend the term of recognition of the organization, or to refuse to extend the term of recognition shall be taken by the authorized body.

      17. In the event of reorganization (re-registration), the organization providing non-formal education shall notify the authorized body within thirty business days with the submission of the documents specified in paragraph 9 of the Rules.

      18. The organization shall be excluded from the List when submitting a free-form application for voluntary termination of its activities.

      19. An exclusion of an organization from the List shall be made by a decision of the authorized body in the field of education.

      20. The List shall contain the information about the details, contacts and address of the online resource of the organization.

      21. The List shall be published and constantly updated on the website of the authorized body in the field of education.

      В соответствии с подпунктом 38-4) статьи 5 Закона Республики Казахстан от 27 июля 2007 года "Об образовании" ПРИКАЗЫВАЮ:

      1. Утвердить прилагаемые Правила признания организаций, предоставляющих неформальное образование и формирования перечня признанных организаций, предоставляющих неформальное образование.

      2. Департаменту высшего и послевузовского образования Министерства образования и науки Республики Казахстан в установленном законодательством Республики Казахстан порядке обеспечить:

      1) государственную регистрацию настоящего приказа в Министерстве юстиции Республики Казахстан;

      2) в течение десяти календарных дней со дня государственной регистрации настоящего приказа направление его копии в бумажном и электронном виде на казахском и русском языках в Республиканское государственное предприятие на праве хозяйственного ведения "Республиканский центр правовой информации" для официального опубликования и включения в Эталонный контрольный банк нормативных правовых актов Республики Казахстан;

      3) размещение настоящего приказа на интернет-ресурсе Министерства образования и науки Республики Казахстан после его официального опубликования;

      4) в течение десяти рабочих дней после государственной регистрации настоящего приказа представление в Департамент юридической службы Министерства образования и науки Республики Казахстан сведений об исполнении мероприятий, предусмотренных подпунктами 1), 2) и 3) настоящего пункта.

      3. Контроль за исполнением настоящего приказа возложить на вице-министра образования и науки Республики Казахстан Аймагамбетова А.К.

      4. Настоящий приказ вводится в действие по истечении десяти календарных дней после дня его первого официального опубликования.

Правила признания организаций, предоставляющих неформальное образование, и формирования перечня признанных организаций, предоставляющих неформальное образование

Глава 1. Общие положения

      1. Настоящие Правила (далее - Правила) разработаны в соответствии с подпунктом 38-4) статьи 5 Закона Республики Казахстан от 27 июля 2007 года "Об образовании" и определяют порядок признания организаций, предоставляющих неформальное образование, и формирования перечня признанных организаций, предоставляющих неформальное образование.

      2. В настоящих Правилах используются следующие понятия:

      1) неформальное образование взрослых – вид образования, осуществляемый организациями, которые предоставляют образовательные услуги, оказываемые без учета места, сроков и формы обучения, и сопровождается выдачей документа, подтверждающего результаты обучения;

      2) перечень признанных организаций, предоставляющих неформальное образование (далее – Перечень) – сформированный уполномоченным органом в области образования перечень казахстанских и зарубежных организаций, предоставляющих неформальное образование независимо от форм собственности;

      3) признание организаций, предоставляющих неформальное образование - процедура подтверждения полномочий организаций, оказывающих образовательные услуги по неформальному образованию.

Глава 2. Порядок признания организаций, предоставляющих неформальное образование и формирования перечня признанных организаций, предоставляющих неформальное образование

      3. Для признания организаций, предоставляющих неформальное образование и формирования Перечня уполномоченным органом в сфере образования создается Комиссия (далее - Комиссия).

      4. Комиссия состоит из нечетного количества членов, в состав которой входят руководители структурных подразделений уполномоченных органов и независимые эксперты в области образования.

      5. Из числа членов комиссии большинством голосов избирается председатель комиссии, который руководит деятельностью комиссии, а в случае его отсутствия заместитель председателя.

      Функции секретаря комиссии выполняет специалист уполномоченного органа в сфере образования, не являющийся членом комиссии.

      6. Решение комиссии принимается большинством голосов от общего числа участвующих в заседании комиссии.

      7. Решение комиссии оформляется протоколом в произвольной форме.

      8. При признании организации, предоставляющие неформальное образование, соответствуют следующим критериям:

      1) оказание образовательных услуг;

      2) наличие материально-технических ресурсов необходимых для исполнения обязательств по предоставлению образовательных услуг;

      3) наличие квалифицированных специалистов необходимых для исполнения обязательств по предоставлению образовательных услуг.

      9. Для формирования Перечня организаций, предоставляющих неформальное образование, организации представляют следующие документы:

      1) заявление в произвольной форме;

      2) нотариально засвидетельствованные копии учредительных документов. При представлении документов на иностранных языках, их нотариально засвидетельствованный перевод на казахский или русский языки;

      3) нотариально засвидетельствованные документы, подтверждающие наличие собственных или находящиеся на иных законных основаниях учебные аудитории, а также аудитории, оснащенные компьютерами, подключенными к сети Интернет;

      4) наличие договоров с физическими лицами о предоставлении образовательных услуг.

      10. Документы, представляемые согласно пункту 9 настоящих Правил, подписываются руководителем организации либо законным представителем организации.

      11. Срок рассмотрения документов, представленных организацией для признания, составляет тридцать рабочих дней со дня принятия документов, предусмотренных пунктом 9 настоящих Правил.

      12. По результатам рассмотрения документов Комиссия принимает решение:

      о признании организации и включении в Перечень;

      об отказе.

      13. Уполномоченный орган принимает решение о признании организаций и включении в Перечень согласно протоколу комиссией, сроком на пять лет.

      14. Признание организации в Перечне подтверждается один раз в пять лет.

      15. Организация для подтверждения полномочий за тридцать календарных дней до истечения срока признания направляет в уполномоченный орган в области образования документы, предусмотренные пунктом 9 настоящих Правил.

      16. Решение о продлении срока признания организации, либо об отказе в продлении срока признания принимается уполномоченным органом.

      17. При реорганизации (перерегистрации) организация, предоставляющая неформальное образование, уведомляет уполномоченный орган в течение тридцати рабочих дней с предоставлением документов, указанных в пункте 9 Правил.

      18. Организация исключается из Перечня при предоставлении заявления в произвольной форме о добровольном прекращении деятельности.

      19. Исключение организации из Перечня производится решением уполномоченного органа в области образования.

      20. Перечень содержит информацию о реквизитах, контактах и адрес онлайн-ресурса организации.

      21. Перечень публикуется и постоянно актуализируется на сайте уполномоченного органа в области образования.
