In accordance with the Law of the Republic of Kazakhstan “On Insurance Activities”, the Board of the National Bank of the Republic of Kazakhstan HEREBY RESOLVES:

1. To approve the attached Rules for posting information on the Internet resource of an insurance company, an insurance broker, a branch of an insurance (reinsurance) company-non-resident of the Republic of Kazakhstan, a branch of an insurance broker-non-resident of the Republic of Kazakhstan, an organization that guarantees insurance payments to policyholders (insured, beneficiaries) in case of liquidation of insurance companies, forced termination of activities of branches of insurance (reinsurance) companies-non-residents of the Republic of Kazakhstan, insurance ombudsman, organization for the formation and maintenance of a database.

2. In accordance with the procedure established by the legislation of the Republic of Kazakhstan, the Department for Regulation of Non-Bank Financial Organizations (Kosherbayeva A.M.) shall:

1) Jointly with the Legal Department (Sarsenova N.V.), ensure the state registration of this resolution with the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this resolution, send its copy in paper and electronic form both in the Kazakh and Russian languages to the Republican State Enterprise on the the Right of Economic Management "Republican Center of Legal Information" for official publication and inclusion in the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;

3) place this resolution on the Internet resource of the National Bank of the Republic of Kazakhstan after its official publication;

4) within ten working days after the state registration of this resolution , submit to the Legal Department the information on execution of activities, provided by subparagraph 2), 3) of this paragraph and paragraph 3 of this resolution. .

3. within ten calendar days after the state registration of this resolution, the Consumer Protection Office of Financial Services and External Communications (Terentiyev A.L.) shall send its copy to official publication in the periodic printed publications for official publication.

4. The supervising Deputy Chairman of the National Bank of the Republic of Kazakhstan Zh. B. shall be authorized to oversee the implementation of this resolution. .

5. This resolution shall be enforced from January 1, 2019 and shall be subject to official publication.

1. These Rules for posting information on the Internet resource of an insurance company, an insurance broker, a branch of an insurance (reinsurance) company-non-resident of the Republic of Kazakhstan, a branch of an insurance broker-non-resident of the Republic of Kazakhstan, an organization that guarantees insurance payments to policyholders (insured persons, beneficiaries) in case of liquidation of insurance companies, forced termination of activities of branches of insurance (reinsurance) companies-non-residents of the Republic of Kazakhstan, the insurance ombudsman, the organization for the formation and maintenance of a database (hereinafter - the Rules) have been developed in accordance with the Law of the Republic of Kazakhstan "On Insurance Activities" (hereinafter - the Law) and shall establish the procedure for posting information on the Internet resource of an insurance company, an insurance broker, a branch of an insurance (reinsurance) company-non-resident of the Republic of Kazakhstan, a branch of an insurance broker-non-resident of the Republic of Kazakhstan, an organization that guarantees insurance payments to policyholders (insured, beneficiaries) in case of liquidation of insurance companies, forced termination of activities of branches of insurance (reinsurance) companies-non-residents of the Republic of Kazakhstan, insurance ombudsman, organization for the formation and maintenance of a database (hereinafter – the participants in the insurance market).

2. The purpose of using the Internet resource shall be to promptly provide the participants of an insurance market with information about their activities to policyholders (insured, beneficiaries) and persons who intend to enter into an insurance contract and (or) settle an insured event under an insurance contract.

3. When posting information on an Internet resource, the participants of an insurance market shall ensure:

1) round-the-clock online access of policyholders (insured, beneficiaries) and persons who intend to enter into an insurance contract and (or) settle an insured event under an insurance contract to the Internet resource of an insurance market participant for familiarization and (or) other effective use of the information without restrictions, except in cases of unforeseen technical failures;

2) provision of objective, complete and reliable information on the Internet resource of an insurance market participant;

3) information security to protect information from destruction, modification and blocking of access to it, as well as other unlawful actions concerning such information;

4) the ability to save a document posted in electronic format and copy an arbitrary fragment of text from it onto the technical means of policyholders (insured, beneficiaries) and persons who intend to enter into an insurance contract and (or) settle an insured event under an insurance contract;

5) access to information by sequentially following hyperlinks (indicating the information to which it leads), starting from the main page of the Internet resource.

4. The list of information posted by the participants of the insurance market on the Internet resource shall be determined in accordance with the annex to the Rules.

5. Information on the Internet resource of participants of the insurance market shall be placed both in the Kazakh and Russian languages, as wellas, if necessary, in other languages.

6. All actions performed on the Internet resource of a participant of the insurance market shall be carried out by the responsible official or a person appointed in accordance with the internal documents of the participant of the insurance market.

The participant of the insurance market shall maintain an electronic transaction register carried out using software and technological means, allowing to record all actions of the responsible official or a person appointed in accordance with the internal documents of the insurance market participant, specifying the exact time of its execution.

1. Утвердить прилагаемые Правила размещения информации на интернет-ресурсе страховой организации, страхового брокера, филиала страховой (перестраховочной) организации-нерезидента Республики Казахстан, филиала страхового брокера-нерезидента Республики Казахстан, организации, гарантирующей осуществление страховых выплат страхователям (застрахованным, выгодоприобретателям) в случае ликвидации страховых организаций, принудительного прекращения деятельности филиалов страховых (перестраховочных) организаций-нерезидентов Республики Казахстан, страхового омбудсмана, организации по формированию и ведению базы данных.

2. Департаменту регулирования небанковских финансовых организаций (Кошербаева А.М.) в установленном законодательством Республики Казахстан порядке обеспечить:

1) совместно с Юридическим департаментом (Сарсенова Н.В.) государственную регистрацию настоящего постановления в Министерстве юстиции Республики Казахстан;

2) в течение десяти календарных дней со дня государственной регистрации настоящего постановления его направление на казахском и русском языках в Республиканское государственное предприятие на праве хозяйственного ведения "Республиканский центр правовой информации" для официального опубликования и включения в Эталонный контрольный банк нормативных правовых актов Республики Казахстан;

3) размещение настоящего постановления на официальном интернет-ресурсе Национального Банка Республики Казахстан после его официального опубликования;

4) в течение десяти рабочих дней после государственной регистрации настоящего постановления представление в Юридический департамент сведений об исполнении мероприятий, предусмотренных подпунктами 2), 3) настоящего пункта и пунктом 3 настоящего постановления.

3. Управлению по защите прав потребителей финансовых услуг и внешних коммуникаций (Терентьев А.Л.) обеспечить в течение десяти календарных дней после государственной регистрации настоящего постановления направление его копии на официальное опубликование в периодические печатные издания.

4. Контроль за исполнением настоящего постановления возложить на заместителя Председателя Национального Банка Республики Казахстан Курманова Ж.Б.

5. Настоящее постановление вводится в действие с 1 января 2019 года и подлежит официальному опубликованию.

Правила размещения информации на интернет-ресурсе страховой организации, страхового брокера, филиала страховой (перестраховочной) организации-нерезидента Республики Казахстан, филиала страхового брокера-нерезидента Республики Казахстан, организации, гарантирующей осуществление страховых выплат страхователям (застрахованным, выгодоприобретателям) в случае ликвидации страховых организаций, принудительного прекращения деятельности филиалов страховых (перестраховочных) организаций-нерезидентов Республики Казахстан, страхового омбудсмана, организации по формированию и ведению базы данных

1. Настоящие Правила размещения информации на интернет-ресурсе страховой организации, страхового брокера, филиала страховой (перестраховочной) организации-нерезидента Республики Казахстан, филиала страхового брокера-нерезидента Республики Казахстан, организации, гарантирующей осуществление страховых выплат страхователям (застрахованным, выгодоприобретателям) в случае ликвидации страховых организаций, принудительного прекращения деятельности филиалов страховых (перестраховочных) организаций-нерезидентов Республики Казахстан, страхового омбудсмана, организации по формированию и ведению базы данных (далее – Правила) разработаны в соответствии с Законом Республики Казахстан "О страховой деятельности" (далее – Закон) и устанавливают порядок размещения информации на интернет-ресурсе страховой организации, страхового брокера, филиала страховой (перестраховочной) организации-нерезидента Республики Казахстан, филиала страхового брокера-нерезидента Республики Казахстан, организации, гарантирующей осуществление страховых выплат страхователям (застрахованным, выгодоприобретателям) в случае ликвидации страховых организаций, принудительного прекращения деятельности филиалов страховых (перестраховочных) организаций-нерезидентов Республики Казахстан, страхового омбудсмана, организации по формированию и ведению базы данных (далее – участники страхового рынка).

2. Целью использования интернет-ресурса является оперативное доведение участниками страхового рынка информации о своей деятельности до страхователей (застрахованных, выгодоприобретателей) и лиц, имеющих намерение заключить договор страхования и (или) урегулировать страховой случай по договору страхования.

3. При размещении информации на интернет-ресурсе участники страхового рынка обеспечивают:

1) круглосуточный онлайн-доступ страхователей (застрахованных, выгодоприобретателей) и лиц, имеющих намерение заключить договор страхования и (или) урегулировать страховой случай по договору страхования, к интернет-ресурсу участника страхового рынка в целях ознакомления и (или) иного эффективного использования информации без ограничений, за исключением случаев непредвиденных технических сбоев;

2) предоставление объективной, полной и достоверной информации на интернет-ресурсе участника страхового рынка;

3) информационную безопасность в целях защиты информации от уничтожения, модификации и блокирования доступа к ней, а также иных неправомерных действий в отношении такой информации;

4) возможность сохранения документа, размещенного в электронном формате, и копирования из него произвольного фрагмента текста на технические средства страхователей (застрахованных, выгодоприобретателей) и лиц, имеющих намерение заключить договор страхования и (или) урегулировать страховой случай по договору страхования;

5) доступ к информации путем последовательного перехода по гиперссылкам (с указанием на информацию, к которой она ведет), начиная с главной страницы интернет-ресурса.

4. Перечень информации, размещаемой участниками страхового рынка на интернет ресурсе, определен в соответствии с приложением к Правилам.

5. Информация на интернет-ресурсе участников страхового рынка размещается на казахском и русском языках, а также при необходимости на других языках.

6. Все действия, выполняемые на интернет-ресурсе участника страхового рынка, осуществляются ответственным должностным лицом или лицом, назначенным в соответствии с внутренними документами участника страхового рынка.

Участник страхового рынка ведет электронный журнал учета операций, выполненных с помощью программного обеспечения и технологических средств, позволяющих обеспечивать учет всех действий ответственного должностного лица или лица, назначенного в соответствии с внутренними документами участника страхового рынка, с указанием точного времени их выполнения.
