      In accordance with subparagraph 12) of Article 9 of the Law of the Republic of Kazakhstan dated October 5, 2018 “On standardization”, I ORDER:

      1. To approve the attached Rules for application of international, regional standards and standards of foreign states, classifiers of technical and economic information of international organizations for standardization, classifiers of technical and economic information, rules and recommendations for standardization of regional organizations for standardization, classifiers of technical and economic information, rules, norms and recommendations on standardization of foreign states.

      2. To recognize invalid:

      1) the order No. 491 of the acting Minister of Industry and Technology of the Republic of Kazakhstan dated December 27, 2012 “On approval of the Rules for accounting and application of international, regional standards and standards of foreign states, standards of organizations, classifiers of technical and economic information, rules, norms and recommendations of foreign states on standardization, confirmation of compliance and accreditation on the territory of the Republic of Kazakhstan, except for their use in the standards of organizations” (registered in the Register of the state registration of regulatory legal acts under No. 8302, published on April 24, 2013 in the Kazakhstanskaya Pravda newspaper (No. 143-144 (27417-27418);

      2) paragraph 1 of the list of some orders of the Ministry of Industry and New Technologies of the Republic of Kazakhstan and the Ministry of Investment and Development of the Republic of Kazakhstan on rendering public services, that are amended, approved by the order of the Minister of Investment and Development of the Republic of Kazakhstan dated July 12, 2017 No. 465 (registered in the Register of the state registration of regulatory legal acts under No.15774, published on October 17, 2017 in the Reference Control Bank of regulatory legal acts of the Republic of Kazakhstan).

      3. The Committee for technical regulation and metrology of the Ministry for Investment and Development of the Republic of Kazakhstan, in accordance with the procedure, established by legislation, to ensure:

      1) the state registration of this order at the Ministry of Justice of the Republic of Kazakhstan;

      2) within ten calendar days from the date of the state registration of this order, to send it in the Kazakh and Russian languages to the Republican state enterprise on the basis of the right of economic management "Republican Center for Legal Information" for official publication and inclusion in the Reference Control Bank of regulatory legal acts of the Republic of Kazakhstan;

      3) the placement of this order on the Internet resource of the Ministry for Investment and Development of the Republic of Kazakhstan;

      4) within ten working days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, to submit the information to the Legal Department of the Ministry of Investment and Development of the Republic of Kazakhstan on implementation of measures, in accordance with subparagraphs 1), 2) and 3) of this paragraph.

      4. Supervising vice minister for investment and development of the Republic of Kazakhstan shall be authorized to oversee the implementation of this order.

      5. This order shall come into force on April 11, 2019 and shall be subject to official publication. Настоящий приказ вводится в действие с 11 апреля 2019 года.

economic information, rules and recommendations for standardization regional organizations for standardization,
classifiers of technical and economic information, rules, norms and recommendations for the standardization of foreign countries

Chapter 1. General Provisions

      1. These Rules for the application of international, regional standards (including the coordination, entry into force and cancellation of interstate standards on the territory of the Republic of Kazakhstan) and standards of foreign states, classifiers of technical and economic information of international organizations for standardization, classifiers of technical and economic information, rules and recommendations for standardization of regional organizations for standardization, classifiers of technical and economic information, rules, norms and recommendations for standardization of foreign states (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 12) of Article 9 of the Law of the Republic of Kazakhstan "On Standardization" (hereinafter referred to as the Law) and shall determine the procedure for the application on the territory of the Republic of Kazakhstan of international, regional standards (including the approval, entry into force and cancellation of interstate standards on the territory of the Republic of Kazakhstan) and standards of foreign states, classifiers of technical and economic information of international organizations for standardization, classifiers of technical and economic information, rules and recommendations for standardization of regional organizations for standardization, classifiers of technical and economic information, rules, norms and recommendations for standardization of foreign countries (hereinafter referred to as standardization documents).

      2. The following concepts shall be used in these Rules:

      1) interstate standard - a regional standard adopted by a regional standardization organization - the Interstate Council for Standardization, Metrology and Certification of the Commonwealth of Independent States (hereinafter - IGU);

      2) technical regulation information system - an automated information system designed to store, process, search, distribute, transfer and provide data and information contained in the registers of technical regulation, the state system for ensuring the uniformity of measurements, the national standardization system and unified registers of issued or accepted documents on conformity assessment of the Eurasian Economic Union;

      3) direct application - the use by the subjects of the national standardization system of standardization documents without additional procedures for coordination or accounting by sending a notification to the national standardization body.

      The subjects of the national standardization system are state bodies, as well as individuals and legal entities engaged in activities in the field of standardization.

Chapter 2. The procedure for applying standardization documents

      3. Application of documents on standardization in the territory of the Republic of Kazakhstan shall be carried out in 2 (two) ways:

      1) through the adoption of national and interstate standards in accordance with the Rules for the development, approval, examination, approval, registration, accounting, change, revision, cancellation and entry into force of national standards (except for military national standards), national classifiers of technical and economic information and recommendations on standardization, approved by the order of the Minister for Investment and Development of the Republic of Kazakhstan dated December 26, 2018 No. 918 (registered in the Register of State Registration of Normative Legal Acts under No. 18075);

      2) through direct application.

      4. The application of national standards in accordance with subparagraph 1) of paragraph 3 of these Rules shall be carried out by the confirmation method and the reissue method:

      1) when using the confirmation method, the international, regional standard and standard of a foreign state are given the status of a national standard by publishing an order of the department of the authorized body in the field of standardization on the official Internet resource of the authorized body in the field of standardization and the national standardization body. The designation of the national standard remains unchanged concerning the international, regional and foreign state standards. The confirmation method is used for international, and regional standards and standards of foreign countries in the absence of the need to make editorial changes to them;

      2) when using the method of reprinting based on the text of the international, regional standard and the standard of a foreign state, a national standard shall be developed with the necessary changes made to the content and (or) structure of the standardization document. The reissue method shall be used when it is necessary to make changes to the structure and (or) content of the source of the international, regional standard and the standard of a foreign state, taking into account the peculiarities of national application (bringing into line with the legislation of the Republic of Kazakhstan, adaptation to special geographical, technological, technical and other conditions).

      5. The application of interstate standards in accordance with subparagraph 1) of paragraph 3 of these Rules shall be carried out in accordance with ST RK 1.23 “National Standardization System of the Republic of Kazakhstan. The procedure for carrying out work on interstate standardization in the Republic of Kazakhstan” (hereinafter referred to as ST RK 1.23).

      6. Direct application of standardization documents for internal use within the organization shall be carried out in the original language of the source.

      7. Direct application of standardization documents to demonstrate the fulfilment of the requirements of these documents to third parties shall be carried out in the original language of the primary source with an official translation into Kazakh and (or) Russian.

      8. The subjects of the national standardization system, when directly applying standardization documents, shall check the standardization document for compliance with the requirements of the legislation of the Republic of Kazakhstan.

      In case of non-compliance with the legislation of the Republic of Kazakhstan, the document on standardization in the territory of the Republic of Kazakhstan shall not be applied.

      The user of the standardization document shall notify the national standardization body of the direct application in the technical regulation information system.

      9. Notice of direct application of standardization documents shall contain the following information:

      1) business identification number, name, address, telephone number and email address of the user organization;

      2) designation, name and date of adoption of the standardization document (in the original language, Kazakh and Russian languages);

      3) the purpose of applying the standardization document;

      4) a document confirming the right to use the standardization document (if necessary);

      5) information confirming the compliance of the standardization document with the requirements of the legislation of the Republic of Kazakhstan;

      6) last name, first name and patronymic (if any) of the head of the user organization.

      10. The national body for standardization shall consider the notification within 10 (ten) working days.

      A notification that does not comply with the requirements of paragraph 9 of Chapter 2 of these Rules shall be rejected in the information system of technical regulation.

      11. For the use of standardization documents and (or) their official translations, they shall be purchased from original holders or organizations that have official permission from original holders to distribute (sale) and (or) translate standardization documents on the territory of the Republic of Kazakhstan.

Chapter 3. The procedure for agreeing, putting into effect and cancelling interstate standards on the territory of the Republic of Kazakhstan

      12. Interstate standards (changes to interstate standards) shall undergo the procedure of coordination with the interested subjects of the national standardization system, as a result of which the position of the country is formed and expressed by voting on the Internet resource of the IGU.

      13. The approval procedure shall be carried out by the national standardization body in accordance with ST RK 1.23.

      14. The national standardization body shall publish draft interstate standards received in the manner prescribed by the IGU on the Internet resource of the national standardization body for agreement with the interested subjects of the national standardization system, and send a notice of publication within 7 (seven) working days to state bodies in accordance with the competence in the field of standardization and technical committees for standardization.

      15. From the moment of receipt of the notification, within 30 (thirty) calendar days, state bodies in accordance with the competence in the field of standardization and technical committees for standardization shall submit comments and (or) proposals on draft interstate standards (if any). Based on the results of the received comments and proposals (if any) on draft interstate standards, the national standardization body within 5 (five) working days expresses a position “for” or “against” the IGU Internet resource.

      In the absence of approval by state bodies in accordance with the competence in the field of standardization and technical committees for the standardization of draft interstate standards within 30 (thirty) calendar days from the date of publication on the Internet resource of the national standardization body, the national standardization body expresses the position "abstain" on the Internet resource of the IGU.

      16. If the Republic of Kazakhstan has previously expressed the position “against” or “abstain”, then the national standardization body, at the initiative of the subjects of the national standardization system, subsequently joins the adopted interstate standard by sending a voting ballot with a positive decision to the IGU.

      17. The national standardization body shall carry out the procedure of joining the interstate standards included in the List of international and regional (interstate) standards, and in their absence, national (state) standards, as a result of which, voluntarily, compliance with the requirements of the technical regulation of the Eurasian Economic Union and the List of international and regional (interstate) standards, and in their absence - national (state) standards containing the rules and methods of research (testing) and measurements, including the rules for sampling, necessary for the application and implementation of the requirements of the technical regulation of the Eurasian Economic Union and the assessment of the conformity of objects of technical regulation from the moment of approval of these lists in the manner established by the Eurasian Economic Union, without re-coordination with the subjects of the national systems s standardization.

      18. According to interstate standards affecting the security of standardization objects, the decision to vote shall be made based on the results of mandatory agreements with state bodies in accordance with the competence in the field of standardization.

      19. According to interstate standards that do not affect the safety of standardization objects, the decision to vote shall be made based on the position of the interested subjects of the national standardization system.

      20. Interstate standards adopted by the IGU are put into effect on the territory of the Republic of Kazakhstan by the order of the department of the authorized body in the field of standardization as national standards of the Republic of Kazakhstan.

      Interstate standards shall be mandatory for application if there are indications about this in the legislation of the Republic of Kazakhstan in accordance with paragraph 1 of Article 26 of the Law.

      21. Information about the adopted interstate standards shall be placed in the next issue of the monthly information index and published on the Internet resource of the national standardization body.

      22. Before being put into effect, interstate standards within 30 (thirty) calendar days from the date of receipt of the published version of the interstate standard from the IGU shall be agreed upon through correspondence with the interested subjects of the national standardization system.

      23. According to interstate standards affecting the safety of standardization objects, the decision to put them into effect shall be made based on the results of mandatory coordination with state bodies in accordance with the competence in the field of standardization.

      24. According to interstate standards that do not affect the safety of standardization objects, the decision to put them into operation shall be made on the basis of the position of the interested subjects of the national standardization system.

      25. In the absence of the position of the interested subjects of the national standardization system, the department of the authorized body in the field of standardization shall set the date of entry into force after 6 (six) months from the date of registration with the IGU.

      26. Cancellation of the interstate standard on the territory of the Republic of Kazakhstan shall be carried out by the department of the authorized body in the field of standardization on the basis of proposals from the subjects of the national standardization system in accordance with ST RK 1.23.
