Қазақстан Республикасының Үкіметі ҚАУЛЫ ЕТЕДІ:
1. 2009 жылғы 22 қазанда Анкара қаласында қол қойылған Қазақстан Республикасының Үкіметі мен Түрік Республикасының Үкіметі арасындағы Туризм саласындағы ынтымақтастық туралы келісім бекітілсін.
2. Осы қаулы қол қойылған күнінен бастап қолданысқа енгізіледі.

Бұдан әрі Тараптар деп аталатын Қазақстан Республикасының Үкіметі мен Түрік Республикасының Үкіметі,
туризм саласында тығыз ынтымақтастықты нығайтуға ұмтыла отырып,
туризм екі мемлекет халықтары арасындағы өзара түсіністікті, достық қатынастарды нығайту үшін ғана емес, экономикалық даму үшін де маңызды құрал болып табылатынына сенім білдіре отырып,
төмендегілер туралы келісті:

1-бап

Тараптар осы Келісімнің ережелеріне және Тараптар мемлекеттерінің ұлттық заңнамалары мен Тараптар мемлекеттері қатысушылары болып табылатын халықаралық шарттарға сәйкес туризм саласындағы ынтымақтастықты дамытады,
туризм саласындағы ынтымақтастықты көтермелейді,
өзара туристік сапарларды ұлғайтады,
үшінші елдерден туристер тарту мақсатында бір-біріне қолдау көрсетеді әрі туризм саласындағы мемлекеттік және жеке кәсіпорындардың іс-шаралары үшін өз елдерінде жеңілдіктер беру мүмкіндігін қарастырады.

2-бап

Тараптар туризм маркетингі саласындағы оқу технологияларымен және зерттеулермен, туристік индустрия үшін кадрлар даярлау, іс-шаралар, көрмелер өткізу жөніндегі тәжірибемен, сондай-ақ туристік сала мен туристік қонақ үй бизнесі саласындағы менеджмент тәжірибесімен бюджеттен тыс көздердің есебінен алмасады.

3-бап

Тараптар құрама турлар ұйымдастыру және үшінші елдерде Қазақстан мен және Түркияның туризм саласындағы мүмкіндіктері туралы іс-шаралар өткізу үшін екі елдің агенттіктері арасындағы ынтымақтастықты ынталандырады.

4-бап

Тараптар ақпарат және тәжірибе алмасу мақсатында Ұлттық туризм басқармаларын мынадай мәселелерде ынталандырады және қолдау көрсетеді:
өз елдеріндегі туризм шараларына қатысты заңдар мен ережелер;
туризм саласындағы ақпараттандыру және статистика;
турларды ұйымдастыру;
туристерге қызмет көрсететін басқа туристік кешендердің жұмысын басқару;
туризмді түрлендіру;
жарнама және маркетинг әдістері.

5-бап

Тараптар бастамаларға жәрдемдеседі және осы мақсатта бірін бірі өз елдеріндегі инвестициялық мүмкіндіктер туралы хабардар етеді.

6-бап

Тараптар ақпарат алмасу жолымен кәсіптік білім беру саласындағы мамандардың білімі мен тәжірибесін пайдалана отырып, туризм ұғымын жетілдіру мақсатында туризм саласындағы қызметкерлерді кәсіптік оқыту бағдарламаларын жасау және семинарлар мен конференциялар сияқты іс-шаралар өткізу арқылы ынтымақтастықты нығайтады.

7-бап

Тараптар туризм өнімі ретінде тарихи Жібек жолына қатысты маркетинг жүргізуге жәрдемдеседі және Жібек жолы бойынша халықаралық деңгейде өткізілетін барлық іс-шараларда бір-біріне қолдау көрсетеді.

8-бап

Осы Келісім Тараптар қатысушылары болып табылатын басқа халықаралық келісімдерден туындайтын олардың құқықтары мен міндеттемелерін қозғамайды.

9-бап

Егер әрбір нақты жағдайда өзге тәртіп келісілмеген болса, Тараптар осы Келісімді орындау барысында туындайтын шығыстарды Тараптар мемлекеттерінің ұлттық заңнамаларында көзделген қаражат шегінде өздері дербес көтереді.

10-бап

Осы Келісім дипломатиялық арналар арқылы оның күшіне енуі үшін қажетті мемлекетішілік рәсімдерді Тараптардың орындағаны туралы соңғы жазбаша хабарлама алынған күннен бастап күшіне енеді.
Осы Келісім бес (5) жыл мерзімге жасалады және егер Тараптардың ешқайсысы мерзім аяқталатын күнге дейін алты ай ішінде өзінің осы Келісімнің қолданылуын тоқтату ниеті туралы екінші Тарапқа жазбаша түрде хабарламаса, келесі бес жылдық мерзімге ұзартылады.
1998 жылы 15 маусымдағы Қазақстан Республикасының Үкіметі мен Түрік Республикасының Үкіметі арасындағы Туризм саласындағы ынтымақтастық туралы келісім осы Келісімге қол қойылғаннан кейін күшін жояды.

Осы Келісім 2009 жылғы "___" ______________ қаласында қазақ, түрік және ағылшын тілдерінде екі түпнұсқа данада жасалды әрі барлық мәтіндердің күші бірдей.
Осы Келісімнің ережелерін талқылау кезінде түсініспеушіліктер туындаған жағдайда, Тараптар ағылшын тіліндегі мәтінге жүгінеді.

the Government of the Republic of Kazakhstan hereby RESOLVED as follows:

1. To approve the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Turkey on cooperation in the field of tourism, signed in Ankara on October 22, 2009.

2. This resolution shall be enforced from the date of its signing.

Agreement
between the Government of the Republic of Kazakhstan and the Government of the
Republic of Turkey on cooperation in the field of tourism

The Government of the Republic of Kazakhstan and the Government of the Republic of Turkey, hereinafter referred to as the Parties,

seeking to strengthen close cooperation in the field of tourism;

expressing confidence that tourism shall be an instrument not only for strengthening mutual understanding and friendly relations between the peoples of the two states, but also an important tool for economic development,

hereby agreed as follows:

Article 1

The Parties shall develop cooperation in the field of tourism in accordance with the provisions of this Agreement and national legislation of the member states and international treaties to which the member states being Parties, shall:

stimulate cooperation in the field of tourism,

increase mutual tourist trip,

in order to attract tourists from third countries, support each other and consider the possibility of benefits for activities of state and individual enterprises in the field of tourism in their countries.

Article 2

The Parties shall exchange educational technologies and research in the field of tourism marketing, experience in training personnel for the tourism industry, holding events, exhibitions, as well as management experience in the tourism industry and the tourism hotel industry at the expense of extra-budgetary sources.

Article 3

The Parties shall stimulate cooperation between the agencies of the two countries to organize all-tours and hold various events in third countries on the opportunities of Kazakhstan and Turkey in the field of tourism.

Article 4

The Parties shall, in order to exchange information and experience, encourage and support the National Tourism offices in the following issues:

laws and rules on tourism measures in their countries;

informatization and tourism statistics;

organization of tours;

management of other tourist complexes providing services to tourists;

variety of types of tourism;

advertising and marketing techniques.

Article 5

The Parties shall promote investment and, to that end, inform each other of the investment opportunities of their countries.

Article 6

The Parties, using the knowledge and experience of specialists in the field of vocational education through the exchange of information, to improve the concept of tourism, strengthen cooperation through the development of training programs for employees in the field of tourism and holding of events such as seminars and conferences.

Article 7

The Parties shall promote marketing regarding the historic Silk Road as a product of tourism and shall support each other in all Silk Road activities held at the international level.

Article 8

This Agreement shall not affect the rights and obligations of the Parties arising from other international treaties to which being parties.

Article 9

The Parties shall bear the expenses which arise in the course of their implementation of this Agreement, within the limits provided by the national legislation of the member states, unless otherwise agreed in each case.

Article 10

This Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification of the implementation by the Parties of the domestic procedures necessary for its entry into force.

This Agreement shall be concluded for a period of five (5) years and shall be extended for a further period of five years unless, within six months prior to the expiration of the Agreement, either Party notifies the other Party in writing of its intention to terminate this Agreement.

The Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Turkey on cooperation in the field of tourism dated June 15, 1998 shall be recognized as invalid after the signing of this Agreement.

Done in ___________ "___" _________ 2009 in two original copies, each in Kazakh, Turkish and English, all texts being authentic.

In case of disagreement in the interpretation of the provisions of this Agreement, the Parties shall refer to the English text.
