Қазақстан Республикасының Үкіметі ҚАУЛЫ ЕТЕДІ:

1. Қоса беріліп отырған 2015 жылғы 12 қазанда Астанада жасалған Қазақстан Республикасының Үкіметі мен Қытай Халық Республикасының Үкіметі арасындағы Қазақстан Республикасының Қарулы Күштеріне өтеусіз негізде техникалық көмек (жәрдем) көрсету туралы келісім бекітілсін.

2. Осы қаулы қол қойылған күнінен бастап қолданысқа енгізіледі.

Бұдан әрі Тараптар деп аталатын Қазақстан Республикасының Үкіметі мен Қытай Халық Республикасының Үкіметі

екі мемлекет арасындағы достық қарым-қатынастарды одан әрі дамыту және олардың қарулы күштері арасындағы әскери ынтымақтастықты нығайту мақсатында

төмендегілер туралы келісті:

1-бап

Қытай тарапы Қазақстан Республикасының Қарулы Күштерін жарақтандыруда техникалық көмек (жәрдем) ретінде жалпы сомасы 30 миллион юань мүлікті өтеусіз негізде Қазақстан тарапының меншігіне береді, оның тізбесі осы Келісімнің ажырамас бөлігі болып табылатын қосымшада көрсетілген.

2-бап

Қытай тарапы мүлікті Алашанькоу шекара пунктіне жеткізеді, онда Тараптардың уәкілетті органдарының өкілдері арасында тиісті актіге қол қойылып, оны қабылдау-беру жүзеге асырылатын болады.

Алашанькоу шекара пунктіне дейін мүлікті жеткізуге байланысты барлық шығыстарды Қытай тарапы көтереді, ал мүлікті Қазақстан Республикасының аумағы арқылы тасымалдауға байланысты одан кейінгі шығыстарды Қазақстан тарапы көтереді.

3-бап

Қазақстан тарапы осы Келісім шеңберінде Қазақстан Республикасының аумағына әкелінетін мүлікті лицензиялау, кедендік декларациялау ресімдерін жүргізуді жүзеге асырады, ол Қазақстан Республикасының заңнамасына және (немесе) Еуразиялық экономикалық одақтың құқығын құрайтын кедендік құқықтық қатынастарды реттейтін халықаралық шарттар мен актілерге сәйкес кедендік төлемдер мен қосылған құн салықтарын төлеуден босатады.

4-бап

Осы Келісімді іске асыру жөніндегі уәкілетті органдар:

Қазақстан тарапынан – Қазақстан Республикасы Қорғаныс министрлігі;

Қытай тарапынан – Қытай Халық Республикасы Қорғаныс министрлігі болып табылады.

5-бап

Осы Келісімге Тараптардың өзара келісуі бойынша жекелеген хаттамалармен ресімделетін және оның ажырамас бөліктері болып табылатын өзгерістер мен толықтырулар енгізілуі мүмкін.

6-бап

Осы Келісімді түсіндіру немесе қолдану бойынша даулар туындаған жағдайда Тараптар оларды келіссөздер немесе консультациялар жолымен шешеді.

7-бап

Осы Келісім Тараптардың оның күшіне енуі үшін қажетті мемлекетішілік рәсімдерді орындағаны туралы жазбаша хабарламаны дипломатиялық арналар арқылы алынған күннен бастап күшіне енеді және осы Келісімнің 2-бабында көрсетілген мүлікті қабылдау-беру актісіне қол қойылған күннен бастап өз қолданысын тоқтатады.

2015 жылғы 12 қазанда Астана қаласында әрқайсысы қазақ, қытай және орыс тілдерінде екі данада жасалды әрі барлық мәтіндердің күші бірдей.

The Government of the Republic of Kazakhstan HEREBY DECREES:

1. To approve the attached Agreement between the Government of the Republic of Kazakhstan and the People’s Republic of China on rendering free of charge technical support (assistance) to the Armed Forces of the Republic of Kazakhstan, made in Astana, on October 12, 2015.

2. This decree shall be put into effect upon the date of signing.

Agreement
between the Government of the Republic of Kazakhstan and the People’s Republic of China
on rendering free of charge technical support (assistance) to the Armed Forces
of the Republic of Kazakhstan

The Government of the Republic of Kazakhstan and the Government of the People’s Republic of China, hereinafter referred to as the Parties,

For the purposes of further development of friendly relations between two states and strengthening of military cooperation between their armed forces,

Have agreed as follows:

Article 1

The Chinese Party in capacity of technical support (assistance) in equipping the Armed Forces of the Republic of Kazakhstan on a free of charge basis shall transfer to the ownership of the Kazakhstani Party the property to the total amount of 30 million CNY, the list of which is specified in the annex, which is an integral part of this Agreement.

Article 2

The Chinese Party shall deliver the property to Alashankou border point, where the acceptance-transfer thereof will be performed with signing of the corresponding act between the representatives of the authorized bodies of the Parties.

All costs, associated with the delivery of the property to Alashankou border point, shall be borne by the Chinese Party, and the subsequent costs, associated with transportation of the property in the territory of the Republic of Kazakhstan, shall be borne by the Kazakhstani Party.

Article 3

The Kazakhstani Party shall perform the procedures of licensing, customs declaration of the property, imported to the territory of the Republic of Kazakhstan under this Agreement, which, in accordance with the legislation of the Republic of Kazakhstan and (or) international treaties and acts regulating customs legal relations, constituting the law of the Eurasian Economic Union, shall be released from payment of customs fees and value-added taxes.

Article 4

The authorized bodies for implementation of this Agreement shall be:

On behalf of the Kazakhstani Party – Ministry of Defense of the Republic of Kazakhstan;

On behalf of the Chinese Party – Ministry of Defense of the People’s Republic of China.

Article 5

By mutual consent of the Parties, this Agreement may be amended and supplemented by separate protocols and shall be its integral parts.

Article 6

In the event of disputes arising from the interpretation or application of this Agreement, the Parties shall resolve them by negotiation or consultation.

Article 7

This Agreement shall come into force upon the date of receipt by means of diplomatic channels of a written notice on performance by the Parties of the internal state procedures, required for its entry into force and shall be terminated from the date of signing an act on acceptance-transfer of property, specified in article 2 of this Agrement.

Made in Astana, on October 12, 2015 in two copies, each in Kazakh, Chinese and Russian languages, where all texts shall have equal force.
