"Сауда мақсатында теңізде жүзу туралы" 2002 жылғы 17 қаңтардағы Қазақстан Республикасының Заңы 212-бабының 6-1-тармағына сәйкес БҰЙЫРАМЫН:

1. Қоса беріліп отырған Кеменің немесе жасалып жатқан кеменің ипотекасын мемлекеттік тіркеу туралы ақпарат беру қағидалары бекiтiлсiн.

2. Қазақстан Республикасы Инвестициялар және даму министрлігінің Көлік комитеті (Ә.А. Асавбаев):

1) осы бұйрықтың Қазақстан Республикасы Әділет министрлігінде мемлекеттік тіркелуін;

2) осы бұйрықтың көшірмелерін Қазақстан Республикасы Әділет министрлігінде мемлекеттік тіркелген күннен бастап күнтізбелік он күн ішінде қағаз және электрондық түрде мерзімді баспа басылымдарында және "Әділет" ақпараттық-құқықтық жүйесінде ресми жариялауға, сондай-ақ Қазақстан Республикасы нормативтік құқықтық актілерінің эталондық бақылау банкіне жіберуді;

3) осы бұйрықтың Қазақстан Республикасы Инвестициялар және даму министрлігінің интернет-ресурсында орналастырылуын;

4) осы бұйрық Қазақстан Республикасы Әдiлет министрлiгiнде мемлекеттiк тiркелгеннен кейiн он жұмыс күні iшiнде осы тармақтың 1), 2) және 3) тармақшаларында көзделген іс-шаралардың орындалуы туралы мәлiметтердi Қазақстан Республикасы Инвестициялар және даму министрлiгiнiң Заң департаментiне ұсынуды қамтамасыз етсiн.

3. Осы бұйрықтың орындалуын бақылау жетекшілік ететін Қазақстан Республикасының Инвестициялар және даму вице-министріне жүктелсін.

4. Осы бұйрық алғашқы ресми жарияланған күнінен кейін күнтізбелік он күн өткен соң қолданысқа енгізіледі.

1-Тарау. Жалпы ережелер

1. Осы Кеменің немесе жасалып жатқан кеменiң ипотекасын мемлекеттік тiркеу туралы ақпарат беру қағидалары "Сауда мақсатында теңiзде жүзу туралы" 2002 жылғы 17 қаңтардағы Қазақстан Республикасының Заңы 212-бабының 6-1-тармағына сәйкес әзiрлендi және кеменің немесе жасалып жатқан кеменің ипотекасын мемлекеттiк тiркеу туралы ақпарат беру тәртiбiн айқындайды.

2. Кеменің немесе жасалып жатқан кеменiң ипотекасын мемлекеттік тiркеу уәкілетті органның аумақтық органдары (бұдан әрi – тiркеушi орган) осы кеме тiркелген мемлекеттік кемелер тiзiлiмiне, кеме кітабына және жасалып жатқан кемелер тізіліміне (бұдан әрі – кемелер тізілімі) тиiстi жазбаны енгiзу жолымен жүзеге асырады.

2-Тарау. Кеменiң немесе жасалып жатқан кеменiң
ипотекасын тiркеу туралы ақпарат беру тәртiбi

3. Заңды немесе жеке тұлғаның еркін нысандағы өтініші бойынша тіркеуші орган кемелер тізілімінен үзінді көшірме немесе көшірме нысанында ақпарат береді. Бұл ретте үзінді көшірме:

1) ипотека туралы мәлiметтер үзiндi көшiрме берiлген күннің алдындағы жұмыс күнiнiң аяғында берiлгенiне сiлтеменi;

2) тiркеушi органның мөрiмен куәландырылған тiркеушi органның уәкілеттi лауазымды тұлғасы қол қойылуын қамтиды.

Ақпарат беру мерзімі өтініш берілген сәттен бастап екі жұмыс күні ішінде беріледі.

4. Кеменің немесе жасалып жатқан кеменiң ипотекасын мемлекеттік тiркеу туралы ақпарат өтеусiз берiледi.

5. Кеменің немесе жасалып жатқан кеменің ипотекасын мемлекеттік тiркеу туралы мәлiметтер барлық заңды және жеке тұлғалар үшiн ашық болып табылады.

6. Сол немесе өзге кемеге немесе жасалып жатқан кемеге қатысты ипотека туралы қандай да бiр жазбалар болмаған жағдайда үзiндi көшiрмеде осыған тиiстi сiлтеме болуы тиiс.

On approval of the Rules for the Provision of Information on State Registration of a Vessel Mortgage or a Vessel under Construction

In accordance with paragraph 6-1 of Article 212 of the Law of the Republic of Kazakhstan dated January 17, 2002 "On Merchant Shipping" I HEREBY ORDER:

1. That the attached Rules for the Provision of Information on State Registration of a Vessel Mortgage or a Vessel under Construction shall be approved.

2. The Transport Committee of the Ministry for Investments and Development of the Republic of Kazakhstan (A. A. Assavbayev ) shall:

1) ensure state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) send a copy hereof in paper and electronic form for the publication in the print media and Adilet, the legal information system, as well as to the reference control bank of regulatory legal acts of the Republic of Kazakhstan within ten calendar days from the date of state registration with the Ministry of Justice of the Republic of Kazakhstan;

3) place this order on the Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten business days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry for Investments and Development of the Republic of Kazakhstan the information on the implementation of measures provided for in subparagraphs 1), 2) and 3) of this paragraph.

3. The control over the execution of this order shall be assigned to the supervising Vice Minister for Investments and Development of the Republic of Kazakhstan.

4. This order shall become effective upon expiration of ten calendar days after the day of its first official publication.

Rules for the
Provision of Information on State Registration of a Vessel Mortgage or a Vessel under Construction
Chapter 1. General provisions

1. These Rules for the
Provision of Information on State Registration of a Vessel Mortgage or a Vessel under Construction are developed in accordance with Paragraph 6-1 of Article 212 of the Law of the Republic of Kazakhstan dated January 17, 2002 "On Merchant Shipping" and determine the procedure for providing information on the state registration of the mortgage of the vessel or the vessel under construction.

2. State registration of a vessel mortgage or a vessel under construction shall be carried out by the territorial divisions of the authorized body (hereinafter referred to as the territorial division) by making an appropriate entry in the state ship registry of sea vessels, the ship book and the register of vessels under construction (hereinafter - the register of vessels) in which this vessel shall be registered.

Chapter 2. The procedure for providing information on state
registration of a vessel mortgage or a vessel under construction

3. Upon the request of an individual or legal entity in any form, the territorial division shall provide information in the form of an extract or a copy from the register of vessels. In this case, the extract shall contain:

1) indications that the information on the mortgage is presented at the end of the business day preceding the day the statement was issued;

2) the signature of the authorized official of the territorial division, certified by the seal of the territorial division.

The deadline for providing information shall be two business days from the date of application.

4. The information on state registration of a vessel mortgage or a vessel under construction shall be provided free of charge.

5. The information on the state registration of a vessel mortgage or a vessel under construction shall be open to all individuals and legal entities.

6. In the absence of any records on the mortgage in relation to a vessel or a vessel under construction, the extract shall contain an appropriate indication of this.
