"Теміржол көлігі туралы" 2001 жылғы 8 желтоқсандағы Қазақстан Республикасы Заңының 14-бабы 2-тармағының 34-36) тармақшасына сәйкес БҰЙЫРАМЫН:

1. Қоса беріліп отырған Кірме жолдар мен жанасу станциялары жұмысының бірыңғай технологиялық процестерін әзірлеу қағидалары бекітілсін.

2. Қазақстан Республикасы Индустрия және инфрақұрылымдық даму министрлігінің Көлік комитеті заңнамада белгіленген тәртіппен:

1) осы бұйрықты Қазақстан Республикасы Әділет министрлігінде мемлекеттік тіркеуді;

2) осы бұйрық мемлекеттік тіркелген күнінен бастап күнтізбелік он күн ішінде қазақ және орыс тілдерінде Қазақстан Республикасы Нормативтік құқықтық актілерінің эталондық бақылау банкіне ресми жариялау және енгізу үшін "Қазақстан Республикасының Заңнама және құқықтық ақпарат институты" шаруашылық жүргізу құқығындағы республикалық мемлекеттік кәсіпорнына жіберуді;

3) осы бұйрықты Қазақстан Республикасы Индустрия және инфрақұрылымдық даму министрлігінің интернет-ресурсында орналастыруды қамтамасыз етсін.

3. Осы бұйрықтың орындалуын бақылау жетекшілік ететін Қазақстан Республикасының Индустрия және инфрақұрылымдық даму вице-министріне жүктелсін.

4. Осы бұйрық алғашқы ресми жарияланған күнінен кейін күнтізбелік он күн өткен соң қолданысқа енгізіледі.

Кірме жолдар мен жанасу станциялары жұмысының бірыңғай технологиялық процестерін әзірлеу қағидалары

1-тарау. Жалпы ережелер

1. Осы кірме жолдар мен жанасу станциялары жұмысының бірыңғай технологиялық процестерін әзірлеу қағидалары (бұдан әрі – Қағидалар) "Темір жол көлігі туралы" 2001 жылғы 8 желтоқсандағы Қазақстан Республикасы Заңының (бұдан әрі – Заң) 14-бабы 2-тармағының 34-36) тармақшасына сәйкес әзірленді және кірме жолдар мен жанасу станциялары жұмысының бірыңғай технологиялық процестерін (бұдан әрі – бірыңғай технологиялық процесс) әзірлеу тәртібін айқындайды.

2. Бірыңғай технологиялық процестерді әзірлеу 50 (елу) вагон және одан да көп орташа тәуліктік жүк айналымы бар меншікті локомотивтермен қызмет көрсетілетін ұйымдардың кірме жолдарының келісілген, техникалық-технологиялық жұмысын қамтамасыз ету үшін жүзеге асырылады.

3. Бірыңғай технологиялық процесс деп вагондарды беру – әкету шартын жасасу үшін қажетті кірме жол мен жанасу станциясының өзара іс-қимыл шарттарын регламенттейтін құжат (еркін нысанда) түсініледі.

2-тарау. Кірме жолдар мен жанасу станциялары жұмысының бірыңғай технологиялық процестерін әзірлеу тәртібі

4. Бірыңғай технологиялық процесс Қазақстан Республикасының азаматтық заңнамасына, Қазақстан Республикасының темір жол көлігі туралы заңнамасына және халықаралық келісімдерге (шарттарға) сәйкес жасалатын шарттар негізінде тасымалдау процесіне қатысушылардың өзара іс-қимылы арқылы әзірленеді.

5. Бірыңғай технологиялық процестің мазмұны дұрыс және бір мәнді түсіндіреді.

6. Әзірленетін бірыңғай технологиялық процестердің біркелкілігін қамтамасыз ету үшін мынадай ақпаратты қамтиды:

1) кірме жолдар мен жанасу станциясының құрылыстары мен құрылғыларының техникалық және пайдалану сипаттамасы;

2) өндірістің жоспарлы – төмендетілетін көлемдері бар кәсіпорындардан басқа, жүктерді тасымалдаудың нақты және ең жоғары жоспарлы (алдағы үш жылдан) көлеміне сүйене отырып есептелген жүк және вагон ағындарының мөлшері;

3) маневрлік жұмысты ұйымдастыру және техникалық операцияларды орындауға арналған нормаларды есептеу;

4) кірме жолдың және жанасу станциясының техникалық құралдарын, құрылыстары мен құрылғыларын кооперациялық пайдалануды жүзеге асыру;

5) вагондарды беру-жинауды ұйымдастыру;

6) вагондарды, берілістер мен поездарды өңдеу кестелері;

7) технологиялық тасымалдау кестелері;

8) станция мен кірме жол жұмысының тәуліктік жоспар-кестесі;

9) жүк операцияларын орындауға арналған технологиялық уақыт;

кірме жолдағы вагондар айналымының технологиялық мерзімдерін есептеу;

11) станция мен кірме жолда жүк және коммерциялық жұмысты жедел жоспарлау, басшылық ету және ұйымдастыру тәртібі;

12) қысқы жағдайларда жұмысты қамтамасыз ету жөніндегі іс-шаралар;

13) вагон паркін сақтау жөніндегі шаралар;

14) орындалатын жұмысты бақылау мен талдауды жүзеге асыру жөніндегі іс-шаралар;

15) есептік бөлім, қосымшалар;

16) кірме жолдар мен жанасу станцияларының жұмысына байланысты мәліметтер.

7. Бірыңғай технологиялық процестерді әзірлеуді және оларды келісуді жүзеге асыратын Комиссияның құрамы Заңның 14-бабы 2-тармағының 34-33) тармақшасына сәйкес бекітілетін теміржол көлігімен жүктерді тасымалдау қағидаларында айқындалады.

8. Бірыңғай технологиялық процестерді әзірлеу ерекшеліктерін кірме жолда және жанасу станциясында пайдаланылатын технологиялық құралдарды, құрылыстар мен құрылғыларды, жыл мезгілдерін, жергілікті жердің ауа райы жағдайларын және кірме жолдар мен жанасу станцияларының жұмысына әсер ететін өзге де факторларды негізге ала отырып, бірыңғай технологиялық процестерді дайындауды жүзеге асыратын комиссия белгілейді.

9. Қысқы жағдайларда кірме жолдың үздіксіз жұмысы көлік шаруашылығын дайындаудың уақтылығы мен сапасына, технологиялық және техникалық шараларды жүргізуге байланысты.

10. Бірыңғай технологиялық процесті әзірлеу кезінде айлар бойынша бөле отырып, өткен жылғы жүктердің нақты келуі және жөнелтілуі, вагондарға және тонналарға тиеу және түсіру туралы деректерді, вагондардың меншік иелеріне (тиесілілігіне), жүктің атауын, жылжымалы құрамның типін есепке алу қажет.

11. Станцияның және кірме жолдың барлық техникалық құралдарын, құрылыстары мен құрылғыларын ұтымды пайдалануды қамтамасыз ететін және кірме жолдағы вагондар айналымының технологиялық мерзімін айқындайтын тәуліктік жоспар-кесте (еркін нысанда) бірыңғай технологиялық процесті жасауды аяқтайтын қорытынды құжат болып табылады.

12. Бірыңғай технологиялық процесс бірыңғай технологиялық процестерді әзірлеуге жұмылдырылған тасымалдау процесіне қатысушылардың жұмыс технологиясы өзгерген жағдайларда түзетіледі.

Вагондарды беру-әкету шартының мерзімі өткен кезде бірыңғай технологиялық процесс қайта жасалады немесе бірыңғай технологиялық процестерді әзірлеуді жүзеге асыратын Комиссияның шешімі бойынша ұзартылады.

In accordance with sub-clause 34-36) of clause 2 of article 14 of the Law of the Republic of Kazakhstan dated December 8, 2001 "On Railway Transport" I HEREBY ORDER:

1. To approve the attached Rules for the development of unified technological processes for operation of access roads and connecting stations.

2. The Transport Committee of the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan in accordance with the procedure established by the law shall ensure:

1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order, its direction in Kazakh and Russian languages to the Republican State Enterprise on the right of economic management “Institute of Legislation and Legal Information of the Republic of Kazakhstan” of the Ministry of Justice of the Republic of Kazakhstan for official publication and placement in the Reference Control Bank of the Regulatory Legal Acts of the Republic of Kazakhstan;

3) Posting this order on the Internet resource of the Ministry of Industry and Infrastructural Development of the Republic of Kazakhstan.

3. Control over execution of this order shall be entrusted to the supervising vice-minister of Industry and Infrastructural Development of the Republic of Kazakhstan.

4. This order shall come into force upon expiry of ten calendar days from the date of its official publication.

Rules for the development of unified technological processes for operation
of access roads and connecting stations

Chapter 1. General provisions

1. These Rules for the development of unified technological processes for operation of access roads and connecting stations (hereinafter referred to as the Правила) have been developed in accordance with sub-clause 34-36) of clause 2 of article 14 of the Law of the Republic of Kazakhstan dated December 8, 2001 "On Railway Transport " (hereinafter referred to as the Law) and shall determine the procedure for development of unified technological processes for operation of access roads and connecting station (hereinafter referred to as the unified technological process).

2. Development of the unified technological processes shall be carried out to ensure coordinated, technical and technological work of access roads of organizations serviced by their own locomotives with an average daily freight turnover of 50 (fifty) cars and above.

3. The unified technological process is a document (in a free form) regulating the conditions for interaction of an access road and an connecting station, required for conclusion of an agreement for spotting - picking of cars.

Chapter 2. Procedure for the development of unified technological processes for operation
of access roads and connecting stations

4. The unified technological process shall be developed through interaction of participants of transportation process based on the concluded agreements in accordance with the civil legislation of the Republic of Kazakhstan, legislation of the Republic of Kazakhstan on rail transport and international agreements (treaties).

5. The unified technological process shall contain a clear meaning not subject not divergent interpretation.

6. To ensure uniformity in development of the unified technological processes, it shall include the following information:

1) technical and operational characteristics of structures and devices of access roads and connecting stations;

2) the size of freight and car flows calculated on the basis of the actual and maximum planned (from the next three years) volume of cargo transportation, except for enterprises with planned - decreasing production volumes;

3) arrangement of shunting operations and calculation of norms for performance of technical operations;

4) the implementation of the cooperated use of technical means, structures and devices of the access road and the connecting station;

5) arrangement of spotting-picking of cars;

6) schedules for cars handling, transfer and trains;

7) schedules for technological transportation;

8) daily schedule of the station and the access road;

9) technological time for cargo operations;

10) calculation of technological terms for turnover of cars on the access road;

11) the procedure for operational planning, management and organization of freight and commercial work at the station and access road;

12) measures to ensure work in winter conditions;

13) measures for the safety of the rolling stock;

14) activities for monitoring and analysis of work performed;

15) calculation part, applications;

16) information related to the operation of access roads and connecting stations.

7. The composition of the commission carrying out the development of the unified technological processes and their coordination shall be determined by the Rules for cargo transportation by rail transport in accordance with sub-clause 34-33) of clause 2 of article 14 of the Law.

8. The peculiar features of the unified technological processes shall be established by the commission preparing the the unified technological processes based on the technological means, structures and devices used on the access road and the connecting station, season, weather conditions and other factors affecting the operation of access roads and connecting stations.

9. Uninterrupted operation of the access road in winter conditions depends on the timeliness and quality of preparation of the transport sector, the implementation of technological and technical measures.

In preparation for the winter period, features are provided for the organization of the reception and departure of trains, shunting operation, spotting-picking of cars, including the conditions for the use of preventive measures when loading and unloading freezable goods.

10. When developing a unified technological process, it is necessary to take into account data on the actual arrival and departure of goods, loading and unloading (unloading) in the rolling stock and tons for the previous year, divided by months, owners (ownership) of cars, name of cargo, type of rolling stock.

11. The result of the development of a unified technological process shall be a daily schedule (in any form) that ensures the rational use of all technical equipment, structures and devices of the station and the access road and determines the technological period for the turnover of cars on the access road.

12. The unified technological process shall be adjusted in cases of changes in the technology of work of the transportation process participants involved in the development of the unified technological processes.

Upon the expiration of the contract for the supply and cleaning of cars, the unified technological process shall be drawn up again or, by decision of the commission carrying out the development of the unified technological processes, shall be extended.
