      The Government of the Republic of Kazakhstan hereby DECREES AS FOLLOWS:

      1. That the attached Agreement between the Government of the Republic of Kazakhstan and the Government of the Hellenic Republic on the abolition of visa requirements for holders of diplomatic passports, executed in the city of Athens on October 16, 2012 shall be approved.

      2. This Decree shall become effective from the date of signing.

Agreement
between the Government of the Republic of Kazakhstan
and the Government of the Hellenic Republic
on the abolition of visa requirements for holders of
diplomatic passports

      The Government of the Republic of Kazakhstan and the Government of the Hellenic Republic, hereinafter referred to as the "Parties",

      desiring to step up their bilateral relationship,

      considering their interest in strengthening existing friendly relations and in order to facilitate the travel of citizens of the states of one Party, owners of valid diplomatic passports, to the territory of the state of the other Party,

      have agreed as follows:

Article 1

      1. Citizens of the Republic of Kazakhstan, holders of valid diplomatic passports who are not assigned to diplomatic missions or consular offices of the Republic of Kazakhstan, accredited in the Hellenic Republic, who are not representatives of the Republic of Kazakhstan to international organizations located in the Hellenic Republic, shall be exempted from the need to obtain visas for entry, transit, stay and leave from the territory of the Hellenic Republic for up to ninety (90) calendar days (in one or more periods) within six (6) months from the date of first entry into the Schengen area.

      2. Citizens of the Hellenic Republic, holders of valid diplomatic passports who are not appointed to diplomatic missions or consular offices of the Hellenic Republic, accredited in the Republic of Kazakhstan, who are not representatives of the Hellenic Republic to international organizations located in the territory of the Republic of Kazakhstan, shall be exempted from the need to obtain visas for entry, transit, stay and departure from the territory of the Republic of Kazakhstan for a period of up to ninety (90) calendar days (in one or more of periods) within six (6) months beginning from the date of arrival.

      3. It shall be prohibited to carry out paid activities by citizens of the states of the Parties referred to in paragraphs 1 and 2 of this article, requiring a work permit in accordance with the national laws of the states of the Parties.

Article 2

      1. This Agreement shall not exempt citizens of the state of any of the Parties who hold valid diplomatic passports who are appointed to the diplomatic mission or consular offices of the state of that Party, accredited in the territory of the state of the other Party, or representatives of this Party to international organizations located in the territory and state of the other Party, from the obligation to obtain a visa for accreditation of the host state prior to their arrival.

      2. This Agreement shall not exempt family members of the persons referred to in paragraph 1 of this article from holders of valid diplomatic passports from the obligation to obtain a visa from the host state before their arrival.

Article 3

      Persons referred to in Articles 1 and 2 of this Agreement may enter, transit, and leave the territory of the state of the other Party at all border checkpoints open for international passenger traffic.

Article 4

      This Agreement shall not affect the obligation of the persons referred to in Articles 1 and 2 of this Agreement to respect the laws of the host state.

Article 5

      This Agreement shall not affect the right of the competent authorities of the state of any of the Parties to refuse entry or to prohibit the stay of persons declared undesirable, or who do not meet the current conditions of entry and residence in the territories of their states.

Article 6

      1. Any of Parties may suspend in whole or in part this Agreement for reasons of national security, public order or public health.

      2. The other Party shall be notified in writing of the suspension and validity of this Agreement through diplomatic channels no later than fifteen (15) calendar days prior to the effective date of such measures.

      3. The suspension of the implementation of this Agreement shall not affect the rights of citizens of the state of any of the Parties referred to in Articles 1 and 2 of this Agreement, already located on the territory of the state of the other Party.

      4. The Party that has suspended this Agreement shall notify the other Party in writing through diplomatic channels of the cancellation of the suspension of this Agreement no later than: seventy-two (72) hours prior to the entry into force of such measures.

Article 7

      1. The Parties shall exchange their standard diplomatic passports through diplomatic channels, within thirty (30) calendar days from the date of entry into force of this Agreement.

      2. In the event that one of the Parties amends diplomatic passports or introduces new diplomatic passports, such Party shall notify the other Party in writing through diplomatic channels by sending samples of new passports thirty (30) calendar days before their entry into force. The Parties shall apply the standards for machine-readable travel documents recommended by the International Civil Aviation Organization (ICAO).

      3. The parties shall immediately notify each other of any changes in the national legislation of their states regarding the issuance of diplomatic passports.

      4. The parties shall immediately notify each other through diplomatic channels of cases of loss, theft or cancellation of diplomatic passports of citizens of the states of the Parties.

Article 8

      The Parties shall agree to conclude, upon the request of one of the Parties, a bilateral agreement governing specific readmission obligations, including readmission obligations of third-country citizens and stateless persons who arrived in the territory of its state from the territory of the state of the other Party.

Article 9

      By mutual written consent of the Parties, this Agreement may be amended. Any changes shall enter into force in accordance with the procedure provided for in Article 11 for the entry into force of this Agreement.

Article 10

      Any disagreement regarding the interpretation or application of this Agreement shall be resolved between the Parties through diplomatic channels.

Article 11

      This Agreement shall enter into force thirty (30) calendar days from the date of receipt through diplomatic channels of the last written notification on the fulfilment by the Parties of internal procedures necessary for its entry into force.

      This Agreement shall remain in force until the expiration of three (3) months from the date of receipt by one of the Parties through diplomatic channels of a written notification to the other Party of its intention to terminate this Agreement.

      This Agreement is executed in Athens, on October 16, 2012, in duplicate, in the Kazakh, Greek and English languages, all texts being equally authentic. In case of differences of interpretation, the Parties shall refer to the text in English.
