The Government of the Republic of Kazakhstan HEREBY DECREES:
1. To approve the attached Agreement in the form of an exchange of notes between the Government of the Republic of Kazakhstan and the Government of the Federal Republic of Brazil on visa-free trips for citizens of the Republic of Kazakhstan and the Federal Republic of Brazil, executed in Astana, on July 25, 2016.
2. This decree shall come into force from the date of signing.

Your Excellency,
I have the honor to acknowledge receipt of your Note dated July 25, 2016 no.52, and to inform that the Government of the Republic of Kazakhstan is ready to accept the conditions proposed by the Government of the Federative Republic of Brazil, in response to which the Government of the Republic of Kazakhstan, wishing to guarantee compliance with the principle reciprocity and to facilitate mutual trips of our citizens, as well as with the aim of further developing friendly relations and strengthening close relationship between the two states, is ready to accept, on the basis of reciprocity, the following obligations on the issue of abolishing the visa regime:
1. Citizens of the Federal Republic of Brazil who are holders of valid passports may enter, leave, transit and stay in the Republic of Kazakhstan without visas for tourist and business trips for a period not exceeding thirty (30) calendar days for one year (1) from the date of first entry into the territory of the Republic of Kazakhstan.
2. The aforementioned period may be extended by the authorized state body of the Republic of Kazakhstan one more time for a period not exceeding thirty (30) calendar days.
3. For the purposes of this Note, a valid passport shall mean the passport of a citizen of the Federal Republic of Brazil.
4. Tourism means trips for recreational, informational, cultural and other purposes that do not imply engaging in any paid activity that may lead to financial obligations of local sources in the territory of the Republic of Kazakhstan.
5. To transit means an opportunity for citizens of the Federal Republic of Brazil to enter and leave the territory of the Republic of Kazakhstan to reach their final destination.
6. Business trips means travels of citizens of the Federal Republic of Brazil who are not engaged in paid activities in the territory of the Republic of Kazakhstan, with the aim of creating prospects for doing business, participating in meetings, signing contracts and performing management and administrative activities.
7. Citizens of the Federative Republic of Brazil should apply for the required visa, in accordance with the national law of the Republic of Kazakhstan, if they wish to stay in the territory of the Republic of Kazakhstan for the purposes of carrying out paid activities, get a job, take part in research, and do internships , training and social work, as well as providing technical assistance, missionary work, religious, artistic or any other activity not stipulated by paragraphs 4, 5, 6 of the present Note.
8. Citizens, specified in paragraph 1 of the present Note, can enter, transit and leave the territory of the Republic of Kazakhstan through any border crossing points open for international traffic.
9. The abolition of visas established by this Note shall apply without prejudice to the obligations of citizens of the Federal Republic of Brazil to national laws in force in the territory of the Republic of Kazakhstan during their short stay.
10. This Note shall apply without prejudice to the right of the Republic of Kazakhstan to refuse entry, to shorten the time limits or to stop staying on its territory undesirable citizens of the Federal Republic of Brazil.
11. The Government of the Republic of Kazakhstan may fully or partially suspend the application of the present Note to ensure national security, public order and public health. The decision to suspend or resume the application of the present Note should be immediately sent to the Government of the Federative Republic of Brazil through diplomatic channels.
12. Citizens of the Federative Republic of Brazil, who have lost or spoiled their valid passport during their stay in the territory of the Republic of Kazakhstan, should receive an appropriate travel document issued by the diplomatic mission or consular office of the Federative Republic of Brazil in the territory of the Republic of Kazakhstan in order to leave it the territory.
13. The Government of the Republic of Kazakhstan shall apply to this Note samples of valid passports.
14. In the event of a change in passports, the Government of the Republic of Kazakhstan should pass to the Government of the Federative Republic of Brazil through diplomatic channels new samples of passports along with information on their application at least thirty (30) calendar days before the date of entry into force of these changes.
15. Disagreements arising from the interpretation or application of the provisions of the present Note shall be resolved through negotiations and consultations through diplomatic channels.
16. The Government of the Republic of Kazakhstan expresses its agreement that this Note and the above Note from Your Excellency constitute the Agreement in the form of an exchange of notes between the Government of the Republic of Kazakhstan and the Government of the Federal Republic of Brazil on visa-free trips for citizens of the Republic of Kazakhstan and the Federal Republic of Brazil which shall enter into force upon expiry of five (5) calendar days from the date of receipt by the Government of the Federal Republic of Brazil through diplomatic channels of a written notification of the Government of the Republic of Kazakhstan on the implementation of domestic procedures necessary for its entry into force.
17. This Agreement is concluded for an indefinite period. The Government of the Republic of Kazakhstan shall have the right to terminate it at any time by sending written notification to the Government of the Federative Republic of Brazil through diplomatic channels. This Agreement shall terminate upon the expiration of ninety (90) calendar days after the date of receipt of such notice.
18. This Agreement may be amended by the Government of the Republic of Kazakhstan and the Government of the Federative Republic of Brazil through the exchange of notifications through diplomatic channels. Amendments shall enter into force in accordance with the terms of the entry into force of the Agreement specified in пункте 16 of the present Note.
19. This Note is composed in Kazakh, Portuguese and English, the texts of which are equally authentic. In case of differences in interpretation or application of the provisions of the present Note, the Parties shall refer to the text in English.

In case of agreement of the Government of the Republic of Kazakhstan with aforementioned, this Note and the Note of Your Excellence in answer shall constitute the Agreement in the form of an exchange of notes between the Government of the Federative Republic of Brazil and the Government of the Republic of Kazakhstan on visa-free trips for citizens of the Federative Republic of Brazil and the Republic of Kazakhstan, which shall enter into force upon expiry of five (5) calendar days from the date of receipt by the Government of the Federative Republic of Brazil through diplomatic channels of a written notification of the Government of the Republic of Kazakhstan on the implementation of domestic procedures necessary for its entry into force.
