On approval of the Rules for Maintaining and the Form of the Logbook of Acts on the Assignment of Inspections of Passenger Trains

In compliance with paragraph 3 of Article 66-1 of the Law of the Republic of Kazakhstan dated December 8, 2001 "On Railway Transport" I HEREBY ORDER:

1. That the following shall be approved:

1) Rules for Maintaining and the Form of the Logbook of Acts on the Assignment of Inspections of Passenger Trains in accordance with Appendix 1 to this Order;

2) the form of the logbook of acts on the assignment of inspections of passenger trains, in accordance with Appendix 2 to this order.

2. The Transport Committee of the Ministry for Investments and Development of the Republic of Kazakhstan (A. A. Assavbayev ) shall:

1) ensure state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) direct copies hereof in printed and electronic form for the publication in the print media and Adilet, the legal information system within ten calendar days after its state registration with the Ministry of Justice of the Republic of Kazakhstan, as well as to the Republican Center of Legal Information within five working days from the date of receipt of the registered order for inclusion in the reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) place this order on the Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the web-portal of government agencies;

4) within ten business days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry for Investments and Development of the Republic of Kazakhstan the information on the implementation of measures provided for in subparagraphs 1), 2) and 3) of this paragraph.

3. The control over the execution of this order shall be assigned to the supervising Vice Minister for Investments and Development of the Republic of Kazakhstan.

4. This order shall become effective ten calendar days after the day of its first official publication.

Chapter 1. General provisions

1. These Rules for Maintaining and the Form of the Logbook of Acts on the Assignment of Inspections of Passenger Trains (hereinafter referred to as the Rules) are developed in accordance with paragraph 3 of Article 66-1 of the Law of the Republic of Kazakhstan dated December 8, 2001 “On Railway Transport”.

2. The Rules shall determine the procedure for maintaining a logbook of acts on the assignment of inspections of passenger trains (hereinafter referred to as the “Logbook”), which shall include its design and completion of the logbook.

Chapter 2. Order of Maintaining of the Logbook of Acts on the Assignment of Inspections of Passenger Trains

3. The authorized body shall fill in the logbook.

4. The logbook shall be maintained on paper, numbered, laced up and certified by the signature and seal (if any) of the authorized body, and signed by the responsible person designated for its maintenance.

5. Entries shall be entered into it fully, clearly, accurately, corrections and cleanings shall be prohibited. Erroneous entries shall be negotiated and certified by the signature of the responsible person.

6. Column 1 shall indicate the serial number for each act of verification of a passenger train.

7. Column 2 shall indicate the date of completion of the logbook.

8. Column 3 shall indicate the date and number of the act on the assignment of the inspection of passenger trains.

9. Column 4 shall indicate the name of the authorized body.

10. Column 5 shall indicate the last name, first name, patronymic (if any) and position of the person (s) authorized (authorized) to conduct an inspection of passenger trains.

11. Column 6 shall indicate the name of the inspected entity and the number of passenger trains.

12. Column 7 shall indicate the identification number (IIN / BIN) of the inspected entity.

13. Column 8 shall indicate the type of activity of the audited entity.

14. Column 9 shall indicate the time period for checking passenger trains.

15. Column 10 shall indicate the signature of the person authorized to sign acts.

Об утверждении Правил ведения и формы журнала учета актов о назначении проверок пассажирских поездов

Приказ Министра по инвестициям и развитию Республики Казахстан от 26 мая 2016 года № 441. Зарегистрирован в Министерстве юстиции Республики Казахстан 24 июня 2016 года № 13824.

В соответствии с пунктом 3 статьи 66-1 Закона Республики Казахстан от 8 декабря 2001 года "О железнодорожном транспорте" ПРИКАЗЫВАЮ:

1. Утвердить:

1) Правила ведения журнала учета актов о назначении проверок пассажирских поездов, согласно приложению 1 к настоящему приказу;

2) форму журнала учета актов о назначении проверок пассажирских поездов, согласно приложению 2 к настоящему приказу.

2. Комитету транспорта Министерства по инвестициям и развитию Республики Казахстан (Асавбаев А.А.) обеспечить:

1) государственную регистрацию настоящего приказа в Министерстве юстиции Республики Казахстан;

2) направление копии настоящего приказа в печатном и электронном виде на официальное опубликование в периодические печатные издания и информационно-правовую систему "Әділет" в течение десяти календарных дней после его государственной регистрации в Министерстве юстиции Республики Казахстан, а также в Республиканский центр правовой информации в течение пяти рабочих дней со дня получения зарегистрированного приказа для включения в эталонный контрольный банк нормативных правовых актов Республики Казахстан;

3) размещение настоящего приказа на интернет-ресурсе Министерства по инвестициям и развитию Республики Казахстан и на интранет-портале государственных органов;

4) в течение десяти рабочих дней после государственной регистрации настоящего приказа в Министерстве юстиции Республики Казахстан представление в Юридический департамент Министерства по инвестициям и развитию Республики Казахстан сведений об исполнении мероприятий, предусмотренных подпунктами 1), 2) и 3) настоящего пункта.

3. Контроль за исполнением настоящего приказа возложить на курирующего вице-министра по инвестициям и развитию Республики Казахстан.

4. Настоящий приказ вводится в действие по истечении десяти календарных дней после дня его первого официального опубликования.

Правила
ведения журнала учета актов о назначении проверок
пассажирских поездов
Глава 1. Общие положения

1. Настоящие Правила ведения журнала учета актов о назначении проверок пассажирских поездов (далее – Правила) разработаны в соответствии с пунктом 3 статьи 66-1 Закона Республики Казахстан от 8 декабря 2001 года "О железнодорожном транспорте".

2. Правила определяют порядок ведения журнала учета актов о назначении проверок пассажирских поездов (далее – Журнал учета), который включает его оформление и заполнение журнала учета.

Глава 2. Порядок ведения журнала учета актов о назначении
проверок пассажирских поездов

3. Уполномоченный орган заполняет журнал учета.

4. Журнал учета введется на бумажном носителе, пронумеровывается, прошнуровывается и заверяется подписью и печатью (при наличии) уполномоченного органа, и подписывается ответственным лицом, назначенным за его ведение.

5. Записи в него вносятся полно, четко, аккуратно, исправления и подчистки не допускаются. Ошибочные записи оговариваются и заверяются подписью ответственного лица.

6. В графе 1 указывается порядковый номер для каждого акта проверки пассажирского поезда.

7. В графе 2 указывается дата заполнения журнала.

8. В графе 3 указывается дата и номер акта о назначении проверки пассажирских поездов.

9. В графе 4 указывается наименование уполномоченного органа.

10. В графе 5 указывается фамилия, имя, отчества (при его наличии) и должность лица (лиц), уполномоченного (уполномоченных) на проведение проверки пассажирских поездов.

11. В графе 6 указывается наименование проверяемого субъекта и номера пассажирских поездов.

12. В графе 7 указывается идентификационный номер (ИИН/БИН) проверяемого субъекта.

13. В графе 8 указывается вид деятельности проверяемого субъекта.

14. В графе 9 указывается срок проведения проверки пассажирских поездов.

15. В графе 10 указываются подпись лица, уполномоченного подписывать акты.
