In accordance with paragraph 6-1 of Article 212 of the Law of the Republic of Kazakhstan dated January 17, 2002 "On Merchant Shipping" I HEREBY ORDER:

1. That the attached Rules for the Provision of Information on State Registration of a Vessel Mortgage or a Vessel under Construction shall be approved.

2. The Transport Committee of the Ministry for Investments and Development of the Republic of Kazakhstan (A. A. Assavbayev ) shall:

1) ensure state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) send a copy hereof in paper and electronic form for the publication in the print media and Adilet, the legal information system, as well as to the reference control bank of regulatory legal acts of the Republic of Kazakhstan within ten calendar days from the date of state registration with the Ministry of Justice of the Republic of Kazakhstan;

3) place this order on the Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten business days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry for Investments and Development of the Republic of Kazakhstan the information on the implementation of measures provided for in subparagraphs 1), 2) and 3) of this paragraph.

3. The control over the execution of this order shall be assigned to the supervising Vice Minister for Investments and Development of the Republic of Kazakhstan.

4. This order shall become effective upon expiration of ten calendar days after the day of its first official publication.

Rules for the
Provision of Information on State Registration of a Vessel Mortgage or a Vessel under Construction
Chapter 1. General provisions

1. These Rules for the
Provision of Information on State Registration of a Vessel Mortgage or a Vessel under Construction are developed in accordance with Paragraph 6-1 of Article 212 of the Law of the Republic of Kazakhstan dated January 17, 2002 "On Merchant Shipping" and determine the procedure for providing information on the state registration of the mortgage of the vessel or the vessel under construction.

2. State registration of a vessel mortgage or a vessel under construction shall be carried out by the territorial divisions of the authorized body (hereinafter referred to as the territorial division) by making an appropriate entry in the state ship registry of sea vessels, the ship book and the register of vessels under construction (hereinafter - the register of vessels) in which this vessel shall be registered.

Chapter 2. The procedure for providing information on state
registration of a vessel mortgage or a vessel under construction

3. Upon the request of an individual or legal entity in any form, the territorial division shall provide information in the form of an extract or a copy from the register of vessels. In this case, the extract shall contain:

1) indications that the information on the mortgage is presented at the end of the business day preceding the day the statement was issued;

2) the signature of the authorized official of the territorial division, certified by the seal of the territorial division.

The deadline for providing information shall be two business days from the date of application.

4. The information on state registration of a vessel mortgage or a vessel under construction shall be provided free of charge.

5. The information on the state registration of a vessel mortgage or a vessel under construction shall be open to all individuals and legal entities.

6. In the absence of any records on the mortgage in relation to a vessel or a vessel under construction, the extract shall contain an appropriate indication of this.

В соответствии с пунктом 6-1 статьи 212 Закона Республики Казахстан от 17 января 2002 года "О торговом мореплавании" ПРИКАЗЫВАЮ:

1. Утвердить прилагаемые Правила предоставления информации о государственной регистрации ипотеки судна или строящегося судна.

2. Комитету транспорта Министерства по инвестициям и развитию Республики Казахстан (Асавбаев А.А.) обеспечить:

1) государственную регистрацию настоящего приказа в Министерстве юстиции Республики Казахстан;

2) направление копии настоящего приказа в бумажном и электронном виде на официальное опубликование в периодические печатные издания и информационно-правовую систему "Әділет", а также в Эталонный контрольный банк нормативных правовых актов Республики Казахстан в течение десяти календарных дней со дня государственной регистрации в Министерстве юстиции Республики Казахстан;

3) размещение настоящего приказа на интернет-ресурсе Министерства по инвестициям и развитию Республики Казахстан;

4) в течение десяти рабочих дней после государственной регистрации настоящего приказа в Министерстве юстиции Республики Казахстан представление в Юридический департамент Министерства по инвестициям и развитию Республики Казахстан сведений об исполнении мероприятий, предусмотренных подпунктами 1), 2) и 3) настоящего пункта.

3. Контроль за исполнением настоящего приказа возложить на курирующего вице-министра по инвестициям и развитию Республики Казахстан.

4. Настоящий приказ вводится в действие по истечении десяти календарных дней после дня его первого официального опубликования.

Правила
предоставления информации о государственной регистрации ипотеки
судна или строящегося судна
Глава 1. Общие положения

1. Настоящие Правила предоставления информации о государственной регистрации ипотеки судна или строящегося судна разработаны в соответствии с пунктом 6-1 статьи 212 Закона Республики Казахстан от 17 января 2002 года "О торговом мореплавании" и определяют порядок предоставления информации о государственной регистрации ипотеки судна или строящегося судна.

2. Государственная регистрация ипотеки судна или строящегося судна осуществляется территориальными подразделениями уполномоченного органа (далее – территориальное подразделение) путем внесения соответствующей записи в государственный судовой реестр морских судов, судовую книгу и реестр строящихся судов (далее – реестр судов), в котором зарегистрировано данное судно.

Глава 2. Порядок предоставления информации о государственной
регистрации ипотеки судна или строящегося судна

3. По заявлению физического или юридического лица в произвольной форме, территориальное подразделение предоставляет информацию в форме выписки или копии из реестра судов. При этом выписка содержит:

1) указания на то, что сведения об ипотеке представлены на конец рабочего дня, предшествующего дню выдачи выписки;

2) подпись уполномоченного должностного лица территориального подразделения, заверенная печатью территориального подразделения.

Срок предоставления информации составляет два рабочих дня с момента подачи заявления.

4. Информация о государственной регистрации ипотеки судна или строящегося судна предоставляется безвозмездно.

5. Сведения о государственной регистрации ипотеки судна или строящегося судна являются открытыми для всех физических и юридических лиц.

6. В случае отсутствия каких-либо записей об ипотеке в отношении того или иного судна или строящегося судна выписка содержит соответствующее указание на это.
