"Кинематография туралы" Қазақстан Республикасының Заңы 4-бабының 2) тармақшасына сәйкес Қазақстан Республикасының Үкіметі ҚАУЛЫ ЕТЕДІ:

1. Жарғылық капиталына мемлекет жүз пайыз қатысатын "Ұлттық киноны қолдау мемлекеттік орталығы" коммерциялық емес акционерлік қоғамы (бұдан әрі – қоғам) құрылсын.

2. Мыналар:

1) ұлттық фильмдер деп танылуға үмітті киножобалар мен ұлттық фильмдерді қаржыландыру түрінде мемлекеттік қолдауды ұсыну, оның ішінде қызметінің негізгі нысанасы фильмдер шығару болып табылатын, жарғылық капиталына мемлекет жүз пайыз қатысатын заңды тұлғаға мемлекеттік қаржылық қолдаудың жыл сайынғы сомасының жалпы көлемінің кемінде отыз бес пайызы мөлшерінде ұсыну;

ЗҚАИ-ның ескертпесі!
2) тармақша осы қаулының 8-тармағына сәйкес 31.12.2025 дейін қолданыста болады.

2) кинематография саласындағы субсидияларды төлеу;

3) Қазақстан Республикасының аумағына әкелінетін балалар анимациялық фильмдері мен отбасымен көруге арналған фильмдерді қазақ тілінде дубляждауды қаржыландыру қоғам қызметінің негізгі нысанасы болып айқындалсын.

3. Қоғамның жарғылық капиталы осы қаулыға 1-қосымшаға сәйкес "Қазақстан Республикасының Ұлттық музейі" республикалық мемлекеттік қазыналық кәсіпорнының балансындағы республикалық мүлік есебінен қалыптастырылсын.

4. Қоғам жанынан осы қаулыға 2-қосымшаға сәйкес құрамда Сараптама кеңесі (бұдан әрі – Сараптама кеңесі) құрылсын.

5. Қоса беріліп отырған Сараптама кеңесі туралы ереже бекітілсін.

6. Қазақстан Республикасы Қаржы министрлігінің Мемлекеттік мүлік және жекешелендіру комитеті Қазақстан Республикасы Мәдениет және спорт министрлігімен бірлесіп, заңнамада белгіленген тәртіппен:

1) қоғамның жарғысын әзірлеуді және бекітуді, оны Қазақстан Республикасының әділет органдарында мемлекеттік тіркеуді;

2) Қазақстан Республикасы Мәдениет және спорт министрлігіне қоғам акцияларының мемлекеттік пакетіне иелік ету және пайдалану құқығын беруді;

3) осы қаулыдан туындайтын өзге де шаралардың қабылдануын қамтамасыз етсін.

7. Қоса беріліп отырған Қазақстан Республикасы Үкіметінің кейбір шешімдеріне енгізілетін ереже бекітілсін.

8. Осы қаулы қол қойылған күнінен бастап қолданысқа енгізіледі.

"Кинематография туралы" Қазақстан Республикасының Заңына сәйкес осы қаулының 2-тармағының 2) тармақшасы 2025 жылғы 31 желтоқсанға дейін қолданыста болады".

1-тарау. Жалпы ережелер

1. Осы Ұлттық киноны қолдаудың мемлекеттік орталығы жанындағы Сараптама кеңесі туралы ереже Ұлттық киноны қолдаудың мемлекеттік орталығы жанындағы консультативтік-кеңесші орган болып табылатын Сараптама кеңесінің (бұдан әрі – Кеңес) мәртебесі мен өкілеттіктерін айқындайды.

2. Кеңес өз қызметінде Қазақстан Республикасының Конституциясын, Қазақстан Республикасының заңдарын, Қазақстан Республикасының Президенті мен Үкіметінің актілерін, басқа да нормативтік құқықтық актілерді, сондай-ақ осы Ережені басшылыққа алады.

3. Ұлттық киноны қолдау мемлекеттік орталығы (бұдан әрі – Орталық) Кеңестің жұмыс органы болып табылады.

4. Кеңес отырыстары қажеттілігіне қарай өткізіледі.

2-тарау. Кеңестің міндеті мен функциялары

5. Кеңестің негізгі міндеті фильмді ұлттық деп тану жөнінде ұсыныстар тұжырымдау және Қазақстан Республикасының аумағына əкелінетін балалар анимациялық фильмдері мен отбасымен көруге арналған фильмдерді қазақ тілінде дубляждауды қаржыландыру болып табылады.

6. Осы Ереженің 5-тармағында көрсетілген міндетті іске асыру үшін Кеңес мынадай функцияларды жүзеге асырады:

1) ұлттық фильмдер деп танылуға үмітті киножобаларды қарайды;

2) Қазақстан Республикасының аумағына әкелінетін балалар анимациялық фильмдері мен отбасымен көруге арналған фильмдерді қазақ тілінде дубляждауды қаржыландыру үшін оларды қарастырады;

3) ұлттық фильмдер деп танылуға үмітті киножобаларды қаржыландыру бойынша қорытындылар дайындайды;

4) Қазақстан Республикасының аумағына әкелінетін балалар анимациялық фильмдері мен отбасымен көруге арналған фильмдерді қазақ тілінде дубляждауды қаржыландыру бойынша қорытындылар дайындайды;

5) фильмді ұлттық деп тану немесе фильмді ұлттық деп танудан бас тарту туралы ұсынымдар дайындайды;

6) өндірістің кез келген кезеңінде киножобаларды қаржыландыру түрінде мемлекеттік қолдау алған киножобалардың бастапқы монтажын қарауды жүзеге асырады;

7) Кеңестің құзыретіне жататын өзге де функцияларды жүзеге асырады.

3-тарау. Кеңес жұмысының ұйымдастырылуы мен тәртібі

7. Кеңестің құрамы шығармашыл қызметкерлер, мәдениет қызметкерлері мен кинематография саласындағы сарапшылар қатарынан құрылатын төрағадан, төрағаның орынбасарынан және Кеңес мүшелерінен тұрады. Кеңес төрағасы Кеңес мүшелерінің арасынан кеңестің бірінші отырысында мүшелердің қарапайым көпшілік даусымен сайланады. Хатшы Кеңес мүшесі болып табылмайды.

8. Кеңестің төрағасы:

1) Кеңес қызметіне басшылық пен бақылауды жүзеге асырады;

2) Кеңестің жұмыс жоспарын бекітеді;

3) Кеңес отырыстарын өткізеді және отырыстардың хаттамаларына қол қояды;

4) Кеңес қабылдаған шешімдер үшін жауапты болады.

9. Төраға болмаған жағдайда оның функцияларын төрағаның орынбасары орындайды.

10. Кеңес мүшелерінің жалпы саны кемінде 10 (он) мүшеден тұрады.

11. Кеңес мүшелері Кеңес отырыстарына алмасу құқығынсыз қатысады.

Отырысқа қатысу мүмкін болмаған жағдайда Кеңес мүшесі Кеңес отырысына дейін кемінде бір күн қалғанда келмеуінің себебін көрсете отырып, Кеңестің жұмыс органына бұл туралы хат жолдайды не қатысудың мүмкін болмауы Кеңес отырысы өтетін күні белгілі болған жағдайда, Кеңес отырысына қатысудың мүмкін еместігі туралы Кеңестің жұмыс органын хабардар ету бойынша қажетті шараларды қабылдайды.

12. Кеңес төрағасы кинематография саласындағы уәкілетті органға Кеңес отырысына дәлелсіз себептермен жүйелі түрде (қатарынан 3 реттен астам) келмеген мүшелерін оның құрамынан шығару туралы ұсыныс енгізеді.

13. Кеңес шешімдері ұсынымдық сипатта болатын хаттама нысанында ресімделеді.

14. Кеңес шешімдері ашық дауыс беру арқылы қабылданады және егер оған Кеңестің қатысып отырған мүшелерінің жалпы санының кемінде үштен екісі дауыс берсе, қабылданды деп есептеледі. Дауыстар тең болған жағдайда Кеңес төрағасы дауыс берген шешім қабылданды деп есептеледі.

Кеңес мүшелерінің ерекше пікірге құқығы бар, оны білдірген жағдайда жазбаша түрде баяндалуға тиіс.

Кеңес отырыстарын өткізу нәтижелері бойынша және дауыс беру парақтарының негізінде хаттама жасалады, оған кеңес төрағасы, мүшелері және хатшысы үш жұмыс күні ішінде қол қояды.

15. Егер Кеңес мүшесі:

1) киножобаның, фильмнің және түсіру тобы авторларының құрамына кіретін болса;

2) киножобаның, фильмнің және түсіру тобы авторларының құрамына кіретін кез келген адамның бірінің туысы, жұбайы (зайыбы) немесе жекжаты болса, қарауға және дауыс беруге қатыса алмайды.

16. Отырысты ұйымдастыруды, хаттаманы дайындауды, сондай-ақ алдын ала танысу үшін Кеңес мүшелеріне тиісті құжаттар мен материалдарды таратуды Кеңес хатшысы жүзеге асырады.

Құжаттар мен материалдарды жіберу Кеңестің кезекті отырысы өткізілгенге дейін кемінде бір ай бұрын жүзеге асырылады.

17. Кеңес отырыстары техникалық жазу құралдарының көмегімен тіркеледі.

Кеңес отырысы барысында техникалық жазу құралдарының көмегімен тіркелген материалдар Кеңес отырысы аяқталған күннен бастап кемінде үш жыл Орталықта сақталады.

On creation of the State center for support of national cinema

Resolution of the Government of the Republic of Kazakhstan dated March 15, 2019 No. 113.

Unofficial translation

In accordance with subclause 2) of Article 4 of the Law of the Republic of Kazakhstan "On cinematography" the Government of the Republic of Kazakhstan HEREBY RESOLVES:

1. To create the Non-Profit Joint Stock Company “State Center for the Support of National Cinema” (hereinafter referred to as the company) with one hundred percent participation of the state in its authorized capital.

2. To determine the major core activities of the company:

1) provision of state support in the form of financing of film projects claiming recognition as national films, and national films, including a legal entity with a wholly owned state participation in the authorized capital, the main activity of which is the production of films, in the amount of at least thirty-five percent of the total annual amount of state financial support;

Subparagraph 2) shall be valid until 31.12.2025 in accordance with p. 8 of this Resolution.

2) payment of subsidies in the field of cinematography;

3) financing of dubbing into the Kazakh language of children's animated films and films for family viewing imported into the territory of the Republic of Kazakhstan.

3. To form the authorized capital of the company at the expense of the republican property, being at the balance of the Republican State Budget-supported Enterprise "National Museum of the Republic of Kazakhstan", according to Appendix 1 to this resolution.

4. To create an Expert Council in the company (hereinafter referred to as the Expert Council) in the composition, according to this resolution.

5. To approve the attached Regulations on the Expert Council.

6. The State Property and Privatization Committee of the Ministry of Finance of the Republic of Kazakhstan jointly with the Ministry of Culture and Sports of the Republic of Kazakhstan, in accordance with the procedure, established by the legislation, shall ensure:

1) development and approval of the charter of the company and its state registration with the bodies of justice of the Republic of Kazakhstan;

2) transfer the rights of ownership and use of the state-owned stake of shares of the company to the Ministry of Culture and Sports of the Republic of Kazakhstan;

3) taking other measures arising from this resolution.

7. To approve the attached additions, which are made to certain decisions of the Government of the Republic of Kazakhstan.

8. This Resolution shall come into force from the date of signing.

Subparagraph 2) of paragraph 2 of this Resolution shall be valid until December 31, 2025 in accordance with the Law of the Republic of Kazakhstan “On cinematography”.

Regulations on the Expert Council under the State Center of Support of National Cinema

Chapter 1. General provisions

1. These Regulations on the Expert Council under the State Center of Support of National Cinema shall determine the status and the powers of the Expert Council (hereinafter referred to as the Council), which is aт advisory body under the State Center of Support of National Cinema.

2. In its activities, the Council shall be governed by the Constitution of the Republic of Kazakhstan, laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan, as well as these Regulations.

3. The working body of the Council is the State Center for the Support of National Cinema (hereinafter referred to as the Center).

4. Meetings of the Council shall be held as necessary.

Chapter 2. Mission and functions of the Council

5. The main mission of the Council is to develop proposals for recognizing the film as national and financing dubbing into the Kazakh language of children's animated films and films for family viewing imported into the territory of the Republic of Kazakhstan.

6. To implement the mission specified in paragraph 5 of these Regulations, the Council shall carry out the following functions:

1) considers film projects that claim to be recognized as national films;

2) considers children's animation films and films for family viewing, imported into the territory of the Republic of Kazakhstan, to finance their dubbing into the Kazakh language;

3) prepares opinions on the financing of film projects claiming to be recognized as national films;

4) prepares opinions on the financing of dubbing into the Kazakh language of children's animated films and films for family viewing imported into the territory of the Republic of Kazakhstan;

5) prepares recommendations on the recognition of the film as national or on the refusal to recognize the film as national;

6) views breakdown footages of film projects that have received state support in the form of film project financing at any stage of production;

7) performs other functions within the competence of the Council.

Chapter 3. Organization and the operating procedure of the Council

7. The composition of the Council consists of the chairman, deputy chairman and members of the Council, formed from among creative workers, cultural workers and experts in the field of cinematography. The Chairman of the Council is elected from among the members of the Council by a simple majority of votes of the members at the first meeting of the Council. The Secretary is not a member of the Council..

8. The Chairman of the Council shall:

1) carry out guidance and control over the activities of the Council;

2) approve the work plan of the Council;

3) hold meetings and sign minutes of meetings of the Council;

4) bear responsibility for the decisions taken by the Council.

9. In the absence of the chairman, his functions shall be performed by the deputy chairman.

10. The total number of members of the Council shall be at least 10 (ten) members.

11. Members of the Council shall take part in the meetings of the Council without the right of substitution.

If it is impossible to participate in the meeting, a member of the Council no later than one day before the meeting of the Council shall send a letter to the working body of the Council indicating the reason for non-attendance, or takes the necessary measures to notify the working body of the Council about the impossibility of taking part in the meeting. meeting of the Council if such impossibility was established on the day of the meeting of the Council.

12. The chairman of the Council shall submit proposals to the authorized body in the field of cinematography to exclude members from the Council of the Council who have systematically failed to attend its meetings (more than 3 times in a row) without good reason.

13. Decisions of the Council shall be drawn up in the form of a protocol, which is of a recommendatory nature.

14. Decisions of the Council shall be taken by an open vote and are considered adopted if they are supported by at least two-thirds of the votes of the total number of members of the Council present. In the event of a tie, the decision is deemed to have been voted for by the chairman of the Council.

Members of the Council shall have the right for a special opinion, which, in case of its expression, must be set down in writing.

Based on the results of the meetings of the Council and on the basis of voting sheets, a protocol shall be drawn up within three working days, signed by the chairman, members and secretary of the Council.

15. A member of the Council may not participate in consideration and voting if he/she:

1) is a member of the authors of the film project, film and crew;

2) is a relative, spouse (wife) or in-law of one of the persons who are part of the authors of the film project, film and film crew.

16. The organization of the meeting, preparation of the minutes, as well as the distribution of relevant documents and materials to the members of the Council for preliminary acquaintance shall be carried out by the Secretary of the Council.

Submission of documents and materials shall be made at least one month before the next meeting of the Council.

17. Meetings of the Council shall be recorded by technical recording.

Materials recorded during a meeting of the Council with the help of technical recording means shall be kept at the Center for at least three years from the date of the conclusion of the meeting of the Council.
