Қазақстан Республикасы Президентінің бастамаларына арналған резервті бөлу қағидалары 1-тарау. Жалпы ережелер

1. Осы Қазақстан Республикасы Президентінің бастамаларына арналған резервті бөлу қағидалары (бұдан әрі – Қағидалар) Қазақстан Республикасының Бюджет кодексі 70-1-бабының 4-тармағына сәйкес әзірленді және Қазақстан Республикасы Президентінің бастамаларына арналған резервті бөлу тәртібін айқындайды.

2. Қазақстан Республикасы Президентінің бастамаларына арналған резерв Қазақстан Республикасы Президентінің Қазақстан халқына жыл сайынғы жолдауларын және Қазақстан Республикасы Президентінің басқа да бастамаларын қаржыландыру үшін жоспарлы кезеңнің бірінші жылына арналған республикалық бюджеттің құрамында қалыптастырылады.

3. Қазақстан Республикасы Президентінің бастамаларына арналған резерв кезекті қаржы жылына арналған республикалық бюджет шығыстарының жоспарланған көлемінің екі пайызына дейінгі мөлшерде жоспарланады.

4. Қазақстан Республикасы Президентінің бастамаларына арналған резерв бюджеттік жоспарлау жөніндегі орталық уәкілетті орган әкімшілендіретін жеке бөлінетін бюджеттік бағдарлама бойынша көзделеді.

5. Қазақстан Республикасы Президентінің Қазақстан халқына жыл сайынғы жолдаулары шеңберінде Қазақстан Республикасы Президентінің 2010 жылғы 27 сәуірдегі № 976 Жарлығымен бекітілген Қазақстан Республикасы Президентінің жолдауын дайындау және іске асыру, актілерімен және тапсырмаларымен жұмыс істеу және олардың орындалуын бақылауды жүзеге асыру, нормативтік құқықтық жарлықтарға мониторинг жүргізу қағидаларының 2-тарауының 6-тармағына сәйкес Қазақстан Республикасының Үкіметі мен Қазақстан Республикасының Президентіне тікелей бағынатын және есеп беретін мемлекеттік органдар Қазақстан Республикасы Президентінің жолдауы жобасының тақырыбы мен мазмұны бойынша ұсыныстарды Қазақстан Республикасы Президентінің Әкімшілігіне жіберген кезде қаржыландыруды көздейтін ұсыныстар бойынша бюджет қаражатының қажеттілігін ұсынады.

6. Қазақстан Республикасы Президентінің Қазақстан халқына арналған жыл сайынғы жолдауларынан және Қазақстан Республикасы Президентінің басқа да бастамаларынан кейін бюджеттік бағдарламалардың тиісті әкімшісі Қазақстан Республикасының бюджет заңнамасына сәйкес есептеулер мен негіздемелерді қоса бере отырып, қаражат сомасын және шығыстар бағытын көрсете отырып, Қазақстан Республикасы Президентінің бастамаларына арналған резервтен қаражат бөлу туралы Қазақстан Республикасы Үкіметі қаулысының жобасын бюджеттік жоспарлау жөніндегі орталық уәкілетті органға жібереді.

Қаражат бюджеттік бағдарламалардың бірнеше әкімшісіне бір мезгілде бөлінген кезде Қазақстан Республикасы Президентінің бастамаларына арналған резервтен қаражат бөлу туралы Қазақстан Республикасының Үкіметі қаулысының жобасын бюджеттік жоспарлау жөніндегі орталық уәкілетті орган әзірлейді.

7. Бюджеттік жоспарлау жөніндегі орталық уәкілетті орган бюджеттік бағдарламалар әкімшісі ұсынған Қазақстан Республикасы Президентінің бастамаларына арналған резервтен қаражат бөлу туралы Қазақстан Республикасының Үкіметі қаулысының жобасын қарауды келіп түскен күнінен бастап 5 жұмыс күні ішінде жүзеге асырады.

8. Қазақстан Республикасы Президентінің бастамаларына арналған резервтен қаражат бөлу туралы Қазақстан Республикасының Үкіметі қаулысының жобасына құжаттардың толық топтамасы ұсынылмаған және/немесе ұсынылған құжаттар бойынша ескертулер болған жағдайда бюджеттік жоспарлау жөніндегі орталық уәкілетті орган Қазақстан Республикасы Президентінің бастамаларына арналған резервтен қаражат бөлу туралы Қазақстан Республикасы Үкіметі қаулысының жобасын пысықтауға қайтарады.

Бюджеттiк бағдарламалар әкiмшiсi Қазақстан Республикасы Президентінің бастамаларына арналған резервтен қаражат бөлу туралы Қазақстан Республикасының Үкіметі қаулысының пысықталған жобасын ол қайтарылған күннен бастап 5 жұмыс күнi iшiнде бюджеттік жоспарлау жөнiндегi орталық уәкiлеттi органға ұсынады.

9. Бюджеттік бағдарламалардың әкімшісі Қазақстан Республикасы Президентінің бастамаларына арналған резервтен қаражат бөлу туралы Қазақстан Республикасы Үкіметі қаулысының жобасына қоса берілетін ақпарат пен есептеулердің толықтығы мен дұрыстығын қамтамасыз етеді.

10. Бюджеттік жоспарлау жөніндегі орталық уәкілетті орган материалдарды қарау қорытындылары бойынша Қазақстан Республикасы Президентінің бастамаларына резервтен қаражат бөлу туралы Қазақстан Республикасы Үкіметі қаулысының жобасы бойынша қорытынды қалыптастырады және 5 жұмыс күнi iшiнде қорытындыны Қазақстан Республикасы Президентінің Әкімшілігіне келісуге енгізеді.

Қазақстан Республикасы Президентінің Әкімшілігі қорытындыны келіскеннен кейін бюджеттік жоспарлау жөніндегі орталық уәкілетті орган Қазақстан Республикасы Президентінің бастамаларына резервтен қаражат бөлу туралы Қазақстан Республикасының Үкіметі қаулысының жобасын қорытындымен бірге Қазақстан Республикасы бюджет заңнамасында белгіленген тәртіппен Республикалық бюджет комиссиясының қарауына енгізеді.

11. Қазақстан Республикасының Үкіметі Қазақстан Республикасы Президентінің бастамаларына арналған резервтен қаражат бөлу туралы шешімі қабылданғаннан кейін бюджетті атқару барысында бюджеттік бағдарламалардың әкімшілері 5 жұмыс күні ішінде тиісті қаржыландыру жоспарларына өзгерістер енгізеді.

12. Қазақстан Республикасы Президентінің бастамаларына арналған резервтен бөлінген қаражатты пайдалану Қазақстан Республикасының Бюджет кодексінің талаптарына, Қазақстан Республикасы Қаржы министрінің 2014 жылғы 4 желтоқсандағы № 540 бұйрығымен (Нормативтік құқықтық актілерді мемлекеттік тіркеу тізілімінде № 9934 болып тіркелген) бекітілген Бюджеттің атқарылуы және оған кассалық қызмет көрсету ережесіне сәйкес жүзеге асырылады.

13. Қазақстан Республикасы Үкіметінің шешімі негізінде резервтен қаражат алған мемлекеттік органдар Қазақстан Республикасының бюджет заңнамасына сәйкес бөлінетін бюджеттік бағдарламаның кассалық шығыстарын қалпына келтіру арқылы пайдаланылмаған қаражатты қайтаруды жүзеге асырады.

14. Қазақстан Республикасы Президентінің орта мерзімді сипаттағы екінші және одан кейінгі жылдарға арналған бастамаларын қаржыландыру Қазақстан Республикасының бюджет заңнамасына сәйкес жүзеге асырылатын болады.

On approval of the Rules for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan

In accordance with paragraph 4 of Article 70-1 of the Budget Code of the Republic of Kazakhstan dated December 4, 2008, the Government of the Republic of Kazakhstan HEREBY RESOLVES:

1. To approve the attached Rules for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan.

2. This Resolution shall enter into force from the date of its first official publication.

Rules for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan

Chapter 1. General provisions

1. These Rules for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan (hereinafter- the Rules) have been developed in accordance with paragraph 4 of Article 70-1 of the Budget Code of the Republic of Kazakhstan and shall determine the procedure for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan.

2. The reserve for the initiatives of the President of the Republic of Kazakhstan shall be formed as part of the republican budget for the first year of the planning period to finance the annual addresses of the President of the Republic of Kazakhstan to the people of Kazakhstan and other initiatives of the President of the Republic of Kazakhstan.

3. The reserve for the initiatives of the President of the Republic of Kazakhstan shall be planned in the amount of up to two percent of the planned volume of expenditures of the republican budget for the next financial year.

4. The reserve for the initiatives of the President of the Republic of Kazakhstan shall be provided for under a separate allocated budget program administered by the central authorized body for budget planning.

Chapter 2. The procedure for allocation of the reserve for the initiatives of the President of the Republic of Kazakhstan

5. As part of the annual addresses of the President of the Republic of Kazakhstan to the people of Kazakhstan, the Government of the Republic of Kazakhstan and state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, when sending proposals to the Administration of the President of the Republic of Kazakhstan on the subject and content of the draft address of the President of the Republic of Kazakhstan in accordance with paragraph 3-2 section 1-1 of the Rules for the preparation, approval and submission to the President of the Republic of Kazakhstan of a draft address of the President of the Republic of Kazakhstan to the people of Kazakhstan, preparation, approval, submission for signature of draft acts and instructions of the President of the Republic of Kazakhstan, implementation of the address of the President of the Republic of Kazakhstan to the people of Kazakhstan, control over execution of acts and instructions of the President of the Republic of Kazakhstan, as well as instructions contained in the decisions of the Security Council of the Republic of Kazakhstan and the Assembly of the People of Kazakhstan, monitoring regulatory legal decrees of the President of the Republic of Kazakhstan, approved by the Decree of the President of the Republic of Kazakhstan dated April 27, 2010 No. 976, shall grant the needs of budgetary funds according to the proposals providing for financing.

6. After the announced annual addresses of the President of the Republic of Kazakhstan to the people of Kazakhstan and other initiatives of the President of the Republic of Kazakhstan, the relevant administrator of budget programs shall send to the central authorized body for budget planning a draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan, indicating the amount of funds and directions of expenses with the application of calculations and justifications in accordance with the budgetary legislation of the Republic of Kazakhstan.

With the simultaneous allocation of funds to several administrators of budget programs, a draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan shall be developed by the central authorized body for budget planning.

7. Consideration of the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan by the central authorized body for budget planning, submitted by the administrator of budget programs shall be carried out within 5 working days from the date of its receipt.

8. In case of submission of an incomplete package and/or comments on the submitted documents to the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan, the central authorized body for budget planning shall return the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from reserve for the initiatives of the President of the Republic of Kazakhstan for revision.

The administrator of budget programs shall submit a finalized draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan to the central authorized body for budget planning within 5 working days from the date of its return.

9. The administrator of budget programs shall ensure the completeness and reliability of the information and calculations attached to the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan.

10. The central authorized body for budget planning, based on the results of consideration of materials shall form a conclusion on the draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan and within 5 working days shall submit a conclusion for approval to the Administration of the President of the Republic of Kazakhstan.

After the approval of the conclusion by the Administration of the President of the Republic of Kazakhstan, the central authorized body for budget planning shall submit a draft resolution of the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan with a conclusion for consideration by the Republican budget commission in the manner established by the budget legislation of the Republic of Kazakhstan.

11. After taking the decision by the Government of the Republic of Kazakhstan on the allocation of funds from the reserve for the initiatives of the President of the Republic of Kazakhstan in the course of budget execution, the administrators of budget programs within 5 working days shall make changes to the relevant financing plans.

12. The use of funds allocated from the reserve for the initiatives of the President of the Republic of Kazakhstan shall be carried out in accordance with the requirements of the Budget Code, the provisions of the Rules for execution of the budget and its cash services, approved by the order of the Minister of Finance of the Republic of Kazakhstan dated December 4, 2014 No. 540 (registered in the register of state registration of regulatory legal acts under No. 9934).

13. State bodies that have received funds from the reserve on the basis of a decision of the Government of the Republic of Kazakhstan shall return unused funds by restoring cash expenses of the allocated budget program in accordance with the budget legislation of the Republic of Kazakhstan.

14. Financing of the initiatives of the President of the Republic of Kazakhstan, which have a medium-term nature, for the second and subsequent years shall be carried out in accordance with the budget legislation of the Republic of Kazakhstan.
