2. Банктік емес қаржы ұйымдарын реттеу департаменті (Көшербаева А.М.) Қазақстан Республикасының заңнамасында белгіленген тәртіппен:

1) Заң департаментімен (Сәрсенова Н.В.) бірлесіп осы қаулыны Қазақстан Республикасының Әділет министрлігінде мемлекеттік тіркеуді;

2) осы қаулы мемлекеттік тіркелген күннен бастап күнтізбелік он күн ішінде оны қазақ және орыс тілдерінде "Республикалық құқықтық ақпарат орталығы" шаруашылық жүргізу құқығындағы республикалық мемлекеттік кәсіпорнына ресми жариялау және Қазақстан Республикасы нормативтік құқықтық актілерінің эталондық бақылау банкіне енгізу үшін жіберуді;

3) осы қаулыны ресми жарияланғаннан кейін Қазақстан Республикасы Ұлттық Банкінің ресми интернет-ресурсына орналастыруды;

4) осы қаулы мемлекеттік тіркелгеннен кейін он жұмыс күні ішінде Заң департаментіне осы қаулының осы тармағының 2), 3) тармақшаларында және 3-тармағында көзделген іс-шаралардың орындалуы туралы мәліметтерді ұсынуды қамтамасыз етсін.

3. Қаржылық қызметтерді тұтынушылардың құқықтарын қорғау және сыртқы коммуникациялар басқармасы (Терентьев А.Л.) осы қаулы мемлекеттік тіркелгеннен кейін күнтізбелік он күн ішінде оның көшірмесін мерзімді баспасөз басылымдарында ресми жариялауға жіберуді қамтамасыз етсін.

2. Сақтандыру нарығы қатысушыларының өз қызметі туралы ақпаратты сақтанушыларға (сақтандырылушыларға, пайда алушыларға) және сақтандыру шартын жасасуға және (немесе) сақтандыру шарты бойынша сақтандыру оқиғасын реттеуге ниет білдірген адамдардың назарына жедел жеткізу интернет-ресурсты пайдаланудың мақсаты болып табылады.

3. Сақтандыру нарығының қатысушылары интернет-ресурста ақпаратты орналастыру кезінде:

1) сақтанушылардың (сақтандырылушылардың, пайда алушылардың) және сақтандыру шартын жасасуға және (немесе) сақтандыру шарты бойынша сақтандыру оқиғасын реттеуге ниет білдірген адамдардың, көзделмеген техникалық іркіліс жағдайларын қоспағанда, шектеусіз, ақпаратпен танысу және (немесе) өзге де тиімді пайдалану мақсатында сақтандыру нарығы қатысушысының интернет-ресурсында тәулік бойы онлайн-қолжетімділігін;

2) сақтандыру нарығы қатысушының интернет-ресурсында объективті, толық және дәйекті ақпарат беруді;

3) ақпаратты жоюдан, түрлендіруден және оған қолжетімділікті бұғаттаудан, сондай-ақ осындай ақпаратқа қатысты заңсыз іс-қимылдардан қорғау мақсатында ақпараттық қауіпсіздікті;

4) электрондық форматта орналастырылған құжатты сақтау және сақтанушылардың (сақтандырылушылардың, пайда алушылардың) және сақтандыру шартын жасасуға және (немесе) сақтандыру шарты бойынша сақтандыру оқиғасын реттеуге ниет білдірген адамдардың техникалық құралдарында одан мәтіннің еркін түрдегі үзіндісінің көшірмесін жасау мүмкіндігін;

5) интернет-ресурстың басты бетінен бастап гиперсілтемелер (оған сілтеме жасалған ақпаратты көрсете отырып) бойынша бірте-бірте өту арқылы ақпаратқа қолжетімділікті қамтамасыз етеді.

4. Сақтандыру нарығының қатысушылары интернет-ресурста орналастыратын ақпараттың тізбесі Қағидаларға қосымшаға сәйкес айқындалған.

5. Сақтандыру нарығы қатысушыларының интернет-ресурсында ақпарат қазақ және орыс тілдерінде, сондай-ақ қажет болғанда басқа тілдерде орналастырылады.

6. Сақтандыру нарығы қатысушысының интернет-ресурсында орындалатын барлық іс-әрекеттерді жауапты лауазымды тұлға немесе сақтандыру нарығы қатысушысының ішкі құжаттарына сәйкес тағайындалған тұлға жүзеге асырады.

Сақтандыру нарығының қатысушысы олардың орындалуының нақты уақытын көрсете отырып, бағдарламалық қамтамасыз етудің және технологиялық құралдардың көмегімен орындалған, жауапты лауазымды тұлғаның немесе сақтандыру нарығы қатысушысының ішкі құжаттарына сәйкес тағайындалған тұлғаның барлық іс-әрекетін есепке алуды қамтамасыз етуге мүмкіндік беретін операцияларды электрондық есепке алу журналын жүргізеді.

In accordance with the Law of the Republic of Kazakhstan “On Insurance Activities”, the Board of the National Bank of the Republic of Kazakhstan HEREBY RESOLVES:

1. To approve the attached Rules for posting information on the Internet resource of an insurance company, an insurance broker, a branch of an insurance (reinsurance) company-non-resident of the Republic of Kazakhstan, a branch of an insurance broker-non-resident of the Republic of Kazakhstan, an organization that guarantees insurance payments to policyholders (insured, beneficiaries) in case of liquidation of insurance companies, forced termination of activities of branches of insurance (reinsurance) companies-non-residents of the Republic of Kazakhstan, insurance ombudsman, organization for the formation and maintenance of a database.

2. In accordance with the procedure established by the legislation of the Republic of Kazakhstan, the Department for Regulation of Non-Bank Financial Organizations (Kosherbayeva A.M.) shall:

1) Jointly with the Legal Department (Sarsenova N.V.), ensure the state registration of this resolution with the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this resolution, send its copy in paper and electronic form both in the Kazakh and Russian languages to the Republican State Enterprise on the the Right of Economic Management "Republican Center of Legal Information" for official publication and inclusion in the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;

3) place this resolution on the Internet resource of the National Bank of the Republic of Kazakhstan after its official publication;

4) within ten working days after the state registration of this resolution , submit to the Legal Department the information on execution of activities, provided by subparagraph 2), 3) of this paragraph and paragraph 3 of this resolution. .

3. within ten calendar days after the state registration of this resolution, the Consumer Protection Office of Financial Services and External Communications (Terentiyev A.L.) shall send its copy to official publication in the periodic printed publications for official publication.

4. The supervising Deputy Chairman of the National Bank of the Republic of Kazakhstan Zh. B. shall be authorized to oversee the implementation of this resolution. .

5. This resolution shall be enforced from January 1, 2019 and shall be subject to official publication.

1. These Rules for posting information on the Internet resource of an insurance company, an insurance broker, a branch of an insurance (reinsurance) company-non-resident of the Republic of Kazakhstan, a branch of an insurance broker-non-resident of the Republic of Kazakhstan, an organization that guarantees insurance payments to policyholders (insured persons, beneficiaries) in case of liquidation of insurance companies, forced termination of activities of branches of insurance (reinsurance) companies-non-residents of the Republic of Kazakhstan, the insurance ombudsman, the organization for the formation and maintenance of a database (hereinafter - the Rules) have been developed in accordance with the Law of the Republic of Kazakhstan "On Insurance Activities" (hereinafter - the Law) and shall establish the procedure for posting information on the Internet resource of an insurance company, an insurance broker, a branch of an insurance (reinsurance) company-non-resident of the Republic of Kazakhstan, a branch of an insurance broker-non-resident of the Republic of Kazakhstan, an organization that guarantees insurance payments to policyholders (insured, beneficiaries) in case of liquidation of insurance companies, forced termination of activities of branches of insurance (reinsurance) companies-non-residents of the Republic of Kazakhstan, insurance ombudsman, organization for the formation and maintenance of a database (hereinafter – the participants in the insurance market).

2. The purpose of using the Internet resource shall be to promptly provide the participants of an insurance market with information about their activities to policyholders (insured, beneficiaries) and persons who intend to enter into an insurance contract and (or) settle an insured event under an insurance contract.

3. When posting information on an Internet resource, the participants of an insurance market shall ensure:

1) round-the-clock online access of policyholders (insured, beneficiaries) and persons who intend to enter into an insurance contract and (or) settle an insured event under an insurance contract to the Internet resource of an insurance market participant for familiarization and (or) other effective use of the information without restrictions, except in cases of unforeseen technical failures;

2) provision of objective, complete and reliable information on the Internet resource of an insurance market participant;

3) information security to protect information from destruction, modification and blocking of access to it, as well as other unlawful actions concerning such information;

4) the ability to save a document posted in electronic format and copy an arbitrary fragment of text from it onto the technical means of policyholders (insured, beneficiaries) and persons who intend to enter into an insurance contract and (or) settle an insured event under an insurance contract;

5) access to information by sequentially following hyperlinks (indicating the information to which it leads), starting from the main page of the Internet resource.

4. The list of information posted by the participants of the insurance market on the Internet resource shall be determined in accordance with the annex to the Rules.

5. Information on the Internet resource of participants of the insurance market shall be placed both in the Kazakh and Russian languages, as wellas, if necessary, in other languages.

6. All actions performed on the Internet resource of a participant of the insurance market shall be carried out by the responsible official or a person appointed in accordance with the internal documents of the participant of the insurance market.

The participant of the insurance market shall maintain an electronic transaction register carried out using software and technological means, allowing to record all actions of the responsible official or a person appointed in accordance with the internal documents of the insurance market participant, specifying the exact time of its execution.
