"Автомобиль жолдары туралы" 2001 жылғы 17 шілдедегі Қазақстан Республикасы Заңының 12-бабы 2-тармағының 42) тармақшасына сәйкес БҰЙЫРАМЫН:

1. Қоса беріліп отырған Жол дерекқорын қалыптастыру және жүргізу қағидалары бекітілсін.

2. Қазақстан Республикасы Индустрия және инфрақұрылымдық даму министрлігінің Автомобиль жолдары комитеті заңнамада белгіленген тәртіппен:

1) осы бұйрықты Қазақстан Республикасы Әділет министрлігінде мемлекеттік тіркеуді;

2) осы бұйрық мемлекеттік тіркелген күнінен бастап күнтізбелік он күн ішінде қазақ және орыс тілдерінде Қазақстан Республикасы Нормативтік құқықтық актілерінің эталондық бақылау банкіне ресми жариялау және енгізу үшін "Республикалық құқықтық ақпарат орталығы" шаруашылық жүргізу құқығындағы республикалық мемлекеттік кәсіпорнына жіберуді;

3) осы бұйрықты Қазақстан Республикасы Индустрия және инфрақұрылымдық даму министрлігінің интернет-ресурсында орналастыруды қамтамасыз етсін.

3. Осы бұйрықтың орындалуын бақылау жетекшілік ететін Қазақстан Республикасының Индустрия және инфрақұрылымдық даму вице-министріне жүктелсін.

4. Осы бұйрық алғашқы ресми жарияланған күнінен кейін күнтізбелік он күн өткен соң қолданысқа енгізіледі.

Жол дерекқорын қалыптастыру және жүргізу қағидалары

1-тарау. Жалпы ережелер

1. Осы Жол дерекқорын қалыптастыру және жүргізу қағидалары (бұдан әрі – Қағидалар) "Автомобиль жолдары туралы" 2001 жылғы 17 шілдедегі Қазақстан Республикасы Заңының (бұдан әрі – Заң) 12-бабы 2-тармағының 42) тармақшасына сәйкес әзірленді және жол дерекқорын қалыптастыру және жүргізу тәртібін айқындайды.

2. Осы Қағидаларда мынадай негізгі ұғымдар пайдаланылады:

1) автомобиль жолын диагностикалау – автомобиль жолдары мен жол құрылыстарының құрылымдық элементтерінің параметрлері мен жай-күйі, көлік ағындарының сипаттамалары туралы ақпаратты, ал қажет болған жағдайда жөндеу іс-шараларына мұқтаждығын айқындауға арналған өзге де ақпаратты зерттеп-қарау, жинау және талдау, сондай-ақ автомобиль жолын одан әрі пайдалану процесінде оның жай-күйін бағалау және болжау;

2) автомобиль жолының көліктік-пайдалану жай-күйі – жолдың техникалық деңгейін және пайдалану жай-күйін сипаттайтын және зерттеу сәтіне оның тұтыну қасиеттерін анықтайтын көрсеткіштер кешені;

3) автомобиль жолдарын паспорттау – техникалық паспортын жасай отырып және жол дерекқорын қалыптастырумен бірге автомобиль жолдарын және жасанды жол құрылыстарын есепке алу;

4) жол дерекқоры – автомобиль жолдары жөніндегі уәкілетті мемлекеттік органның автомобиль жолдарын пайдаланушылар үшін ашық, автомобиль жолдарының көлік-пайдалану жай-күйі туралы ақпаратты қамтитын ақпараттық жүйесі.

3. Жол дерекқорындағы ақпарат жол пайдаланушылар үшін ашық болып табылады және жалпы пайдаланымдағы автомобиль жолдарының желісін дамытуды жоспарлау, Қазақстан Республикасы автомобиль жолдарының схемаларын, карталарын, атластарын жасау және басқа да мақсаттарда пайдаланылады.

2-тарау. Жол дерекқорын қалыптастыру тәртібі

4. Жол дерекқорын қалыптастыру мыналарды қамтиды:

1) автомобиль жолдарын паспорттау;

2) автомобиль жолдарын диагностикалау;

3) автомобиль жолдарының техникалық параметрлері мен көліктік-пайдалану жай-күйі туралы ақпаратты жүктеу.

5. Жол дерекқоры электрондық түрде қалыптастырылады және автомобиль жолы туралы мынадай ақпаратты қамтиды:

1) автомобиль жолына арналған жалпы мәліметті;

2) жолдың көлденең және бойлық бейіні элементтерінің геометриялық параметрлері:

жамылғы типі бойынша учаскелер туралы;

жүру бөлігінің ені бойынша;

3-тарау. Жол дерекқорын жүргізу тәртібі

6. Жол дерекқорын жүргізуді өкілетті орган мынадай тәртіпте жүзеге асырады:

1) автомобиль жолдарын диагностикалау және паспорттауды ұйымдастыру және жүргізу, сондай-ақ алынған деректерді өңдеу есептік жылда есептік жылдың 1 қазанынан кешіктірмей;

2) автомобиль жолдарын диагностикалау және паспорттау қорытындылары бойынша жол дерекқорына өзгерістер мен (немесе) толықтыруларды есептік жылдың 1 желтоқсанына дейін енгізу.

3) автомобиль жолдарын жөндеу және күтіп-ұстауға арналған бюджеттік шығындарын есептік жылдың 31 желтоқсанынан кешіктірмей жоспарлау.

7. Жол дерекқоры үшін деректерді жинау жұмыстарын жүргізу кезеңділігі мынадай тәртіпте жүзеге асырылады:

1) Автомобиль жолын паспорттау – кемінде 5 жылда бір рет немесе салудан, реконструкциялаудан, сондай-ақ күрделі жөндеуден кейін;

2) Автомобиль жолын диагностикалау кемінде 3 жылда бір рет немесе салудан, реконструкциялаудан, сондай-ақ күрделі жөндеуден кейін оны пайдалануға қабылдап алғанға дейін.

In accordance with subparagraph 42) of paragraph 2 of Article 12 of the Law of the Republic of Kazakhstan dated July 17, 2001 "On Automobile Roads" I ORDER:

1. To approve the attached Rules for formation and maintenance of the road database.

2. The roads Committee of the Ministry of Industry and Infrastructural Development of the Republic of Kazakhstan in the order established by the legislation shall ensure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) sending of this order in the Kazakh and Russian languages to the Republican state enterprise on the right of economic management "Republican Center for Legal Information" for official publication and inclusion to the Standard control bank of regulatory legal acts of the Republic of Kazakhstan within ten calendar days from the date of state registration;

3) placement of this order on the Internet resource of the Ministry of Industry and Infrastructural Development of the Republic of Kazakhstan.

3. Control over the execution of this order shall be assigned to the supervising Vice-Minister of Industry and Infrastructural Development of the Republic of Kazakhstan.

4. This order shall be enforced upon expiry of ten calendar days after its first official publication.

Rules for formation and maintenance of the road database
Chapter 1. General provisions

1. These Rules for formation and maintenance of the road database (hereinafter – the Rules) are developed in accordance with subparagraph 42) of paragraph 2 of Article 12 of the Law of the Republic of Kazakhstan dated July 17, 2001 "On Automobile Roads" (hereinafter – the Law) and shall determine the procedure for formation and maintenance of the road database.

2. The following basic definitions shall be used in these Rules:

1) automobile road diagnostics - inspection, collection and analysis of information on the parameters and condition of structural elements of automobile road and road structures, characteristics of traffic flows, and, if necessary, other information to determine the need for repair measures, as well as assessment and forecast of the state of automobile road in the process of its further operation;

2) transport and operational state of automobile road – a set of indicators, characterizing technical level and operational state of the road and determining its consumer properties at the time of inspection;

3) passportization of automobile roads- registration of automobile roads and artificial road structures with preparation of a technical passport and formation of a road database;

4) a road database – an information system of the authorized state body for automobile roads, open to road users, containing information on the transport and operational state of automobile roads.

3. The information, contained in the road database shall be open for road users and shall be used for planning the development of public roads network, formation of schemes, maps, atlases of automobile roads of the Republic of Kazakhstan.

Chapter 2. Procedure for formation of a road database

4. Formation of a road database shall include:

1) passportization of automobile road;

2) automobile roads diagnostics;

3) downloading of information on technical parameters and transport- operational state of automobile roads.

5. A road database shall be formed electronically and contain the following information about the road:

1) general information about the road;

2) geometric parameters of elements of the longitudinal and transverse road profile:

about the sites by types of coverage;

on the width of the roadway;

on the width of the roadbed;

on the width of the dividing strip;

on the height of the edge of the roadbed and the steepness of the slopes;

on the roadsides;

on the longitudinal slopes;

on the curves in the plan and turns;

on the areas with insufficient visibility;

3) on the designs of road dressings;

4) on the intersection, junction and exits (entrances);

5) on the presence of intersections with the railway;

6) on retaining walls;

7) on protective structures;

8) on drainage trays;

9) on roadside services;

10) on gardening;

11) on the objects of road service;

12) on pedestrian crossings;

13) on the sidewalks;

14) on recreation areas, parking lots;

15) on bus stops and car pavilions;

16) on transition-speed and additional lanes;

17) on lighting;

18) on fences;

19) on signal posts;

20) on road signs;

21) on traffic lights;

22) on guiding devices;

23) on road marking;

24) on communications in the diversion lane;

25) on information signs and billboards;

26) on kilometer columns;

27) on ferry services;

28) on bridges and overpasses;

29) on culverts;

30) through tunnels;

31) on settlements;

32) by coordinates;

33) a bridge (overpass) card);

34) a culvert card;

35) on the places of traffic accidents concentration;

36) on traffic intensity measurements;

37) on the assessment of state of the roadbed and drainage system;

38) on the assessment of road surfaces evenness;

39) on the assessment of road dressings strength;

40) on the assessment of road surfaces adhesion;

41) on the road surface defects;

42) on the assessment of road surfaces rut;

43) on culvert defects;

44) on bridge defects;

45) on technical state of the bridge.

Chapter 3. Procedure for maintenance of a road database

6. Maintenance of a road database shall be carried out by the authorized body in the following order:

1) organization and conducting of diagnostics and passportization of automobile roads, as well as processing of the received data in the reporting year no later than October 1 of the reporting year;

2) making changes and (or) additions to the road database based on the results of diagnostics and passportization of automobile roads before December 1 of the reporting year;

3) planning of budget expenditures for repair and maintenance of automobile roads no later than December 31 of the reporting year.

7. The frequency of data collection for the road database shall be carried out:

1) passportization of automobile road - not less than in 5 years or after construction, reconstruction, as well as capital repairs;

2) diagnostics of automobile road at least 3 years or after construction, reconstruction, and also capital repairs before its acceptance into operation.
