"Халық денсаулығы және денсаулық сақтау жүйесі туралы" Қазақстан Республикасының 2020 жылғы 7 шілдедегі Кодексінің 205-бабы 1-тармағына сәйкес БҰЙЫРАМЫН:

1. Осы бұйрыққа 1-қосымшаға сәйкес Донорларды медициналық куәландыруға, медициналық қолдану үшін қан өнімдерін өндіру кезіндегі қауіпсіздік пен сапаға қойылатын талаптар бекітілсін.

2. "Донорларды медициналық куәландыруға және медициналық қолдану үшін қан өнімдерін өндіру кезіндегі қауіпсіздікке және сапаға қойылатын талаптарды бекіту туралы" Қазақстан Республикасы Денсаулық сақтау министрінің 2019 жылғы 15 сәуірдегі № ҚР ДСМ-34 бұйрығының (Нормативтік құқықтық актілерін мемлекеттік тіркеу тізілімінде № 18524 болып тіркелген, Қазақстан Республикасының Нормативтік құқықтық актілерінің эталондық бақылау банкіде 2019 жылғы 22 сәуірде электрондық түрде жарияланған).

3. Қазақстан Республикасы Денсаулық сақтау министрлігінің Медициналық көмекті ұйымдастыру департаменті Қазақстан Республикасының заңнамасында белгіленген тәртіппен:

1) осы бұйрықты Қазақстан Республикасы Әділет министрлігінде мемлекеттік тіркеуді;

2) осы бұйрықты Қазақстан Республикасы Денсаулық сақтау министрлігінің интернет-ресурсына орналастыруды;

3) осы бұйрықты мемлекеттік тіркегеннен кейін он жұмыс күні ішінде Қазақстан Республикасы Денсаулық сақтау министрлігінің Заң департаментіне осы тармақтың 1) және 2) тармақшаларында көзделген іс-шаралардың орындалғаны туралы мәліметтерді ұсынуды қамтамасыз етсін.

4. Осы бұйрықтың орындалуын бақылау Қазақстан Республикасының Денсаулық сақтау вице-министрі А.Ғиниятқа жүктелсін.

5. Осы бұйрық алғашқы ресми жарияланған күнінен кейін күнтізбелік он күн өткен соң қолданысқа енгізіледі.

1-тарау. Жалпы ережелер

1. Осы Қан мен оның компоненттерін донациялауды өтеулі негізде орындайтын донорларға төленетін төлемдердің қағидалары, өлшемшарттары "Халық денсаулығы және денсаулық сақтау жүйесі туралы" Қазақстан Республикасының 2020 жылғы 7 шілдедегі № 360-VІ ҚРЗ Кодексі 208-бабының 7 және 9-тармақтарына сәйкес әзірленді және қан мен оның компоненттерін донациялауды өтеулі негізде орындайтын донорларға төленетін төлемдердің тәртібін, өлшемшарттарын белгілейді.

2-тарау. Қан мен оның компоненттерін донациялауды өтеулі негізде орындайтын донорларға төленетін төлемдердің қағидалары, өлшемшарттары

2. Қан қызметі ұйымы мен оның компоненттерін донациялауды өтеулі негізде жүзеге асырған донорға төленетін төлемді, сондай-ақ қанды және (немесе) оның компоненттерін донациялауды өтеусіз негізде жүзеге асырған донорға берілетін тегін тамақтың ақшалай баламасының мөлшерін төлеуді жүргізеді.

3. Төлем екі әдіспен: қолма-қол және қолма-қол қаражатсыз жүзеге асырылады.

Қолма-қол қаражатпен есеп айырысу қан және оның компоненттерін донациялау күні, қолма-қол қаражатсыз - қан және оның компоненттерінің донациялау күнінен бастап екі банктік күннің ішінде жүзеге асырылады.

Қолма-қол қаражатсыз төлем кезінде донор екінші деңгейдегі банкілердің карталық базасында ағымдағы шот ашуды растайтын құжатты ұсынылады.

4. Өтеулі донордың плазмасында плазманы донациялау кезінде центрифугалау әдісімен қанның формалық элементтерінен бөлгеннен кейін көзбен хилез (ылайлау, опалесцирлеуші, ақшыл түстен ақ түске дейін) анықталған кезде төлем жүзеге асырылмайды.

5. Қан қызметі ұйымдарының қажеттілігі бойынша донорларды мынадай өлшемшарттар кезінде қан және оның компоненттерінің донациясына шақырады:

1) қанда құжатпен расталған белглі антигендік сипаттамалардың бар болуы (АВО жүйесі бойынша әмбебап қан тобы, резус-теріс тиістілік немесе қан компоненттері дайындалатын әлеуетті реципиентпен қан антигендері бойынша ұқсастық);

2) қанның қажетті антигендік сипаттамаларын ескере отырып, әлеуетті донорларды жқмыстан тыс уақытта (түнгі сағаттар, демалыс және мереке күндері) шұғыл түрде шақырған жағдайда;

3) белгілі бір топтағы және резус-тиістілігі бойынша қан компоненттеріне ұзақ мерзімді және жоғары қажеттілік туындаған жағдайда.

Қан мен оның компоненттерін донациялауды өтеулі негізде орындайтын донорларға төленетін төлемдердің мөлшері

Қан мен оның компоненттерін донациялауды өтеулі негізде жүзеге асыратын донорларға төленетін төлемдердің мөлшері (тиісті қаржы жылына арналған республикалық бюджет туралы заңмен белгіленген айлық есептік көрсеткіштер):

1) бір реттік қан донациясы үшін (450 миллилитр ± 10 %) - 2 айлық есептік көрсеткіш;

2) екі реттік плазмаферез кезінде бір реттік плазма донациясы үшін (550 ± 50 миллилитр плазма) - 4 айлық есептік көрсеткіш;

3) екі реттік плазмаферез кезінде бір реттік иммундық плазма донациясы үшін (550 ± 50 миллилитр иммундық плазма) - 7 айлық есептік көрсеткіш;

4) екі реттік плазмаферез кезінде 1: 64-тен төмен емес резус антиденелер титрімен изоиммундық плазманың бір реттік донациясы үшін (550 ± 50 миллилитр изоиммундық плазма) - 8 айлық есептік көрсеткіш;

5) аппараттық цитаферез кезінде тромбоциттердің бір дозасының бір реттік (дозадағы тромбоциттердің саны кемінде 200 х 109) донациясы үшін - 1 айлық есептік көрсеткіш;

6) аппараттық цитаферез кезінде эритроциттердің бір дозасының бір реттік (дозада кемінде 45 грамм гемоглобин) донациясы үшін - 2 айлық есептік көрсеткіш.

7) осы тармақтың 1), 2), 3), 4) тармақшаларында белгіленген көлемнен аз көлемдегі донациялау кезінде төлем осы тармақтың 1), 2), 3), 4) тармақшаларында көрсетілген мөлшерге барабар жүзеге асырылады.

Қанды және (немесе) оның компоненттерін донациялауды өтеусіз негізде жүзеге асырған донорға берілетін тегін тамақтың ақшалай баламасының мөлшері

Қанды және (немесе) оның компоненттерін донациялауды өтеусіз негізде жүзеге асырған донорға берілетін тегін тамақтың ақшалай баламасы не тиісті қаржы жылына арналған республикалық бюджет туралы заңмен белгіленген айлық есептік көрсеткіштің 0,25 мөлшерін құрайды.

In accordance with paragraphs 7 and 9 of Article 208 of the Code of the Republic of Kazakhstan “On Public Health and the Healthcare System” as of July 7, 2020, I hereby ORDER:

1. To approve:

1) the rules, criteria for payments to donors who donate blood and its components on a reimbursable basis in accordance with Appendix 1 to this order;

2) the amount of payments to donors who donate blood and its components on a reimbursable basis in accordance with Appendix 2 to this order;

3) the amount of the monetary value of free meal to a donor who donated blood and (or) its components on a gratuitous basis in accordance with Appendix 3 to this order.

2. To invalidate:

1) Order № 374 of the Minister of Healthcare and Social Development of the Republic of Kazakhstan as of May 22, 2015 “On approval of the rules for the implementation and amount of payments to donors of blood and its components that perform a donor function on a gratuitous and reimbursable bases” (registered in the State Registration Register of Regulatory Legal Acts under № 11424, published on July 23, 2015 in the “Adilet” Legal Information System);

2) paragraph 4 of the list of some amended orders of the Ministry of Healthcare of the Republic of Kazakhstan, which is approved by Order № KR DSM-62 of the Ministry of Healthcare of the Republic of Kazakhstan as of May 4, 2019 “On amendments to some orders of the Ministry of Healthcare and Social Development of the Republic Kazakhstan” (registered in the State Registration Register of Regulatory Legal Acts under № 18637, published in electronic form on May 23, 2019 in the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan).

3. In accordance with the procedure established by the legislation of the Republic of Kazakhstan, the Department for Organization of Medical Aid of the Ministry of Healthcare of the Republic of Kazakhstan shall ensure:

1) the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) the posting of this order on the website of the Ministry of Healthcare of the Republic of Kazakhstan;

3) the submission of information on the implementation of the measures provided for in subparagraphs 1) and 2) of this paragraph to the Legal Department of the Ministry of Healthcare of the Republic of Kazakhstan within ten working days of state registration of this order.

4. Control over the execution of this order shall be entrusted to the deputy minister of healthcare of the Republic of Kazakhstan, A.Giniyat.

5. This order comes into effect ten calendar days of its first official publication.

Rules, criteria for the amount of payments to donors who donate blood and its components on a reimbursable basis

Chapter 1. General provisions

1. These rules, criteria for payments to donors who donate blood and its components on a reimbursable basis are developed in accordance with paragraphs 7 and 9 of Article 208 of the Code of the Republic of Kazakhstan “On Public Health and the Healthcare System” as of July 7, 2020 and establish the procedure, criteria for payments donors who donate blood and its components on a reimbursable basis.

Chapter 2. Rules, criteria for payments to donors who donate blood and its components on a reimbursable basis

2. The blood service facility makes a payment to a donor who donated blood and its components on a reimbursable basis, and also pays the monetary value of a free meal to a donor who donated blood and (or) its components on a gratuitous basis.

3. A payment is made in two ways: in cash and through a bank.

Payment in cash is made on the day of donation of blood and its components; payment though a bank within two banking days of donation of blood and its components.

In case of payment through a bank, a donor provides a document confirming the opening of a current account in the card database of second-tier banks.

4. In case of visual identification of lacteous serum (cloudy, opalescent, from whitish to milky) in plasma from a paid donor after its separation from blood cells by centrifugation during plasma donation, payment is not made.

5. Taking into account the needs of the blood service facility, donors are invited to donate blood and its components on a reimbursable basis, subject to the following criteria:

1) the presence of confirmed documented antigenic characteristics of blood (universal blood group according to the ABO system, Rh-negative affiliation or identity with respect to blood antigens with a potential recipient for whom blood components are procured);

2) in the event of an emergency invitation of potential donors after working hours (at night, on weekends and holidays), taking into account the necessary antigenic characteristics of the blood;

3) in the case of a long and high demand for blood components of a certain group and Rh-affiliation.

The amount of payments to donors who donate blood and its components on a reimbursable basis

The amount of payments to donors who donate blood and its components on a reimbursable basis (monthly calculation indices established by the law on the republican budget for the corresponding financial year) is as follows:

1) for a single blood donation (450 milliliters ± 10%) - 2 monthly calculation indices;

2) for a single donation of plasma with double plasmapheresis (550 ± 50 milliliters of plasma) - 4 monthly calculation indices;

3) for a single donation of immune plasma with double plasmapheresis (550 ± 50 milliliters of immune plasma) - 7 monthly calculation indices;

4) for a single donation of isoimmune plasma with a Rh antibody titer of at least 1: 64 with double plasmapheresis (550 ± 50 milliliters of isoimmune plasma) - 8 monthly calculation indices;

5) for a single donation of one dose of platelets (the number of platelets in a dose is at least 200 x 109) with apparative cytapheresis - 1 monthly calculation index;

6) for a single donation of one dose of erythrocytes (in a dose of at least 45 grams of hemoglobin) with apparative cytapheresis - 2 monthly calculation indices.

7) when donating a volume less than that specified in subparagraphs 1), 2), 3), 4) of this paragraph, the payment is made in proportion to the amount specified in subparagraphs 1), 2), 3), 4) of this paragraph.

The amount of the monetary value of a free meal to a donor who donated blood and its components on a gratuitous basis

The amount of the monetary value of free meal to a donor who donated blood and (or) its components on a gratuitous basis is 0.25 monthly calculation index established by the law on the republican budget for the corresponding financial year.
