В целях реализации Закона Республики Казахстан от 5 июля 2001 года "О Государственной премии мира и прогресса Первого Президента Республики Казахстан - Елбасы" постановляю:

1. Утвердить прилагаемые:

1) Положение о Государственной премии мира и прогресса Первого Президента Республики Казахстан - Елбасы;

2) персональный состав Комиссии по присуждению Государственной премии мира и прогресса Первого Президента Республики Казахстан - Елбасы.

2. Признать утратившими силу:

1) постановление Президента Республики Казахстан от 31 августа 1992 г. № 903 "О Президентской премии мира и духовного согласия" (САПП Республики Казахстан, 1992 г., № 31, ст.471);

2) постановление Президента Республики Казахстан от 20 октября 1994 года № 1949 "О внесении изменений в постановление Президента Республики Казахстан от 31 августа 1992 г. № 903" (САПП Республики Казахстан, 1994 г., № 42, ст. 454);

3) Указ Президента Республики Казахстан от 24 октября 1997 года № 3716 "О внесении изменений в постановление Президента Республики Казахстан от 31 августа 1992 г. № 903 "О присуждении Президентской премии мира и духовного согласия" (САПП Республики Казахстан, 1997 г., № 47, ст. 435).

3. Настоящий Указ вступает в силу со дня подписания.

Положение о Государственной премии мира и прогресса
Первого Президента Республики Казахстан - Елбасы

1. Государственная премия мира и прогресса Первого Президента Республики Казахстан - Елбасы (далее - Государственная премия) присуждается:

за активную деятельность, направленную на укрепление мира и дружбы, взаимного доверия между народами, равенства и одинаковой безопасности в межгосударственных отношениях;

за особый вклад в утверждение общественного и межнационального согласия, укрепление единства многонационального народа Республики;

за развитие демократии и социального прогресса;

за глубокие публицистические произведения, формирующие уважение к культуре и историческим традициям наций и народностей Казахстана.

2. Государственная премия присуждается ежегодно гражданам Республики Казахстан и иностранцам, а также может быть присуждена отечественным, международным и иностранным организациям.

3. Лицам, удостоенным Государственной премии, присваивается звание "Лауреат Государственной премии мира и прогресса Первого Президента Республики Казахстан - Елбасы", вручается диплом, нагрудный знак, удостоверение и денежное вознаграждение.

4. Размер Государственной премии составляет 6000 (шесть тысяч) месячных расчетных показателей и выплачивается из средств республиканского бюджета.

5. Государственная премия может присуждаться одновременно нескольким соискателям, в этом случае ее денежная часть делится поровну между ними. Повторное присуждение Государственной премии не допускается.

Ранее отклоненные соискатели могут быть выдвинуты повторно на присуждение Государственной премии.

6. Государственная премия вручается в торжественной обстановке Президентом Республики Казахстан ко Дню Первого Президента Республики Казахстан.

7. Правом выдвижения на соискание Государственной премии обладают:

комитеты Сената и Мажилиса Парламента Республики Казахстан;

Правительство Республики Казахстан;

государственные органы, непосредственно подчиненные и подотчетные Президенту Республики Казахстан;

акимы областей (городов республиканского значения и столицы) по согласованию с маслихатами;

отечественные, иностранные и международные организации.

8. Для отбора кандидатов на соискание Государственной премии создается Комиссия по присуждению Государственной премии мира и прогресса Первого Президента Республики Казахстан - Елбасы (далее - Комиссия) из числа государственных, общественных деятелей и иных лиц.

9. Комиссия является консультативно-совещательным органом при Президенте Республики Казахстан.

10. Правовую основу деятельности Комиссии составляют Конституция, законодательные акты Республики Казахстан, акты Президента Республики Казахстан и настоящее Положение. U962935_

Основные задачи Комиссии

11. Основными задачами Комиссии являются:

1) рассмотрение поступивших предложений по присуждению Государственной премии;

2) рекомендация соискателей, достойных присуждения Государственной премии, Президенту Республики Казахстан.

Права и обязанности Комиссии

12. Комиссия вправе в установленном порядке:

1) знакомиться с деятельностью и творчеством соискателей по месту жительства или работы;

2) запрашивать необходимые для осуществления своей деятельности документы, материалы и иную информацию в государственных органах и иных организациях;

3) при необходимости приглашать и заслушивать представителей государственных органов и иных организаций;

4) вносить предложения Президенту Республики Казахстан по совершенствованию механизма присуждения Государственной премии.

Комиссия обязана:

1) принимать документы соискателей, выдвинутых на присуждение Государственной премии;

2) публиковать в официальных изданиях после окончания приема документов список соискателей, краткие сведения об их деятельности с указанием выдвинувших их организаций;

3) способствовать широкому и открытому обсуждению деятельности соискателей среди общественности;

4) рассматривать внесенные на соискание Государственной премии кандидатуры и готовить рекомендации по количеству лауреатов Государственной премии в текущем году и причитающемуся им денежному вознаграждению;

5) обеспечивать в установленном порядке разработку проекта Указа Президента Республики Казахстан о присуждении Государственной премии и представление его на рассмотрение в Администрацию Президента Республики Казахстан.

Организация работы Комиссии

13. Комиссию возглавляет председатель, назначаемый Президентом Республики Казахстан. В период отсутствия председателя Комиссии его обязанности исполняет заместитель председателя Комиссии.

14. Председатель Комиссии:

1) организует и осуществляет руководство деятельностью Комиссии;

2) формирует повестку дня заседаний Комиссии;

3) созывает заседания Комиссии и председательствует на них;

4) из числа членов Комиссии определяет докладчика по вопросу, включенному в повестку дня заседания Комиссии;

5) выполняет иные полномочия в рамках компетенции Комиссии.

15. Секретарь Комиссии:

1) обеспечивает проведение заседания Комиссии;

2) информирует членов Комиссии о повестке дня, месте и времени проведения заседания Комиссии;

3) предоставляет членам Комиссии поступившие документы;

4) исполняет поручения председателя Комиссии;

5) организует тайное голосование членов Комиссии по представленным кандидатурам соискателей.

16. Заседания Комиссии проводятся по мере необходимости. Заседание Комиссии считается правомочным, если на нем присутствует не менее двух третей от общего числа членов Комиссии.

17. Решение Комиссии принимается большинством голосов при тайном голосовании. При равенстве голосов голос председательствующего является решающим.

18. Решение Комиссии оформляется протоколом и подписывается председателем Комиссии.

19. Акт Президента Республики Казахстан о присуждении Государственной премии публикуется в официальных изданиях.

Обеспечение деятельности Комиссии

20. Организационное и информационное обеспечение деятельности Комиссии осуществляет Министерство культуры и спорта Республики Казахстан.

With a view to implementation of the Law of the Republic of Kazakhstan dated July 5, 2001 "On the State Prize of Peace and Progress of the First President of the Republic of Kazakhstan - Elbasy" hereby I resolve:

1. To approve the attached:

1) Regulations on the State Prize of Peace and Progress of the First President of the Republic of Kazakhstan - Elbasy;

2) personal composition of the Commission for awarding the State Prize of Peace and Progress of the First President of the Republic of Kazakhstan - Elbasy.

2. To recognize as terminated:

1) Resolution of the President of the Republic of Kazakhstan dated August 31, 1992 No. 903 "On the Presidential Prize for Peace and Spiritual Accord" (CAPG of the Republic of Kazakhstan, 1992, No. 31, art. 471);

2) Resolution of the President of the Republic of Kazakhstan dated October 20, 1994 No. 1949 "On Amending Resolution of the President of the Republic of Kazakhstan dated August 31, 1992 No. 903" (CAPG of the Republic of Kazakhstan, 1994, No. 42, art. 454);

3) Decree of the President of the Republic of Kazakhstan dated October 24, 1997 No. 3716 "On Amendments to Decree of the President of the Republic of Kazakhstan dated August 31, 1992 No. 903 "On Awarding the Presidential Prize for Peace and Spiritual Accord" (CAPG of the Republic of Kazakhstan, 1997, No. 47, art. 435).

3. This Decree shall come into effect from the date of signing.

Regulations on the State Prize of Peace and Progress of the
First President of the Republic of Kazakhstan - Elbasy

1. The State Prize of Peace and Progress of the First President of the Republic of Kazakhstan - Elbasy (hereinafter referred to as the State Prize) shall be awarded:

for active work aimed at strengthening peace and friendship, mutual trust between peoples, equality and equal security in interstate relations;

for a special contribution to the establishment of social and interethnic harmony, strengthening the unity of the multinational people of the Republic;

for the development of democracy and social progress;

for deep publicistic works that form respect for the culture and historical traditions of the nations and peoples of Kazakhstan.

2. The State Prize shall be awarded annually to citizens of the Republic of Kazakhstan and foreigners, and may be awarded to domestic, international, and foreign organizations.

3. Persons awarded the State Prize shall be awarded the title "Laureate of the State Prize of Peace and Progress of the First President of the Republic of Kazakhstan - Elbasy", a diploma, badge, certificate and monetary reward.

4. The amount of the State Prize shall be 6,000 (six thousand) monthly calculation indices and shall be paid from the republican budget.

5. The State Prize may be awarded simultaneously to several applicants, in this case its monetary portion shall be divided equally between them. Re-awarding the State Prize shall be prohibited.

Previously rejected applicants may be re-nominated for the State Prize.

6. The State Prize shall be awarded in a solemn atmosphere by the President of the Republic of Kazakhstan on the Day of the First President of the Republic of Kazakhstan.

7. The right to nominate for the State Prize shall be possessed by:

the committees of the Senate and Mazhilis of the Parliament of the Republic of Kazakhstan;

the Government of the Republic of Kazakhstan;

the state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan;

akims of regions (cities of republican significance and the capital) in agreement with maslikhats;

domestic, foreign and international organizations.

8. To select candidates for the State Prize, the Commission to award the State Prize of Peace and Progress of the First President of the Republic of Kazakhstan - Elbasy (hereinafter - the Commission) shall be created from among statesmen, public figures and other persons.

9. The Commission shall be a consultative and advisory body under the President of the Republic of Kazakhstan.

10. The legal basis of the Commission's activities shall be the Constitution, legislative acts of the Republic of Kazakhstan, and the acts of the President of the Republic of Kazakhstan and this Regulation.

The main tasks of the Commission

11. The main tasks of the Commission shall be:

1) consideration of the received proposals for the award of the State Prize;

2) recommendation of eligible applicants of the State Prize to the President of the Republic of Kazakhstan.

Rights and obligations of the Commission

12. The Commission has the right in the prescribed manner to:

1) get acquainted with the activities and works of applicants at the place of residence or work;

2) request documents, materials and other information necessary for the implementation of their activities in state bodies and other organizations;

3) if necessary, invite and hear representatives of state bodies and other organizations;

4) make proposals to the President of the Republic of Kazakhstan to improve the mechanism for awarding the State Prize.

The commission is obliged to:

1) accept the documents of applicants nominated for the award of the State Prize;

2) publish in official publications after the end of the acceptance of documents, the list of applicants, brief information on their activities with an indication of the organizations that nominated them;

3) facilitate a broad and open discussion of the activities of applicants among the public;

4) consider the nominations submitted for the State Prize and prepare recommendations on the number of State Prize laureates in the current year and with the monetary reward that is entitled to them;

5) ensure, in the prescribed manner, the development of a draft Decree of the President of the Republic of Kazakhstan on awarding the State Prize and its submission for consideration to the Administration of the President of the Republic of Kazakhstan.

Organization of the work of the Commission

13. The Commission shall be headed by the Chairperson appointed by the President of the Republic of Kazakhstan. During the absence of the Chairperson of the Commission, his duties shall be performed by the Deputy Chairperson of the Commission.

14. Chairperson of the Commission shall:

1) organize and manage the activities of the Commission;

2) form the agenda of the meetings of the Commission;

3) convene meetings of the Commission and preside over them;

4) from among the members of the Commission, determine the rapporteur on the issue included in the agenda of the Commission meeting;

5) perform other powers within the competence of the Commission.

15. Secretary of the Commission shall:

1) ensure the holding of a meeting of the Commission;

2) inform the members of the Commission on the agenda, place and time of the meeting of the Commission;

3) provide the members of the Commission with the received documents;

4) execute the instructions of the Chairperson of the Commission;

5) organize a secret ballot of the members of the Commission on the submitted candidates.

16. Meetings of the Commission shall be held as required. The meeting of the Commission shall be considered competent if attended by at least two thirds of the total number of members of the Commission.

17. The decision of the Commission shall be adopted by a majority vote by secret ballot. In case of equality of votes, the vote of the Chairperson shall be decisive.

18. The decision of the Commission shall be formalized in the minutes and signed by the Chairperson of the Commission.

19. The act of the President of the Republic of Kazakhstan on awarding the State Prize shall be published in official publications.

Ensuring the activities of the Commission

20. Organizational and informational support of the Commission activities shall be carried out by the Ministry of Culture and Sports of the Republic of Kazakhstan.
