Об утверждении Правил разработки единых технологических процессов работы подъездных путей и станций примыкания

Приказ Министра индустрии и инфраструктурного развития Республики Казахстан от 20 июня 2019 года № 415. Зарегистрирован в Министерстве юстиции Республики Казахстан 21 июня 2019 года № 18882.

В соответствии с подпунктом 34-36) пункта 2 статьи 14 Закона Республики Казахстан от 8 декабря 2001 года "О железнодорожном транспорте" ПРИКАЗЫВАЮ:

1. Утвердить прилагаемые Правила разработки единых технологических процессов работы подъездных путей и станций примыкания.

2. Комитету транспорта Министерства индустрии и инфраструктурного развития Республики Казахстан в установленном законодательством порядке обеспечить:

1) государственную регистрацию настоящего приказа в Министерстве юстиции Республики Казахстан;

2) в течение десяти календарных дней со дня государственной регистрации настоящего приказа направление на казахском и русском языках в Республиканское государственное предприятие на праве хозяйственного ведения "Институт законодательства и правовой информации Республики Казахстан" для официального опубликования и включения в Эталонный контрольный банк нормативных правовых актов Республики Казахстан;

3) размещение настоящего приказа на интернет-ресурсе Министерства индустрии и инфраструктурного развития Республики Казахстан.

3. Контроль за исполнением настоящего приказа возложить на курирующего вице-министра индустрии и инфраструктурного развития Республики Казахстан.

4. Настоящий приказ вводится в действие по истечении десяти календарных дней после дня его первого официального опубликования.

Правила разработки единых технологических процессов работы подъездных путей и станций примыкания

Глава 1. Общие положения

1. Настоящие Правила разработки единых технологических процессов работы подъездных путей и станций примыкания (далее – Правила) разработаны в соответствии с подпунктом 34-36) пункта 2 статьи 14 Закона Республики Казахстан от 8 декабря 2001 года "О железнодорожном транспорте" (далее – Закон) и определяют порядок разработки единых технологических процессов работы подъездных путей и станций примыкания (далее – единый технологический процесс).

2. Разработка единых технологических процессов осуществляется для обеспечения согласованной, технико-технологической работы подъездных путей организаций обслуживаемых собственными локомотивами со среднесуточным грузооборотом 50 (пятьдесят) вагонов и более.

3. Под единым технологическим процессом понимается документ (в произвольной форме), регламентирующий условия взаимодействия подъездного пути и станции примыкания, необходимые для заключения договора на подачу – уборку вагонов.

Глава 2. Порядок разработки единых технологических процессов работы подъездных путей и станций примыкания

4. Единый технологический процесс разрабатывается посредством взаимодействия участников перевозочного процесса на основании заключаемых договоров в соответствии с гражданским законодательством Республики Казахстан, законодательством Республики Казахстан о железнодорожном транспорте и международными соглашениями (договорами).

5. Единый технологический процесс содержит четкий и не подлежащий различному толкованию смысл.

6. Для обеспечения однообразия разрабатываемых единых технологических процессов, включает следующую информацию:

1) техническая и эксплуатационная характеристика сооружений и устройств подъездных путей и станции примыкания;

2) размеры грузовых и вагонных потоков, рассчитанные исходя из фактического и максимального планового (из предстоящих трех лет) объема перевозок грузов, кроме предприятий с планово – снижающимися объемами производства;

3) организация маневровой работы и расчет норм на выполнение технических операций;

4) осуществление кооперированного использования технических средств, сооружений и устройств подъездного пути и станции примыкания;

5) организация подачи-уборки вагонов;

6) графики обработки вагонов, передач и поездов;

7) графики технологических перевозок;

8) суточный план-график работы станции и подъездного пути;

9) технологическое время на выполнение грузовых операций;

10) расчет технологических сроков оборота вагонов на подъездном пути;

11) порядок оперативного планирования, руководства и организации грузовой и коммерческой работы на станции и подъездном пути;

12) мероприятия по обеспечению работы в зимних условиях;

13) меры по сохранности вагонного парка;

14) мероприятия по осуществлению контроля и анализа выполняемой работы;

15) расчетная часть, приложения;

16) сведения связанные с работой подъездных путей и станций примыкания.

7. Состав комиссии осуществляющей разработку единых технологических процессов и их согласование определяется Правилами перевозок грузов железнодорожным транспортом, утверждаемыми в соответствии с подпунктом 34-33) пункта 2 статьи 14 Закона.

8. Особенности единых технологических процессов устанавливаются комиссией осуществляющей подготовку единых технологических процессов исходя из используемых на подъездном пути и станции примыкания технологических средств, сооружений и устройств, времени года, погодных условий местности и иных факторов влияющих на работу подъездных путей и станций примыкания.

9. Бесперебойная работа подъездного пути в зимних условиях зависит от своевременности и качества подготовки транспортного хозяйства, проведения технологических и технических мер.

При подготовке к зимнему периоду предусматриваются особенности организации приема и отправления поездов, маневровой работы, подачи-уборки вагонов, в том числе условия применения средств профилактики при погрузке и выгрузке смерзающихся грузов.

10. При разработке единого технологического процесса необходимо учитывать данные о фактическом прибытии и отправлении грузов, погрузке и выгрузке (разгрузке) в вагонах и тоннах за предыдущий год с разделением по месяцам, собственникам (принадлежности) вагонов, наименованию груза, типу подвижного состава.

11. Итогом разработки единого технологического процесса является суточный план-график (в произвольной форме), обеспечивающий рациональное использование всех технических средств, сооружений и устройств станции и подъездного пути и определяющий технологический срок оборота вагонов на подъездном пути.

12. Единый технологический процесс корректируется в случаях изменения технологии работы участников перевозочного процесса задействованных в разработки единых технологических процессов.

При истечении срока договора на подачу-уборку вагонов единый технологический процесс составляется вновь или по решению комиссии осуществляющей разработку единых технологических процессов пролонгируется.

In accordance with sub-clause 34-36) of clause 2 of article 14 of the Law of the Republic of Kazakhstan dated December 8, 2001 "On Railway Transport" I HEREBY ORDER:

1. To approve the attached Rules for the development of unified technological processes for operation of access roads and connecting stations.

2. The Transport Committee of the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan in accordance with the procedure established by the law shall ensure:

1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order, its direction in Kazakh and Russian languages to the Republican State Enterprise on the right of economic management “Institute of Legislation and Legal Information of the Republic of Kazakhstan” of the Ministry of Justice of the Republic of Kazakhstan for official publication and placement in the Reference Control Bank of the Regulatory Legal Acts of the Republic of Kazakhstan;

3) Posting this order on the Internet resource of the Ministry of Industry and Infrastructural Development of the Republic of Kazakhstan.

3. Control over execution of this order shall be entrusted to the supervising vice-minister of Industry and Infrastructural Development of the Republic of Kazakhstan.

4. This order shall come into force upon expiry of ten calendar days from the date of its official publication.

Rules for the development of unified technological processes for operation
of access roads and connecting stations

Chapter 1. General provisions

1. These Rules for the development of unified technological processes for operation of access roads and connecting stations (hereinafter referred to as the Правила) have been developed in accordance with sub-clause 34-36) of clause 2 of article 14 of the Law of the Republic of Kazakhstan dated December 8, 2001 "On Railway Transport " (hereinafter referred to as the Law) and shall determine the procedure for development of unified technological processes for operation of access roads and connecting station (hereinafter referred to as the unified technological process).

2. Development of the unified technological processes shall be carried out to ensure coordinated, technical and technological work of access roads of organizations serviced by their own locomotives with an average daily freight turnover of 50 (fifty) cars and above.

3. The unified technological process is a document (in a free form) regulating the conditions for interaction of an access road and an connecting station, required for conclusion of an agreement for spotting - picking of cars.

Chapter 2. Procedure for the development of unified technological processes for operation
of access roads and connecting stations

4. The unified technological process shall be developed through interaction of participants of transportation process based on the concluded agreements in accordance with the civil legislation of the Republic of Kazakhstan, legislation of the Republic of Kazakhstan on rail transport and international agreements (treaties).

5. The unified technological process shall contain a clear meaning not subject not divergent interpretation.

6. To ensure uniformity in development of the unified technological processes, it shall include the following information:

1) technical and operational characteristics of structures and devices of access roads and connecting stations;

2) the size of freight and car flows calculated on the basis of the actual and maximum planned (from the next three years) volume of cargo transportation, except for enterprises with planned - decreasing production volumes;

3) arrangement of shunting operations and calculation of norms for performance of technical operations;

4) the implementation of the cooperated use of technical means, structures and devices of the access road and the connecting station;

5) arrangement of spotting-picking of cars;

6) schedules for cars handling, transfer and trains;

7) schedules for technological transportation;

8) daily schedule of the station and the access road;

9) technological time for cargo operations;

10) calculation of technological terms for turnover of cars on the access road;

11) the procedure for operational planning, management and organization of freight and commercial work at the station and access road;

12) measures to ensure work in winter conditions;

13) measures for the safety of the rolling stock;

14) activities for monitoring and analysis of work performed;

15) calculation part, applications;

16) information related to the operation of access roads and connecting stations.

7. The composition of the commission carrying out the development of the unified technological processes and their coordination shall be determined by the Rules for cargo transportation by rail transport in accordance with sub-clause 34-33) of clause 2 of article 14 of the Law.

8. The peculiar features of the unified technological processes shall be established by the commission preparing the the unified technological processes based on the technological means, structures and devices used on the access road and the connecting station, season, weather conditions and other factors affecting the operation of access roads and connecting stations.

9. Uninterrupted operation of the access road in winter conditions depends on the timeliness and quality of preparation of the transport sector, the implementation of technological and technical measures.

In preparation for the winter period, features are provided for the organization of the reception and departure of trains, shunting operation, spotting-picking of cars, including the conditions for the use of preventive measures when loading and unloading freezable goods.

10. When developing a unified technological process, it is necessary to take into account data on the actual arrival and departure of goods, loading and unloading (unloading) in the rolling stock and tons for the previous year, divided by months, owners (ownership) of cars, name of cargo, type of rolling stock.

11. The result of the development of a unified technological process shall be a daily schedule (in any form) that ensures the rational use of all technical equipment, structures and devices of the station and the access road and determines the technological period for the turnover of cars on the access road.

12. The unified technological process shall be adjusted in cases of changes in the technology of work of the transportation process participants involved in the development of the unified technological processes.

Upon the expiration of the contract for the supply and cleaning of cars, the unified technological process shall be drawn up again or, by decision of the commission carrying out the development of the unified technological processes, shall be extended.
